Dear Assembly Member Bonta:
The City of Diamond Bar respectfully opposes AB 34, as amended on May 5,
2015. The City is appreciate of efforts to modify the legislation, however, the
May 5th amendments do not go far enough to protect local control.
Specifically, the May 5th amendments do not ensure that the legal force of
local ordinances, or local governments' ability to regulate marijuana
businesses to the same extent as is true under current law, will remain intact.
In fact, local governments' ability to regulate marijuana businesses will be
significantly curtailed under AB 34, due in part to the pre-emptive enforcement
model followed by the Department of Alcoholic Beverage Control (ABC), which
remains in overall charge of enforcement.
AB 34 still does not make explicit reference to the regulatory authority, namely
local permitting and licensing, that local ordinances have over medical
marijuana businesses. Additionally, the enforcement of AB 34's regulatory
scheme will only serve to weaken our city's existing enforcement authority.
Ultimately, the City of Diamond Bar has no desire to have its land use
authority or its local ordinances pre-empted by a state regulatory scheme, and
is opposed to any law that compels the City to facilitate points of sale of
marijuana—whether medicinal or recreational—within its boundaries.
For these reasons, the City of Diamond Bar opposes AB 34.
