A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF DIAMOND BAR PERTAINING TO 01ABSTAIN12 VOTES.
A. Recitals.
(i) The common law of the State of California
establishes that an "abstain" vote shall be considered an
acquiescence to the will of the majority of a quorum of this City
Council.
(ii) California Law provides that this Council may, in
its discretion, establish rules of procedure including rules
providing for the effect of "abstain" votes.
(iii) All legal prerequisites to the adoption of this
Resolution have occurred.
B. Resolution.
NOW, THEREFORE, the City Council of the City of Diamond
Bar hereby finds, determines and resolves as follows:
1. As all respects as set forth in the Recitals, Part
A, of this Resolution.
2. Notwithstanding any other rule of procedure
heretofore adopted or imposed on this City Council, an "abstain"
vote shall not be deemed to be a vote in favor or in acquiescence
to the will of the majority of a quorum and shall be considered
of the same force and effect as if the individual Council Member
were absent at the time of the taking of the vote on the motion
M presented.

3. The City Clerk shall certify to the adoption of
this Resolution.
PASSED, ADOPTED AND APPROVED this 19th day of
