HomeMy WebLinkAboutRES 89-84RESOLUTION NO. 89- 84 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DIAMOND BAR ADOPTING A SPEED ZONE STUDY JUSTIFYING SPEED LIMITS ON CERTAIN CITY STREETS A. Recitals. (i) California Vehicle Code Section 40803(b) provides, in pertinent part, as follows: "In any prosecution under this Code of a charge involving the speed of a vehicle, where enforcement involves the use of radar or other electronic devices which measure the speed of moving objects the prosecution shall establish, as part of its prima facie case, that the evidence or testimony presented is not based upon a speed trap as defined in subdivision (b) of Section 40802..." (ii) The City of Diamond Bar desires to use radar and other electronic devices to measure the speed of moving objects in order to protect the lives and property of motorists utilizing City streets and to improve the enforcement of speed limits within the City of Diamond Bar. (iii) The City's Traffic Engineering Consultant has conducted a speed zone study establishing and justifying prima facie speed limits on certain City streets within the City of Diamond Bar. (iv) The Speed Zone Study prepared by the City's Traffic Engineering Consultant, dated September 5, 1989, is attached hereto as Exhibit "A" and incorporated by this reference as though fully set forth herein. B. Resolution. NOW, THEREFORE, the City Council of the City of Diamond Bar does hereby find, determine and resolve as follows; 1. In all respects as set forth in the Recitals, Part A, of this Resolution. 2. The Speed Zone Study submitted by the City's Traffic Engineering Consultant dated September 5, 1989, and attached hereto as Exhibit "A" is hereby adopted and approved, in its entirety, as the official Speed Zone Study for the City of Diamond Bar concerning certain City streets more specifically described therein. 3. The City Clerk shall: a. Certify a copy of said Speed Zone Study for transmittal to the Los Angeles County District Attorney's Office for use in prosecutions under the California Vehicle Code; and Resolution. 1989. b.
