HomeMy WebLinkAboutRES 2012-05RESOLUTION NO. 2012-05 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DIAMOND BAR DECLARING THE PROPERTY LOCATED AT THE SOUTHEASTERLY CORNER OF DIAMOND BAR BOULEVARD AND BREA CANYON ROAD (APN 8714-105-901) AS SURPLUS PROPERTY AND AUTHORIZING THE CITY MANAGER TO DISPOSE OF THE PROPERTY AT FAIR MARKET VALUE WHEREAS, the property located at the southeasterly corner of Diamond Bar Boulevard and Brea Canyon Road (APN 8714-105-901) is owned by the City of Diamond Bar, and WHEREAS, the property has been identified as surplus with no present or future value as municipal land with a public purpose; and WHEREAS, California Government Code Sections 37420-37430 specifies the procedures for public agencies to dispose of surplus property; and WHEREAS, the City has followed these procedures, including: • Receiving an appraisal setting the fair market value of the land; • Completing Planning Commission review finding that the disposition of the property is consistent with the City's General Plan; • Notifying local public agencies of the property's availability for open space or housing and giving them first right of refusal to purchase WHEREAS, no agencies have expressed interest in acquiring the property for such purposes. NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF DIAMOND BAR AS FOLLOWS: SECTION 1.The City Council of the City of Diamond Bar declares the City -owned property on the southeasterly corner of Diamond Bar Boulevard and Brea Canyon Road (APN 8714-105-901) to be surplus property. SECTION 2. The City Manager is authorized to dispose of the property at the fair market value of no less than $595,000 and to execute any and all documents reasonably necessary to dispose of the property. SECTION 3. The Mayor is hereby authorized to affix his or her signature to this resolution signifying its adoption by the City Council, and the City Clerk, or her duly appointed deputy, is directed to attest hereto.
