HomeMy WebLinkAbout05/02/1989 Minutes - Regular MeetingMINUTES OF THE CITY COUNCIL OF THE CITY OF DIAMOND BAR HELD May 2, 1989 CALL TO ORDER: Mayor Papen called the Council meeting to order at 6:03 p.m. ROLL CALL: The following Council members were present: Councilman - Gary Werner Councilman - Gary Miller Councilman - John Forbing Mayor Pro Tem - Paul Horcher Mayor - Phyllis Papen PRESENTATIONS: Mayor Papen proclaimed Water Awareness Week from May 1 to May 7, 1989. Reverend Richard Enghdahl was presented with a Proclamation. Mayor Papen proclaimed "Day of the Teacher" on May 10, 1989. Proclamations to be sent to both Walnut Valley and Pomona Unified School Districts. Mayor Papen proclaimed May 1, 1989 as "Law Day U.S.A." Councilwoman Nel Soto with the City of Pomona, presented Mayor Papen with a Proclamation congratulating the City. CLOSED Mayor Papen recessed to closed session at 6:15 SESSION: p.m. for approximately 10 minutes to discuss City Manager applicants with the City Managers of Walnut, San Dimas and Rancho Cucamonga. RECONVENED: Mayor Papen reconvened the meeting at 6:25 P.m. CONSENT Councilman Gary Werner requested that Item B CALENDAR: (Warrant Register) be pulled for discussion. Mayor Pro Tem Horcher moved, Councilman Werner seconded to approve the Consent Calendar with the deletion of Item B. With the following Roll Call vote, motion carried: AYES: COUNCILMEN - Forbing, Miller, Werner, Mayor Pro Tem Horcher, Mayor Papen NOES: COUNCILMEN - None ABSENT: COUNCILMEN - None a. Adopted the following Resolution, No. 89-28, entitled: RESOLUTION NO. 89-28: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DIAMOND BAR PROVIDING FOR ENFORCEMENT OF CITY HEALTH ORDINANCES AND AUTHORIZING EXECUTION OF AN AGREEMENT WITH THE COUNTY OF LOS ANGELES WITH RESPECT THERETO. Adopted the following Resolution, No. 89-31, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DIAMOND BAR, CALIFORNIA, DETERMINING THE AUTHORITY AND RESPONSIBILITY FOR INSPECTION OF CITY BRIDGES, INDEMNIFYING THE COUNTY OF LOS ANGELES FOR SUCH INSPECTION, AND PROVIDING FOR PAYMENT OF COSTS THEREOF. h. Adopted the following Resolution, No: 89-32, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DIAMOND BAR GRANTING CONSENT AND JURISDICTION TO THE COUNTY OF LOS ANGELES FOR THE INCLUSION OF THE ENTIRETY OF THE CITY OF DIAMOND BAR WITHIN A COUNTY SEWER MAINTENANCE DISTRICT. MATTER WITHDRAWN FROM CONSENT CALENDAR: b. WARRANT REGISTER - Councilman Werner questioned the fax and copier rentals and asked if they were on a long term rental or month to month. Mr. Caswell stated that rental was on a month to month agreement. Councilman Werner asked staff to seek alternatives to better suit the needs of the City. Councilman Werner moved, Councilman Miller seconded to approve the Warrant Register. With the following Roll Call vote, motion carried: MAY 2, 1989 AYES: NOES: ABSENT: COMMUNICATIONS FROM THE PUBLIC: COUNCILMEN - Forbing, Miller, Werner, Mayor Pro Tem Horcher, Mayor Papen COUNCILMEN - None COUNCILMEN - None SAND STONE Don Schad made a video presentation of "Sand CANYON Stone Canyon" to show Council his concern over the potential destruction of the land by developers. He stated that he would like to see the land preserved and suggested that possibly Arciero donate the land to the City. CONTINUED BUSINESS: Sunny Martindale, resident, also spoke in favor of Mr. Schad's suggestion and appealed to the Council to halt any action in the canyon until a study could be made. She further urged to the Council to meet with Dr. Brown with the W.V.U.S.D. to make sure that none of the excess fill dirt from South Pointe Middle School be dumped into the canyon as well as deny any permits for dumping of dirt, street access, etc. Mrs. Martindale also suggested that this item be placed on a future agenda so that Dr. Brown could be present to discuss the District's intention regarding the school land. Debra Duarte and Phillip Duarte, residents, concurred with the previous speakers. CM/Caswell stated that L.A. County Public Works handles these issues and would instruct them to investigate the site every day; however, at this time, no reports have been taken. ORDINANCE #9 Item A Ordinance 9: Mayor Papen asked the MAY 2, 1989 City Attorney to review Ordinance #9. Attorney Arczynski reviewed Ordinance 19 and read it by title. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DIAMOND BAR ESTABLISHING SALARIES FOR MEMBERS OF THE CITY COUNCIL. Councilman Forbing moved, Councilman Miller seconded to adopt Ordinance No. 9 (1989). With the following Roll Call vote, motion carried: AYES: COUNCILMEN - Forbing, Miller, Werner, Mayor Pro Tem Horcher, Mayor Papen NOES: COUNCILMEN - None ABSENT: COUNCILMEN - None SUMMER Discussion of proposals by L.A. County and RECREATION: Walnut Valley Recreation for summer programs. Mayor Papen stated that sub -committee members Councilman Forbing and Councilman Miller reviewed the proposals. Mr. Dela Gaza with L.A. County Parks & Recreation made a presentation on their proposal stating that it would offer after school programs, Summer camps and Tiny Tot programs. Mr. Gaza then introduced Ms. Rosales, Recreation Division and Supervisor, Melinda Mayoral. Councilman Forbing stated that Walnut Valley proposal included 2 people per park whereas L.A. County proposed only 1. Further Walnut Valley's proposal is to open the parks from 10:00 a.m. to 4:00 p.m. and that the County does not staff any other park but Heritage which is paid by the people using the program. Chris Adams with Walnut Valley Recreation Department stated that the JPA with Walnut School District had been ratified for another year. Councilman Forbing moved, Councilman Miller seconded to use Walnut Valley Recreation for the City's summer programs. With the following Roll Call vote, motion carried: AYES: COUNCILMEN - Forbing, Miller, Werner, Mayor Pro Tem Horcher, Mayor Papen NOES: COUNCILMEN - None ABSENT: COUNCILMEN - None TRAFFIC STUDY Mr. Caswell requested that this item be continued to May 16, 1989 to enable L.A. MAY 2, 1989 County Public Works time to prepare an inventory of traffic signals and analysis of the traffic system and signals on Diamond Bar Blvd. and Grand Ave. NEW BUSINESS: ORDINANCE 10 Attorney Arczynski stated that he had prepared this ordinance as requested dealing with requiring a permit for walls and fences in excess of 36" in height. Councilman Miller stated that the reason behind the Ordinance was to afford the City more control over the design, as well as the process of the building of walls and fences. Attorney Arczynski stated that this ordinance did not address the CC&R's but would make the person who is pulling the permit aware that CC&R's need to be checked. Councilman Forbing asked for a report from Building & Safety regarding their procedure for the aeneral hermit process. Following further discussion, Councilman Werner moved, Mayor Pro Tem Horcher seconded to approve for 1st reading by title only and waive full reading of Ordinance No. 10 (1989), entitled: AN ORDINANCE OF THE CITY OF DIAMOND BAR AMENDING SECTION 301(b)2 OF THE BUILDING CODE HERETOFORE ADOPTED BY THE CITY PERTAINING TO PERMITS FOR WALLS AND FENCES. With the following Roll Call vote, motion carried: AYES: COUNCILMEN - Forbing, Miller, Werner, Mayor Pro Tem Horcher, Mayor Papen NOES: COUNCILMEN - None ABSENT: COUNCILMEN - None PLANNING Item B: Planning Function: Councilman FUNCTION Werner and Councilman Miller have been appointed to the sub -committee for planning. C/Werner advised that under California State Law, Council is required to prepare a general plan within 30 months of incorporation. Suggest that we initiate a "Planning Ad hoc Committee" to assemble community people to participate in the future of Diamond Bar. Councilman Werner offered his participation in being a member of this committee. He also suggested that Councilman Miller co-chair this committee. Mayor Pro Tem Horcher suggested that each member of the City Council solicit 3 MAY 2, 1989 volunteers to be on this committee. Mayor Papen suggested that a study session be held Tuesday, May 9, 1989 on planning. The County as well as members of the Municipal Advisory Council advisory group to be invited to make presentations. This meeting would be open to the public and last for approximately 1 1/2 hours. With the consensus of the City Council, a study session was set for 7:00 p.m. Councilman Werner requested that the Regional Planning staff be prepared for presentation. Mr. Caswell advised that we need to get a consultant that will be heading up the General Plan immediately. The community can then respond to what the community wants. PERSONNEL Item C: Personnel Budget: The amount of BUDGET $10,000.00 is for personnel budget from date of incorporation to June 30. Councilman Forbing moved that a budget of $10,000.00 be approved for staffing. The motion was seconded by Councilman Miller. Councilman Werner asked how many people Mr. Caswell was speaking about. Mr. Caswell advised that it was for clerical, a short term intern, as well as a second secretary. Item D: P.E.R.S. - This is a Retirement Plan for Public Employees. Mr. Caswell suggested that the Personnel Committee should investigate the options for PERS and make a recommendation to the City Council on what kind of contract should be a part of the eventual benefit package of the City. Medical Benefit packets are also included. Councilman Forbing advised that the Personnel sub -committee would be meeting the following morning and would be happy to include this with the items they will be discussing. He also advised that they would be making a report at the next meeting on the status of what they are looking at as far as personnel is concerned. MAY 2, 1989 INSURANCE Item E: Liability Insurance: The insurance premium for this City is approximately $75,000.00. Council decided that the bill should be paid by the payment plan. AB -2186 Item F: AB -2186: Mayor Papen advised that the League of California Cities has requested that we support this bill which goes before the Assembly Local Government Committee on May 10, 1989. This is a bill to correct an error and allow the affected cities to count the population in annexed areas for the purposes of receiving the state per capita subventions. Mayor Papen recommended that Council support this bill. Councilman Forbing requested that staff draft a letter to the Assemblyman on the committee that Council is in favor of this bill. Attorney Arczynski stated that this ordinance did not address the CC&RIs but would make tl person who is pulling the permit aware that CC&RIs need to be checked. Councilman Forbing asked for a report from Building & Safety regarding their procedure for tl general permit process. Following further discussion, Councilman Werner moved, Mayor Pro Tem Horcher seconded approve for 1st reading by title only and waive full reading of Ordinance No. 10 (198 entitled: AN ORDINANCE OF THE CITY OF DIAMOND BAR AMENDING SECTION 301(b)2 ( THE BUILDING CODE HERETOFORE ADOPTED BY THE CITY PERTAINING TO PERMITS F( WALLS AND FENCES. C/Werner advised that under California State Law, Council is required to prepare a general pl; within 30 months of incorporation. Suggest that we initiate a "Planning Ad hoc Committee" assemble community people to participate in the future of Diamond Bar. Councilman Wern offered his participation in being a member of this committee. He also suggested th Councilman Miller co-chair this committee. Mavn,r Prn Tp -,m Rnrnhp-r that- each MAY 2, 1989 volunteers to be on this committee. Mayor Papen suggested that a study session be held Tuesday, May 9, 1989 on planning. The County as well as members of the Municipal Advisory Council advisory group to be invited to make presentations. This meeting would be open to the public and last for approximately 1 1/2 hours. With the consensus of the City Council, a study session was set for 7:00 p.m. Councilman Werner requested that the Regional Planning staff be prepared for presentation. Mr. Caswell advised that we need to get a consultant that will be heading up the General Plan immediately. The community can then respond to what the community wants. PERSONNEL Item C: Personnel Budget: The amount of BUDGET $10,000.00 is for personnel budget from date of incorporation to June 30. Councilman Forbing moved that a budget of $10,000.00 be approved for staffing. The motion was seconded by Councilman Miller. Councilman Werner asked how many people Mr. Caswell was speaking about. Mr. Caswell suggested that the Personnel Committee should investigate the options for PERS and make a recommendation to the City Council on what kind of contract should be a part of the eventual benefit package of the City. Medical Benefit packets are also included. Councilman Forbing advised that the Personnel sub -committee would be meeting the following morning and would be happy to include this with the items they will be discussing. He also advised that they would be making a report at the next meeting on the status of what they are looking at as far as personnel is concerned. MAY 2, 1989 INSURANCE Item E: Liability Insurance: The insurance premium for this City is approximately $75,000.00. Council decided that the bill should be paid by the payment plan. AB -2186 Item F: AB -2186: Mayor Papen advised that the League of California Cities has requested that we support this bill which goes before the Assembly Local Government Committee on May 10, 1989. This is a bill to correct an error and allow the affected cities to count the population in annexed areas for the purposes of receiving the state per capita subventions. Mayor Papen recommended that Council support this bill. Councilman Forbing requested that staff draft a letter to the Assemblyman on the committee that Council is in favor of this bill. Councilmembers concurred. COUNCILMEMBER Councilman Forbing commented on how happy he COMMENTS was to see so many people at the meeting.
