REGULAR MEETING OF THE CITY OF DIAMOND BAR
JULY 18, 1989
CALL TO ORDER: Mayor Papen called the meeting to order at 6:00
p.m. in the Council Chamber, W.V.U.S.D., 880 S.
Lemon Avenue, Diamond Bar, California.
PLEDGE OF The audience was led in the Pledge of Allegiance
ALLEGIANCE: by Councilman Gary Miller.
ROLL CALL: Mayor Papen, Mayor Pro Tem Horcher, Councilman
Werner, Councilman Miller, Councilman Forbing
Also present were City Manager Robert van Nort,
City Attorney Andrew Arczynski and City Clerk
Lynda Burgess.
PROCLAMATION: Mayor Papen read a Proclamation designating
Tuesday, August 8, 1989 as "National Night Out" in
the City of Diamond Bar.
COUNCIL Councilman Forbing announced that a 10'x 15'
COMMENTS: temporary cover for Peterson Park will be
delivered in two weeks at a cost of $300. This
size will be easy for recreation staff to take
down and store when not in use. He further
announced that the Rotary Club is purchasing a
table for this site as well.
Mayor Papen announced a Special Meeting to be held
on August 29, 1989 at City Hall to award the sale
of bonds.
Mayor Papen expressed concern regarding advertis-
ing signs posted during weekends throughout the
City. A number of developers and businesses were
cited for advertising in this manner several years
ago. She requested staff to look into this for
violations of Zoning Ordinance Sections 22.20.020
et. seq. she suggested that a meeting with Los
Angeles County Zoning Enforcement be held to
request weekend inspections.
Councilman Miller suggested that staff consider
selecting central locations for advertising of
this type which can be sold to local businesses to
eliminate "bootleg" signs.
PUBLIC COMMENT
PERIOD: Mr. David Lang, 431 Carpio Drive, stated that the
intersection of Carpio Drive and Golden Springs
was marked for repair by the County prior to

Cityhood but the markings have worn off. He
explained that if repairs are not begun soon,
there will be serious degradation of the
surface of the street.
He also commented that since the Landscape
Maintenance District was soundly defeated at
the last election, assistance by the; City
Council in getting this charge removed from
local tax bills would be appreciated.
In response to Mr. Lang's question regarding
the cost of law enforcement in this year's
budget, the City Manager answered that the
additional cost was included in the budget
and with revenues and expenditures, the City
Council adopted a balanced budget with a very
small surplus.
CONSENT It was moved by Councilman Werner and
CALENDAR: seconded by Mayor Pro Tem Horcher to approve
the Consent Calendar items 2 through 5. The
motion carried by the following roll call

2. Approved Minutes of the Special Meeting
of June 27, 1989.
3. Approved Warrant Register dated July 18,
1989 in the amount of $39,305.70.
4. Adopted Resolution No. 89-64 Marking the
25th Anniversary of the Los Angeles
County Music Center.
5. Authorized the addition of one (1)
maintenance employee salary range.
NEW BUSINESS:
Elections The City Attorney recommended that the City
Council adopt for 1st reading by Ordinance 19
Ordinance 19(1989) title only Ordinance No.
19 (1989) and waive further reading:

DIAMOND BAR DIRECTING THAT GENERAL MUNICIPAL
ELECTIONS OF THE CITY OF DIAMOND BAR BE HELD ON
THE DAY OF STATEWIDE PRIMARY ELECTIONS
It was moved by Mayor Papen and seconded by
Councilman Miller to approve Ordinance No. 19
(1989) for 1st reading by title only and waive
further reading. The motion carried by the
following roll call vote:

Purchasing The City Attorney recommended that the City
Ordinance 20 Council adopt for 1st reading by title only
Ordinance No. 20 (1989) and waive further reading:

DIAMOND BAR ESTABLISHING A PURCHASING SYSTEM
It was moved by Councilman Werner and seconded by
Councilman Miller to approve Ordinance No. 20
(1989) for 1st reading by title only and waive
further reading. The motion carried by the
following roll call vote:

Parks & Councilman Forbing requested that staff prepare an
Recreation article and an application form for publication in
the next issue of the Windmill for persons
interested in serving on the Parks and Recreation
Commission for possible establishment of the
Commission in October. It was agreed that the
Council Park & Recreation Committee would develop
a description of the Commission, a proposal for
submission of applications and distribution of
notices soliciting applications for further
discussion at the August 1, 1989 regular meeting.

Zoning The City Manager explained that enforcement
Ordinance of Sections 22.28.340 and 22.60.360 regarding
displaying of merchandise outside of an
enclosed building on a permanent basis was
becoming a matter of concern to local
businesses. This matter was brought before
the City Council for direction as to whether
to continue enforcement of these sections or
suspend enforcement until review by the
Chamber of Commerce and the City Council
Planning Committee.
Mayor Papen stated that many businesses store
shopping carts or sell Christmas trees in the
areas in front of their buildings. She
requested a report from the Fire Department
as to public safety and any possible
liability if the City permitted these
practices to continue.
It was moved by Councilman Werner and
seconded by Councilman Miller to notify the
County of Los Angeles that Sections
22.280.340 and 22.60.360 be suspended from
enforcement until August 16, 1989. The
motion carried by the following roll call

Traffic Survey It was moved by Mayor Papen and seconded by
Radar Mayor Pro Tem Horcher to approve a traffic
Enforcement study in the amount of $5,875.00 subject to
approval by the CHP report and adjustments
accordingly. The motion carried by the

Logo Contest Following discussion regarding various designs
submitted, it was agreed to table this matter
until all members of the City Council have an
opportunity to review all designs with approval at
the next regular meeting.
Koll Company Following discussion, it was moved by
Resolution 65 Councilman Miller and seconded by Councilman
Werner to adopt Resolution'No. 89-65 entitled: A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DIAMOND BAR APPROVING TENTATIVE PARCEL MAP NO. PM
20358, A REQUEST TO SUBDIVIDE CERTAIN REAL
PROPERTY MORE PARTICULARLY DESCRIBED HEREIN INTO
SEVEN COMMERCIAL LOTS WITHIN THE CITY OF DIAMOND
BAR, LOCATED AT 1320 - 1340 SOUTH VALLEY VISTA
DRIVE, MAKING FINDINGS IN SUPPORT THEREOF AND
IMPOSING CONDITIONS THEREON

Mayor Papen reconvened the meeting at 7:46 p.m.
PUBLIC HEARINGS The City Attorney recommended that the City
Council adopt, by title only, Ordinance No.
Ordinance 11-A it -A: AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF DIAMOND BAR EXTENDING THE TERM OF AN
INTERIM ZONING ORDINANCE, ORDINANCE NO. 11 (1989)
PURSUANT TO THE PROVISIONS OF CALIFORNIA
GOVERNMENT CODE SECTION 65858 AND MAKING FINDINGS
IN SUPPORT THEREOF.
Mayor Papen opened the Public Hearing.
Mr. Bill Ruh of the Building Industry Association,
1150 N. Mountain, Suite 203', Upland and Mr. Carlos
Negretti, 2732 Calle Arroyo, Suite B, San Juan
Capistrano criticized the ordinance as being
overly broad.
There being no further public comments, Mayor Pro
Tem Horcher moved, seconded by Councilman Werner
to close the Public Hearing. Motion carried by
the following vote:

Ordinance 15-A The City Attorney recommended that the City

THE TERM OF AN INTERIM ZONING ORDINANCE,
ORDINANCE NO. 15 (1989) PURSUANT TO THE

Mayor Papen opened the Public Hearing. There
being no public comments, a motion was made
by Mayor Papen, seconded by Councilman Werner
to close the Public Hearing. With approval
of Council, the Public Hearing was closed.
It was moved by Councilman Miller and
seconded by Mayor Papen to waive further
reading and adopt Ordinance No. 15-A (1989).

adjourned the regular meeting to closed session at
8:40 p.m.
Closed session convened at 8:40 p.m. with
discussions regarding Personnel, Grand Avenue
Litigation and San Gabriel Valley Tribune
Litigation.
Resolution 66 It was moved by Councilman Miller, seconded by
Councilman Forbing to adopt Resolution No. 89-66
electing to be subject to Public Employees'
Medical and Hospital Care Act.
Mayor Papen reconvened regular session at 9:45
p.m. and adjourned the regular meeting at 9:45
p.m.
