CDD/Gubman reported that the Commission's normally next scheduled meeting is November 11, Veterans' Day, and that meeting will be canceled. The Commission will reconvene on Tuesday, November 25, two days prior to Thanksgiving. The November 25 agenda includes a proposed drive-through car wash addition to the Chevron Station located across the street from Diamond Bar High School at the corner of Brea Canyon Road and Pathfinder Road. Staff also expects to have the new commercial building on the vacant pad across from Chili's on. the November 25 agenda for approval. If the Commission would like, he will make a brief presentation to show the new City entry monuments approved by the City Council last week. CDD/Gubman proceeded with his Power Point presentation of the final approved design for the new City entry monuments, an offshoot of the Grand Avenue Beautification Project, a complete reconstruction of the intersection of Grand Avenue and Diamond Bar Boulevard establishing a new design palette and. unifying theme and character that defines the character of the City, intended to be carried throughout the City as intersections and key corridors are improved. The first proposed location for the City entry monument is at Grand Avenue and Longview replacing OCTOBER 28, 2014 PAGE 4 PLANNING COMMISSION the existing "fly swatter" pole in the median. A new landscape median will be extended to the City limit to accommodate placement of the new monument sign which incorporates thematic elements from the Grand Avenue Beautification and visual character of the City's natural setting, stone cladding from the Diamond Bar Center and abstracted shapes and symbols found in the City Seal. There is no literal representation of the City's seal on any of the monument surfaces because the seal is very distinctive, formal and officious and staff wanted to avoid that tone in the new design to let folks know they are entering a place and not a jurisdiction. C/Mahlke asked the height of the new monument sign and CDD/Gubman responded that it is about 10 feet tall. CDD/Gubman explained the look and materials used for the monument sign and said that the name "City of Diamond Bar" was avoided to give people the idea that they were "entering our turf' and only "Diamond Bar" was used to reinforce Diamond Bar as a brand and that they were entering a "Place.". In addition to the monument in the center there will be pillars on either side to create a "gateway" composition. Eventually, these monument features will be used at each of the City's entries and more significantly, as the new landmark entry feature at the new Diamond Canyon Park at the corner of Diamond Bar Boulevard and Brea Canyon Road. C/Low asked if the plantings would be varied throughout the City or more uniform in nature. CDD/Gubman responded that the plant palette is the same palette that the Diamond Bar Boulevard Beautification project enjoys. The project site is located in the Diamond Bar Country Estates (The Country)', on the east side of Rocky View Road, a cul-de-sac street south of Ridge Line Road. The property is undeveloped and slopes downward from the street at a 16 percent average slope to the rear property line. There are four existing trees on the site, consisting of ti-iree Black Walnuts and one Lemon Scented Gum eucalyptus. However, only one of the three Black Walnut trees is considered a protected tree due to the cumulative diameter of the multi -trunk tree. The other two Black Walnut (sii-igle-trunk) trees have a diameter at breast height (DBH) of less than 8 inches, therefore, not considered protected trees. On June 7, 1972, the Board of Supervisors of the County of Los Angeles, based on the evidence presented and recommended by the County Engineer at the time, determined that the easement for restricted use area for this property, and others within the Tract, was no longer required to protect the public from geologic hazard and adopted an order to abandon said RUA, as recorded with Document No. 1941 of Official Records on file with the Office of Registrar- Recorder/County Clerk of the County of Los Angeles. However, the Assessor's Parcel Map has not been updated to reflect this action. For clarification, staff acknowledges the action taken by the Board of Supervisors of the County of Los Angeles and considers the RUA shown on the Assessor's Parcel Map as abandoned, per the recorded document identified above. The property is legally described as Lot 123 of Tract No. 30091, and the Assessor's Parcel Number (APN) is 8713-030-001. =41 � The proposed single-family house consists of the following site plan and architectural components: Site Plan The property's gross lot area is 49,223 square feet (1.13 acres), and includes a 29 -foot wide private street easement for Rocky View Road along its frontage. The property's net buildable area (i.e., minus the private street easement) is 45,346 square feet (1.04 acres). The house is situated* toward the front of the lot, a minimum of 30 feet from the edge of the street easement line. A series of retaining walls and significant grading at the center of the property will create level pads to facilitate the development of the house and useable open space at the rear of the home, which will include a swimming pool, a lawn area, and other landscape and hardscape surface areas. Landscaping is proposed throughout the front and rear yard to enhance the architecture and to create an overall site design that blends in with the neighboring homes and the natural environment to the site. As mentioned, the applicant is proposing four, 4 -foot high terraced retaining walls in the middle of the property to create a minimum 25 -foot rear pad to comply with the City's development standards for the rear setback. A condition of approval will be added to the resolution for plans to show that all exposed portions of retaining walls will be finished with a float textured stucco application or decorative stone veneer to match the proposed exterior wall finish of the house. The home consists of the following components: A 3,630 square -foot upper level consisting of three bedrooms, including the master bedroom with bathroom and walk-in closet, laundry room, recreation room, and loft area; A 3,729 square -foot middle (street) level consisting of an entry area, living room, dining room, library, kitchen, wok (second kitchen), family room, and bedroom with bathroom and walk-in closet; A 4,036 square -foot lower level consisting of a home theater, game room, wine cellar, wet bar, gym, second laundry room, second master bedroom with bath and walk-in closet, two bedrooms with bathroom and closet, and powder room; ® 1,394 square feet of balcony/patio/porch area; and e A 1,074 square -foot, attached five -car garage. The multi-level home is accessed by two internal staircases and an elevator. The height of the building is 35', measured from the finished grade to the highest point of the roofline. The analysis that follows provides the basis for staff's recommendation to approve the DR and TP applications. New construction of a single-family home requires Planning Commission approval of a Development Review (DR) application. Development Review approval is required to ensure compliance with the City's General Plan policies, development standards, and design guidelines, and to minimize adverse effects of the proposed project upon the surrounding properties and the City in general. As stated in Section 22.48.010 of the Development Code, the Development Review process was established to ensure that new development and additions to existing development are consistent with the General Plan "through the promotion of high functional and aesthetic standards to complement and add to the economic, physical, and social character" of Diamond Bar. Site and Grading Configuration: The project site is located on a rectangular shaped property with a descending 16 percent average slope to the rear property line. The applicant is proposing to cut 564 cubic yards of soil and fill 11,314 cubic yards of soil to create split-level Development Review and Tree Permit No. PL 2014-238 Page 6 of 10 buildable pads towards the front of the property. Therefore, 10,750 cubic yards would have to be imported to the site. Standard dump truck capacities range from 10 to 15 cubic yards, so the proposed amount of import would require between 716 to 1,075 deliveries. The site is located on undisturbed grade and will be modified to allow for split level pads for the lower and street level floor areas. A series of four 4 -foot high tiered retaining walls will be constructed to accommodate the additional pad area in the rear yard. Architectural Features, Colors, and Materials: The architectural style is Eclectic Prairie. The applicant designed the project to have a variety of architectural elements to reflect the architectural style, including the following design features: ® Low pitched, hip and valley roofs with flat concrete roof tiles; ® Fagade details emphasizing horizontal lines, such as windows grouped in horizontal bands; ® Two -foot deep overhanging eaves; and ® Natural colors used to highlight architectural details and integrate with the landscape. The applicant is proposing to use a variety of colors and materials to create character and articulation. The fagade of the house will have float textured stucco and stone veneer walls, and vinyl window framing throughout the fenestration pattern. The scale and proportions of the proposed home are well balanced and appropriate for the site. Landscaping: Landscaping is used to soften the look of the paved surfaces, enhance the architecture, and create an overall site design that blends in with neighboring homes and the natural environment of the site. In the front yard, a variety of five -gallon shrubs such as Foxtail agave and Cleveland sage are complemented with a mix of perennials and ground cover along the driveway and a walkway consisting of decomposed granite. Also, two 24 -inch box African Sumac trees will be planted at the front corners of the property. All plant types will be drought tolerant and non-invasive species. The project is required to comply with the City's Water Conservation Landscaping Ordinance, which is noted on the preliminary landscape plans and will be verified during building plan check. The subject property is located within the Los Angeles County Fire Department "Very High Fire Hazard Severity Zone." Therefore, the proposed landscaping must comply with the Fire Department's Fuel Modification Plan, requirements. The* landscape plans will be submitted for review and approval by the Fire Department during building plan check. Tree Permits are required when the removal or protection of a protected tree is requested. A protected tree is any of the following: Development Review and Tree Permit No. PL 2014-2818 Page 7 of 10 Native oak, walnut, sycamore and willow trees with a diameter at breast height ("DBH" i.e., 4.5 feet above ground level) of eight inches or greater; • Trees of significant historical or value as designated by the council; • Any tree required to be preserved or relocated as a condition of approval for a discretionary permit; • Any tree required to be planted as a condition of approval for a discretionary permit; and • A stand of trees, the nature of which makes each tree dependent upon the others for survival. The Development Code requires the preservation and maintenance of walnut trees with a DBH of eight inches or greater. When removal is allowed as a result of new development, replacement trees shall be planted at a minimum 3:1 ratio in residential lots greater than 20,000 square feet. The applicant submitted an arboriculture report, prepared by a licensed arborist, which indicates one protected tree exists on the property. The protected tree is a multi -trunk Black Walnut tree with five trunks having a DBH of four inches, each. The removal of the protected tree and replanting of six Black Walnut trees complies with the required minimum tree replacement ratio of 3:1. Therefore, it is not anticipated that the removal of the protected tree and replacement of six 24 -inch box Black Walnut trees will be detrimental to the overall contribution of natural vegetation of protected or non -protected tree species. The proposed project was reviewed for compliance with the City's Hillside Management Design Guidelines and regulations. The project complies with all of the regulations and guidelines to ensure that development will complement the character and topography of hillside areas set forth in the Development Code. The project site was designed with: All proposed retaining walls associated with the building pad are at a maximum exposed height of four feet; • Split pads are used to step down the natural slope; • Earth tone building materials and color schemes are used that blend in with the natural landscape; • The project is terraced on two pad levels. From the street view, the building has an appearance of a two-story structure, but the rear of the building steps down to three levels. The project complies with all of the regulations and guidelines to ensure that development will complement the character and topography of hillside areas set forth in the Development Code. The project is designed to be compatible with and enhance the character of the existing homes in the neighborhood. The new house will not be intrusive to neighboring homes and will not block existing views since the home on the north side of the property is at a higher elevation and the property to the south is situated at the end of the cul-de-sac, with views looking to the south. The project incorporates the principles of the City's Residential Design Guidelines as follows: The new single-family residence will conform to all development standards, including building height and setbacks, which is consistent with other homes in The Country Estates; A gradual transition between the project and adjacent uses is achieved through appropriate setbacks, building height, landscaping, and window and door placement; o The proposed new single-family residence is appropriate in mass and scale to the site; a Elevations are treated with detailed architectural elements; Roof lines are representative of the design and scale of the structure through vertical and horizontal articulations such as hip and valley roofs; Proper screening for ground and roof -mounted equipment is architecturally compatible with the dwelling in terms of materials, color, shape, and size and blends in with the proposed building design; 0 Large wall expanses without windows or doors are avoided; e The exterior finish materials and colors blend with the natural environment; Landscaping is used to emphasize and highlight focal points such as gardens, patios and walkways; and Landscaping is used to soften building lines and blend a structure with its environment, creating a transition between the hard vertical edges of the structure and the softer horizontal lines of the site. The Public Works Department and Building and Safety Division reviewed this project, and their comments are included in the attached resolution as conditions of approval. The construction documents submitted for plan check shall be in substantial, compliance with the architectural plans approved by the Planning Commission, as modified pursuant to the conditions below. If the plan check submittal is not in substantial compliance with the approved Development Review submittal, the plans may require further staff review and re -notification of the surrounding property owners, which may delay the project and entail additional fees. 3. To ensure compliance with the provisions of i the Planning Commission approval, a final inspection is required from the Planning Division when work for any phase of the project has been completed. All graffiti shall be removed within 72 hours by the property owners/occupant. 10. All landscaping, structures, architectural features and public improvements damaged during construction shall be repaired or replaced upon project completion. SOLID WASTE The- site shall be maintained in a condition, which is free of debris both during and after the construction, addition,, or implementation of the entitlement approved herein. The removal of all trash, debris, and refuse, whether during or subsequent to construction shall be done only by the property owner, applicant or by a duly permitted waste contractor, who has been authorized by the City to provide collection, transportation, and disposal of solid waste from residential, commercial, construction, and industrial areas within the City. It shall be the applicant's obligation to insure that the waste contractor used has obtained permits from the City of Diamond Bar to provide such services. 2. Mandatory solid waste disposal services shall be provided by the City franchised waste hauler to all parcels/lots or uses affected by approval of this project. 9 Planning Commission Resolution No. 2014 -XX F. FIRE PROTECTION STANDARDS 1. Development shall be constructed to reduce the potential for spread of brushfire. a. In the case of a conflict, where more restrictive provisions are contained in the Uniform Building Code or in the fire code, the more restrictive provisions shall prevail. b. Roofs shall be covered with noncombustible materials as defined in the building code. Open eave ends shall be stopped in order to prevent bird nests or other combustible material lodging within the roof and to preclude entry of flames. C. Exterior walls shall be surfaced with noncombustible or fire-resistant materials. d. Balconies, patio roofs, eaves and other similar overhangs shall be of noncombustible construction or shall be protected by fire-resistant material in compliance with the building code. 2. All .development shall be constructed with adequate water supply and pressure for all proposed development in compliance with standards est:,blished by the fire marshal. 3. A permanent fuel modification area shall be required around development projects or portions thereof that are adjacent or exposed to hazardous fire areas for the purpose of fire protection. The required width of the fuel modification area shall be based on applicable building and fire codes and a fire hazard analysis study developed by the -fire marshal. In the event abatement is not performed, the council may instruct the fire marshal to give notice to.the owner of the property upon which the condition exists to correct the prohibited condition. An Erosion Control Plan shall be submitted concurrently with the grading plan clearly detailing erosion control measures. These measures shall be implemented during construction. The erosion control plan shall conform to National Pollutant Discharge Elimination System (NPDES) standards and incorporate the appropriate Best Management Practices (BMP's) as specified in the Storm Water BMP Certification. Grading and construction activities and the transportation of equipment and materials and operation of heavy grading equipment shall be limited to between the hours of 7:00 a.m. and 5:00 p.m., Monday through Saturday. Dust generated by grading and construction activities shall be Ceduced by watering the soil prior to and during the activities and in accordance with South Coast Air Quality Management District Rule 402 and Rule 403. Reclaimed water shall be used whenever possible. In addition, all construction equipment shall be properly muffled to reduce noise levels. 2. SOILS REPORT/GRADING/RETAINING WALLS a. Prior to grading plan submittal, a geotechnical report prepared by a Geotechnical Engineer, licensed by the State of California, shall be submitted by the applicant for approval by the City. b. Upon approval of the geotechnical report, the applicant shall submit drainage and grading plans prepared by a Civil Engineer, licensed by the State of California, prepared in accordance with the City's requirements for the City's review and approval. A list of requirements for grading plan check is available from the Public Works Department. All grading (cut and fill) calculations shall be submitted to the City concurrently with the grading plan. C. Finished slopes shall conform to City Code Section 22.22.080 -Grading. d. The grading plan shall show the location of any retaining walls and the elevations of the top of wall/footing/retaining and the finished grade on both sides of the retaining wall. Construction details for retaining wails shall be shown on the grading plan. Calculations and details of retaining 11 Planning Commission Resolution No. 2014 -XX walls shall be submitted to the Building and Safety Division for review and approval. e. All equipment staging areas shall be located on the project site. Staging area, including material stockpile and equipment storage area, shall be enclosed within a six foot -high chain link fence. All access points in the defense shall be locked whenever the construction site is not supervised. Grading of the subject property shall be in accordance with the California Building Code, City Grading Ordinance, Hillside Management Ordinance and acceptable grading practices. 9. The maximum grade of driveways serving building pad areas shall be 15 percent. In hillside areas driveway grades exceeding 15 percent shall have parking landings with a minimum 16 feet deep and shall not exceed five (5) percent grade or as required by the City Engineer. Driveways with 6 slope of 15 percent shall incorporate grooves for traction into the construction as required by the City Engineer. h. All slopes shall be seeded per landscape plan and/or fuel modification plan with native grasses or planted with ground cover, shrubs, and trees for erosion control upon completion of grading or some other alternative method of erosion control shall be completed to the satisfaction of the City Engineer. Prior to the issuance of building permits, a pre -construction meeting shall be held at the project site with the grading contractor, applicant, and city grading inspector at least 48 hours prior to commencing grading operations. Rough grade certifications by project soils and civil engineers shall be submitted prior to issuance of building permits for the foundation of the residential structure. Retaining wall permits may be issued without a rough grade certificate. k. Final grade certifications by project civil engineers shall be submitted to the Public Works Department prior to the issuance of any project final inspections/certificate of occupancy respectively. a. Detailed drainage system information of the lot with careful attention to any flood hazard area shall be submitted. All drainage/runoff from the development shall be conveyed from the site to the natural drainage course. No on-site drainrge shall be conveyed to adjacent parcels, unless that is the natural drainage course. 12 Planning Commission Resolution No. 2014 -XX H. The minimum design load for wind in this area is 110 M.P.H. exposures "C" and the site is within seismic zone D or E. The applicant shall submit drawings and calculations prepared by a California State licensed Architect/Engineer with wet stamp and signature. e. This project shall comply with the energy conservation requirements of the State of California Energy Commission. All lighting shall be high efficacy or equivalent per the current California Energy Code 119 and 150(k). Indoor air quality shall be provided consistent with ASHRAE 62.2 as required per California Energy Code 150(0). 9. Public Works/Engineering Department is required to review and approve grading plans that clearly show all finish elevations, drainage, and, 3 Planning Commission Resolution No. 2014 -XX retaining wall(s) locations. - These plans shall be consistent with the site plan submitted to the Building & Safety Division. h. "Separate permits are required for pool, spa, and retaining walls" and shall be noted on plans. All balconies shall be designed for 60lb/ft live load. All easements shall be shown on the site plan. k. Fire Department approval shall be required. Contact the Fire Department to check the fire zone for the location of your property. If this project is located in High Hazard Fire Zone, it shall meet requirements of the fire zone per CBC Chapter 7A. i. All. unenclosed under -floor areas shall be constructed as exterior wall. ii. All openings into the attic, floor and/or other enclosed areas shall be covered with corrosion -resistant wire mesh not less than 1/4 inch or more than'l /2 inch in any dimension except where such openings are equipped with sash or door. iii. Slope setbacks shall be consistent with California Building Code Figure 1805.3.1 and California Residential Code R403.1.7. Foundations shall provide a minimum distance to daylight. 0. Light and ventilation shall comply with CBC 1203 and 1205. The recreation room shall provide natural light and ventilation or be designed by a mechanical engineer for artificial ventilation. a. Private property sewer system shall be approved by the Los Angeles County Sanitation District. e. AQMD notification is required at least 10 days prior to any demolition. Proof of notification is required at permit issuance. f. All workers on the job shall be covered by workman's compensation insurance under a licensed general contractor. Any changes to the contractor shall be updated on the building permit. 4. CONSTRUCTION — CONDITIONS REQUIRED DURIN(-, CONSTRUCTION a. Fire sprinklers are,required for new single family dwellings (CRC R313.2). Sprinklers shall be approved by LA County Fire Department prior to installation and shall be inspected at framing stage and finalization of construction. b. Occupancy of the facilities shall not commence until all California Building Code and State Fire Marshal regulations have been met. The buildings shall be inspected for compliance prior to occupancy. C. Every permit issued by the building official under the provisions of this Code shall expire and become null and void unless the work authorized by such permit is commenced within one -hundred -eighty (180) days after permit issuance, and if a successful inspection has not been obtained from the building official within one -hundred -eighty (180) days from the date of permit issuance or the last successful inspection. A successful inspection shall mean a documented passed inspection by the city building inspector as outlined in Section 110.6. d. Construction activities causing the operation of any tools or equipment used in construction, drilling, repair, alteration, or demolition work shall be conducted Monday — Saturday between the hours of 7:00 a.m. and 7:00 p.m. 15 Planning Commission Resolution No. 2014 -XX e. The project shall be protected by a construction fence to the satisfaction of the Building Official. All fencing shall be view obstructing with opaque surfaces. f. All structures and property shall be maintained in a safe and clean manner during construction. The property shall be free of debris, trash, and weeds. 9. All equipment staging areas shall be maintained in an orderly manner and screened behind a minimum 6' high fence. h. Any changes or deviation from approved plans during the course of construction shall be approved by the City prior to proceeding with any work. M. The following opinions expressed are based on field inspection. My observations, recommendations, and opinions are within this report. Based on the site visit there are four trees within the lot. Here is a breakdown of existing tree species, please refer to "TREE PROTECTION PLAN' for more information. Three (3) of existing trees within the lot are of the species, Juglans californica, Southern California Black Walnut of which two are mitigated due to DBH size, The remaining tree is a Eucalyptus citridora, Lemon Scented Gum which is not a mitigated species. All existing mitigated Juglans, californica, trees will be removed and will be replaced with 24" box trees at a 3:1 ratio. Eucalyptus citridora, Lemon Scented Gum will remain in place.
