Dear Assembly Member Feuer:
The City Council of Diamond Bar respectfully opposes AB 602, which would
extend the statute of limitations and allow for a broad array of potential lawsuits
that could leave cities, businesses, and developers unfairly open to challenges
long after decisions have been made.
The City of Diamond Bar strongly objects to this legislation because it changes
the statue of limitations from any time after an action to adopt, amend, or revise
a housing element to within five years after any action. This amendment would
dramatically impact development because municipalities could be challenged
and projects shut down while the courts issue a decision. Jeopardizing
investment in new projects in this time of extreme economic hardship is
something we can ill afford.
The City of Diamond Bar values certainty for planning and land use decisions.
The changes proposed in AB 602 impact the local control of municipal
governments to make even the most basic land use decisions without a long-
term threat of litigation.
For these reasons, the City of Diamond Bar is opposed to AB 602.
