A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DIAMOND
BAR ESTABLISHING AND ADOPTING SCHEDULES OF RATES,
FEES, AND CHARGES FOR BUILDING CONSTRUCTION SERVICES
PROVIDED BY THE COMMUNITY DEVELOPMENT DEPARTMENT OF
THE CITY OF DIAMOND BAR
A. RECITALS
WHEREAS, the City Council of the City of Diamond Bar has heretofore
established various schedules of rates, fees, and charges for the processing of
applications, permits, and other municipal services; and
WHEREAS, pursuant to the Constitution and state laws of the State of California,
the City of Diamond Bar is authorized to adopt and implement rates, fees, and charges
for municipal services provided the rates, fees, and charges do not exceed the
estimated reasonable cost of providing such services; and
WHEREAS, the City's rates, fees, and charges for building construction services,
including inspections and permits have remained static for an extended period and are
in need of adjustment to better reflect current business costs; and
WHEREAS, the City Council desires to implement rates, fees, and charges for
various municipal construction services provided by the City of Diamond Bar as set forth
herein; and
WHEREAS, California Government Code Section 66016 requires notice to be
published in advance and data made available concerning rates, fees, and charges
prior to the City Council conducting an open and public meeting with respect to the
adoption of increases in rates, fees, and charges or the adoption of new rates, fees and
charges for various municipal services; and
WHEREAS, Pursuant to California Government Code Section 66016, the City
Council has met the noticing requirements and considered the matter in an open and
public meeting prior to the adoption of this Resolution; and
B. RESOLUTION
THEREFORE, BE IT RESOLVED that the City Council of the City of Diamond
Bar as follows:
SECTION 1. The City Council hereby finds and determines that, based upon the
data, information, analyses, and testimony presented and contained in the
corresponding staff report, concerning the rates, fees, and charges described in Exhibit
A attached hereto and by this reference incorporated herein, the rates, fees, and
charges set forth in said Exhibit A do not exceed the estimated reasonable cost of
providing the service for which it is levied.

SECTION 2. The rates, fees, and charges set forth in Exhibit A are hereby
adopted and approved as the rates, fees, and charges for the services identified.
SECTION 3. The rates, fees, and charges set forth in Exhibit A shall be effective
and implemented commencing sixty (60) days from the date of adoption of this
Resolution.

Important Points
The BVD is not intended to apply to alterations or repairs
to existing buildings. Because the scope of alterations or
repairs to an existing building varies so greatly, the Square
Foot Construction Costs table does not reflect accurate
values for that purpose. However, the Square Foot
Construction Costs table can be used to determine the
cost of an addition that is basically a stand-alone building
which happens to be attached to an existing building. In
the case of such additions, the only alterations to the
existing building would involve the attachment of the
addition to the existing building and the openings between
the addition and the existing building.
• For purposes of establishing the Permit Fee Multiplier, the
estimated total annual construction value for a given time
period (1 year) is the sum of each building's value (Gross
Area x Square Foot Construction Cost) for that time pen
(e.g., 1 year).
The Square Foot Construction Cost does not include the
price of the land on which the building is built. The Square
Foot Construction Cost takes into account everything from
foundation work to the roof structure and coverings but
does not include the price of the land. The cost of the land
does not affect the cost of related code enforcement
activities and is not included in the Square Foot
Construction Cost.
