GENERAL INFt3RMATiON
In September, 1986, the State Legislature passed and the Govemor signed Assembly Biil 2926. This bitl grants schaal
distr'�cts in California tha power to levy deva{oper fees on residentiai and cammerciat developments for the purpose of
financing the canstruction af schaol faci4ities. The Pomo�a Unified Schoal District (PUSD) began levying AB 2926 fees
effective October 19, 1987. AB 2926 applies to all new development with the following two exceptions:
1. Any residentiai project cavered by an agreement entered'+nto before January t, 1887 which requires the payment of
fees, charges, ar dedications far construction of school facilities as a condftion of approvai.
2. Any development praject far which a final map was approved and constructiun had cammenced on or before
September 1, 19B6. {Such projects would be liable tor any fees in effect,on that date.)
PAYING THE FEE
State law now prahibiks a city or county fram issuing a buiiding permit unless tha local schaoi district has cect'rfied that the
applica'ion is in compliance with its Developer Fea Program. Following is the pracedure for obtaini»g this required certification:
1. A set of project plans s#amped by tha goveming Ciry or County building depariment, and vaivatian receipt ind'tcating
calculated square footage and plan chsck number cnust be reviewed at Facilities Plan�ing, Growth 8� Develapment
Department of Pomo�a Unified School District, Education Center, located at 800 Souih Garey Avenue, Pomona.

including basements, intermediate floor tiers or mezzanines, and penthouses, measured from the exterior walts and
the exterior faces af walls separating canditioned and unconditioned spaces for which the bui)ding permit will be
applicab{e. Qo not inciude unenolased cave�ed walkways, open raafed over areas, unenclosed parches, exckerior
terracas ar steps,chimneys, rool overhangs,parking garages or unheated basements.

2. District staff wil!varify projsct square foatags and building use, and complete the required certificate of compliance
during available hours. Available hours for payment of developer tees are from 2:30-d:30pm Monday thru Friday,
ather times available by appointment by calling(9d9}3S7-d800 Ext.3520.
3. Fees due are paid to appropriate District accaunting personnel.
4. A copy af tha campleted certification wii{be returned far use in abtaining building permits.
APPEAL PROCESS
1. Any claim by a building permit applicant that his/her project should be exempt from assessment of schooi
development fees mus#be made in writing and filed with the DistricYs Businass Senrices{?ffice p�iar to the issuance
of a Cert'rficatian af Campliance. The claim must speci(y ihe exerription requested and all grounds supporking the
claim. In addition the claim must contain a statement spec'rfying the nature of the project, and date project building
permit application was filed.
2. The Superintendent,or his designee,shal!respo�d in writing to a claim within fourteen (14)days from receipt oi the
claim. The response shall contain the Superintend�nYs decision on the claim, and a statament of the reasons
supporting tha decision.
3. Any claimant who is dissatisfied with the Superintendent's decision may request review by the district's Baard of
Education. A request for review must be written and filad with the Superintendent's oftice not later than ten(14)days
fram the date of the Superintendent's decision. The request must contain a statement of all grounds in support of the
continuing claim.
4. The Board of Educatian shall consider and act upon a request for review at a public meeting nat later than thirty(30)
days from the date of filing of the request. A claimant may appear and address the board in regard to the ciaim. The
Board shall provide written notice of its decisian to be maiied to the claimani w'sthin fourteen{14}days afEer the public
meeting at which the Board acted upc�n the c4aim.

GENERALINFORMATION
In September, 1986,the State Legislature passed and the Governor signed Assembly Bill 2926.This bill grants school
districts in California the power to levy developer fees on residential and commercial developments for the purpose of
financing the construction of school facilities.The Pomona Unified School District(PUSD)began levying AB 2926 fees
effective October 19, 1987.AB 2926 applies to all new development with the following two exceptions:
1.Any residential project covered by an agreement entered into before January 1, 1987 which requires the payment of
fees,charges,or dedications for construction of school facilities as a condition of approval.
2.Any development project for which a final map was approved and construction had commenced on or before
September 1, 1986. (Such projects would be liable for any fees in effect,on that date.)
PAYING THE FEE
State law now prohibits a city or county from issuing a building permit unless the local school district has certified that the
application is in compliance with its Developer Fee Program. Following is the procedure for obtaining this required certification:
1.A set of project plans stamped by the governing City or County building department,and valuation receipt indicating
calculated square footage and plan check number must be reviewed at Facilities Planning,Growth&Development
Department of Pomona Unified School District, Education Center,located at 800 South Garey Avenue,Pomona.
Calculating Area for Residential Projects-Total square foot floor areas of new/added conditioned space of all floors
including basements,intermediate floor tiers or mezzanines,and penthouses, measured from the exterior walls and
the exterior faces of walls separating conditioned and unconditioned spaces for which the building permit will be
applicable. Do not include unenclosed covered walkways,open roofed over areas,unenclosed porches,exterior
terraces or steps,chimneys, roof overhangs, parking garages or unheated basements.
Calculating Area for Commercial Projects-Total covered square foot floor areas of new/added floors measured from
the exterior faces of the surrounding exterior walls of the structure(s)/addition(s)for which the building permit will be
applicable.
2. District staff will verify project square footage and building use,and complete the required certificate of compliance
during available hours.Available hours for payment of developer fees are from 2:30-4:30pm Monday thru Friday,
other times available by appointment by calling(909)397-4800 Ext. 3920.
3. Fees due are paid to appropriate District accounting personnel.
4.A copy of the completed certification will be returned for use in obtaining building permits.
APPEAL PROCESS
1.Any claim by a building permit applicant that his/her project should be exempt from assessment of school
development fees must be made in writing and filed with the District's Business Services Office prior to the issuance
of a Certification of Compliance.The claim must specify the exemption requested and all grounds supporting the
claim. In addition the claim must contain a statement specifying the nature of the project,and date project building
permit application was filed.
2.The Superintendent,or his designee,shall respond in writing to a claim within fourteen (14)days from receipt of the
claim.The response shall contain the Superintendent's decision on the claim,and a statement of the reasons
supporting the decision.
3.Any claimant who is dissatisfied with the Superintendent's decision may request review by the district's Board of
Education.A request for review must be written and filed with the Superintendent's office not later than ten (10)days
from the date of the Superintendent's decision.The request must contain a statement of all grounds in support of the
continuing claim.
4.The Board of Education shall consider and act upon a request for review at a public meeting not later than thirty(30)
days from the date of filing of the request.A claimant may appear and address the board in regard to the claim.The
Board shall provide written notice of its decision to be mailed to the claimant within fourteen (14)days after the public
meeting at which the Board acted upon the claim.
