Dear Assembly Member Chu:
The City of Diamond Bar respectfully opposes AB 718, which would prohibit
local agencies from enforcing laws and ordinances regulating the act of people
sleeping or resting in parked motor vehicles.
Parking locations, whether on public or private property, were never intended
or designed for residential occupancy. Such uses raise major issues of
sanitation as well as the ability of residents to feel secure in their homes and
enable the conduct of business activity. Cities across the state work hard to
balance all of the needs of their communities, and therefore, it is not
appropriate for the Legislature to remove local government authority to protect
the public health, safety and welfare of their residents.
Additionally, it is increasingly concerning that the State Legislature places the
responsibility for statewide issues on local governments, all while removing
local authority and burdening municipalities with the increasingly costly
financial impacts.
For these reasons, the City of Diamond Bar opposes AB 718.
