Dear Assembly Member Gonzalez:
The City of Diamond Bar respectfully opposes Assembly Bill 5 (AB 5), as the
proposed legislation would impose new requirements limiting a municipality's
initial ability to best meet an agency's staffing needs.
AB 5 would require an employer with 10 or more employees to offer additional
hours of work to an existing nonexempt employee before hiring another
employee or subcontractor. Employers often face circumstances where hiring
Jimmy Lin another employee or subcontractor is beneficial to the agency for a variety of
Mayor reasons, such as the specialized nature of the work being performed, timing
Ruth M. Low constraints associated with a project, and the ability to allow for staffing
Mayor Pro Tem flexibility. The burdensome and costly process of initially offering additional
hours of work to existing non-exempt employees, when it is not in the best
Carol Herrera interests of the organization, would negatively impact the agency by
Council Member expending unnecessary resources and delay essential work from being
Nancy A. Lyons performed.
Council Member
For these reasons, the City of Diamond Bar opposes AB 5.
Steve Tye
Council Member Sincerely,
Jimmy Lin
