A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DIAMOND BAR, CALIFORNIA, DETERMINING THE AUTHORITY AND
RESPONSIBILITY FOR INSPECTION OF CITY BRIDGES, INDEMNIFYING THE
COUNTY OF LOS ANGELES FOR SUCH INSPECTION, AND PROVIDING FOR
PAYMENT OF COSTS THEREOF.
WHEREAS, the Board of Supervisors of the County of
Los Angeles did, on March 20, 1973, duly adopt a resolution
determining that, upon the concurrence of a City, the County
shall have the authority and responsibility for the inspection
of all City bridges within said City; and
WHEREAS, it is in the best interests of this City
that inspections of this City's bridges be standardized in
character and uniform in nature with similar inspections of
County bridges and of bridges in other cities within the
County;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
DIAMOND BAR, CALIFORNIA, DOES HEREBY FIND, DETERMINE AND
RESOLVE AS FOLLOWS:
SECTION 1. This City Council does hereby consent and
concur that the County of Los Angeles shall have the authority
and responsibility for the inspection of all City bridges
within the City of Diamond Bar as provided in Section 1394 of
the Streets and Highways Code of the State of California.
SECTION 2. The City shall indemnify, defend and hold
harmless the County of Los Angeles, and its officers, agents
and employees from any liability imposed for injury (as defined
by Government Code, Section 810.8) occurring by reason of any
injury to persons or property caused by or due to the failure
of the County of Los Angeles to properly perform its
responsibility to inspect City's bridges.
SECTION 3. The inspection of said bridges by County
shall be at no cost to the City of Diamond Bar, but all such
costs shall be borne by the County of Los Angeles.
SECTION 4. The authority and responsibility vested
in County by this Resolution, and the termination thereof,
shall be in accordance with the terms and conditions of the
Resolution of the County of Los Angeles, hereinabove referred
to.
SECTION 5. This resolution shall take effect and be
in full force and virtue immediately upon its passage and
adoption thereof.
SECTION 6. That the City Clerk shall certify to the
passage and adoption of this resolution; shall cause the same
to be entered in the book of original resolutions of said City;
shall cause a certified copy thereof to be forwarded to the Los
Angeles County Board of Supervisors, and shall make a minute of
the passage and adoption thereof in the records of the
proceedings of the City Council of said City in the minutes of
the meeting at which the same is passed and adopted.
