Good evening,
Just an update on our inspection this morning. We met with the owner who started demo worl<while
acknowledging a permit is required. He indicated he was having two contractors do the work and small
work to be done by him as owner. The first contractor will be doing 7 openings (2 sliding doors and 5
1
windows), bathroom remodel in kind, and a repipe. The second contractor wilt be doing the kitchen
remodel, flooring, and railing. The owner will be doing the lighting (connecting to existing wiring).
He was also told that he needs to apply treatment to mold and it would need to be verified by the
inspector. He did not that the neighbor had issues before due to a water leak which he abandoned the
Line (which is causing the repipe). He was reminded to not do anymore work and encouraged to apply
for his permit as soon as possible. The first contractor already came in which prompted the
inspection. He said the second contractor will come later since the first contractor's worm will take
some time.
Please see below for some pictures. Gabby took photos which will come later. Let me Know if you have
any questions.

I. FORMAL NOTICE OF MANDATORY DUTYAND LIABILITIES
To the City Attorney and City Manager of Diamond Bar:
This correspondence constitutes a formal Notice of Intent to Sue the City of
Diamond Bar ("the City")for its ongoing failure to discharge its mandatory,
non -discretionary statutory duties to enforce the California Building
Standards Code, the California Health and Safety Code, and the Diamond
Bar Municipal Code.
The City has been repeatedly notified of severe, unpermitted structural
alterations, active asbestos disturbances, and egregious habitability
violations at 1344 S. Diamond Bar Blvd., Unit B.
5
The City has possessed actual and constructive knowledge of toxic
environmental hazards at this specific unit since May 8, 2025, yet has
demonstrated deliberate indifference. By continuing to engage in
bureaucratic stalling and failing to issue an immediate Stop Work Order and
administrative citations, the City is actively creating public entity liability
under California Government Code § 815.6.
II. STATEMENT OF FACTS AND ACTIVE VIOLATIONS
The property located at 1344 S. Diamond Bar Blvd., Unit B, is currently
subjected to major, unpermitted structural alterations by owner Kai Ping
Wang and co-owner Ying Lu Wang "Yang", exacerbating pre-existing,
documented environmental hazards.
* Pre-existing and Ignored Habitability Hazards (Since May 8, 2025):
The City has been fully aware since May 8, 2025, that this unit suffers from
severe asbestos contamination. Furthermore, the City has been notified of
dangerous electrical wiring, vermin infestations, toxic mold growth, and
chronic plumbing leaks. For over a year, the City has taken no substantive
enforcement action, jeopardizing the health and safety of the surrounding
community.
* Unpermitted Excavation in a Contaminated Unit: Owner I<ai Ping Wang is
actively tearing up and excavating the structural concrete foundation slab in
Unit B. Because the City is already aware of the asbestos contamination,
allowing unpermitted demolition guarantees the uncontrolled release of
friable asbestos fibers, creating an immediate, life -threatening respiratory
hazard to neighboring units and the public.
*Intentional Avoidance of Code and Environmental Regulations: In
December 2025 /January 2026, a professional estimate was provided by
Western Rooter outlining a cost of approximately $3,000 solely to safely
open the concrete to address a stab Leak. To bypass building standards,
mandatory South Coast AQMD Rule 1403 asbestos surveying and abatement
protocols, and municipal permit fees, the owners rejected professional
oversight and are executingthe demolition clandestinely.
* Illegal Real Estate Flip Operations:
The scope of this unpermitted work constitutes an illegal, clandestine
"property flip" designed to masl<severe subterranean, electrical, and toxic
mold defects. This bypasses California Real Estate Disclosure Laws,
unlicensed contracting statutes, and local municipal zoning protocols.
III. LEGAL AUTHORITIES AND COMPULSORY INTERVENTION
The City's failure to act violates a multi -tiered framework of California and
local statutes designed to protect the public from structural collapse, toxic
exposure, and unpermitted hazardous developments:
* California Health and Safety Code §§ 17920.3 & 17960:
These statutes mandate that local enforcement agencies shalt inate
""
abatement actions upon the discovery of a substandard building. The
presence of exposed electrical wiring, chronic dampness, mold, vermin, and
unpermitted plumbing explicitly classifies this unit as substandard. The City
has no discretion to ignore these documented hazards.
* South Coast AQMD Rule 1403 (Asbestos Emissions):
The unpermitted demolition of concrete and structural elements in a unit
Known to contain asbestos directlyviolates state and regional environmental
mandates requiring licensed abatement contractors, P5 clean-up
procedures, and proper disposal manifests.
*The "Mandatory Duty" Doctrine (§815.6) &Failure to Act:
White a city is immune forfailingto enforce a purely discretionary taw, it
loses immunitywhen it has specific knowledge of an ongoing structural and
environmental violation that creates a public nuisance and takes no
ministerial step to abate it.
IV. PUBLIC ACCOUNTABILITYAND DEMAND FOR IMMEDIATE ACTION
The City's blatant disregard for environmental and structural safety at this
property casts a severe shadow of liability and incompetence over its
municipal operations. This documented pattern of negligence and
environmental evasion threatens to derail public and regulatory trust in the
highly publicized Downtown Diamond Bar Plan —particularly given the City
has already faced scrutiny for being deceptive regarding the environmental
impacts of that project. Allowing a known toxic and structurally
compromised property to operate with impunity directly undermines the
City's credibility. To mitigate its growing legal exposure and protect the
community, the City of Diamond Bar must execute the following actions
within forty-eight (48) hours of receiving this notice.
* Issue an Immediate Stop Worl<Order:
Dispatch a Building and Safety Inspector alongside Code Enforcement
officers to 1344 S. Diamond Bar Blvd., Unit B, inspect the foundation slab,
and place a red -tag / Stop Work Order on the premises.
*Mandate Environmental Abatement:
Compel the owners to halt all work until a comprehensive asbestos survey
and licensed abatement plan (in compliance with AQMD Rule 1403) is
submitted and approved.
* Issue Formal Administrative Citations:
Levy immediate citations against Kai Ping Wang and Ying Lu Wang "Yang" for
executing structural and plumbing modifications without permits in a
substandard building.
NOTICE IS HEREBY GIVEN:
If the City of Diamond Bar continues its bureaucratic stalling and fails to
discharge its mandatory duties to halt this unpermitted, hazardous
construction, all subsequent structural damage, toxic exposures, property
devaluations, or bodily injuries will rest squarely on the shoulders of the City.
The City will be named as a principal or co-defendant in a formal civil lawsuit
seeking maximum damages, injunctive relief, and statutory attorney fees for
its reckless, negligent failure to protect the community. Govern yourselves
accordingly.

Good evening,
Just an update on our inspection this morning. We met with the owner who started demo
workwhile acknowledging a permit is required. He indicated he was having two
contractors do the work and small work to be done by him as owner. The first contractor
will be doing 7 openings (2 sliding doors and 5 windows), bathroom remodel in kind, and a
repipe. The second contractor will be doing the kitchen remodel, flooring, and railing. The
owner will be doing the lighting (connecting to existing wiring).
He was also told that he needs to apply treatment to any mold and it would need to be
verified by the inspector. He did not that the neighbor had issues before due to a water
leakwhich he abandoned the line (which is causing the repipe). He was reminded to not
Jo any more work and encouraged to apply for his permit as soon as possible. The first
contractor already came in which prompted the inspection. He said the second contractor
Atilt come later since the first contractor's worm will take some time.
Please see below for some pictures. Gabby took photos which will come later. Let me

I. FORMAL NOTICE OF MANDATORY DUTYAND LIABILITIES
To the City Attorney and City Manager of Diamond Bar:
This correspondence constitutes a formal Notice of Intent to
Sue the City of Diamond Bar ("the City") for its ongoing failure
to discharge its mandatory, non -discretionary statutory duties
to enforce the California Building Standards Code, the
California Health and Safety Code, and the Diamond Bar
Municipal Code.
The City has been repeatedly notified of severe, unpermitted
structural alterations, active asbestos disturbances, and
egregious habitability violations at 1344 S. Diamond Bar Blvd.,
Unit B.
The City has possessed actual and constructive knowledge of
toxic environmental hazards at this specific unit since May 8,
2025, yet has demonstrated deliberate indifference. By
continuing to engage in bureaucratic stalling and failing to
issue an immediate Stop Work Order and administrative
citations, the City is actively creating public entity liability
under California Government Code § 815.6.
II. STATEMENT OF FACTS AND ACTIVE VIOLATIONS
The property located at 1344 S. Diamond Bar Blvd., Unit
currently subjected to major, unpermitted structural
aIterations by owner Kai Ping Wang and co-owner Ying Lu
Wang "Yang", exacerbating pre-existing, documented
environmental hazards:
* Pre-existing and Ignored Habitability Hazards (Since May 8,
2025):
The City has been fully aware since May 8, 2025, that this unit
suffers from severe asbestos contamination. Furthermore, the
City has been notified of dangerous electrical wiring, vermin
infestations, toxic mold growth, and chronic plumbing leaks.
For over a year, the City has taken no substantive enforcement
action, jeopardizing the health and safety of the surrounding
community.
* Unpermitted Excavation in a Contaminated Unit: Owner I<ai
Ping Wang is actively tearing up and excavating the structural
concrete foundation slab in Unit B. Because the City is already
aware of the asbestos contamination, allowing unpermitted
demolition guarantees the uncontrolled release of friable
asbestos fibers, creating an immediate, life -threatening
respiratory hazard to neighboring units and the public.
*Intentional Avoidance of Code and Environmental
Regulations: In December 2025 /January 2026, a professional
estimate was provided by Western Rooter outlining a cost of
approximately $3,000 solely to safely open the concrete to
address a slab leak. To bypass building standards, mandatory
South Coast AQMD Rule 1403 asbestos surveying and
abatement protocols, and municipal permit fees, the owners
rejected professional oversight and are executing the
demolition clandestinely.
* Illegal Real Estate Flip Operations:
The scope of this unpermitted work constitutes an illegal,
clandestine "property flip" designed to mask severe
subterranean, electrical, and toxic mold defects. This
bypasses California Real Estate Disclosure Laws, unlicensed
contracting statutes, and local municipal zoning protocols.
III. LEGAL AUTHORITIES AND COMPULSORY INTERVENTION
The City's failure to act violates a multi -tiered framework of
California and local statutes designed to protect the public
from structural collapse, toxic exposure, and unpermitted
hazardous developments:
* California Health and Safety Code §§ 17920.3 & 179600
These statutes mandate that local enforcement agencies shall
initiate abatement actions upon the discovery of a
"substandard building." The presence of exposed electrical
wiring, chronic dampness, mold, vermin, and unpermitted
plumbing explicitly classifies this unit as substandard. The City
has no discretion to ignore these documented hazards.
*South Coast AQMD Rule 1403 (Asbestos Emissions):
The unpermitted demolition of concrete and structural
elements in a unit known to contain asbestos directly violates
state and regional environmental mandates requiring licensed
abatement contractors, P5 clean-up procedures, and proper
disposal manifests.
*The "Mandatory Duty" Doctrine (§815.6) &Failure to Act:
While a city is immune forfailingto enforce a purely
discretionary law, it loses immunity when it has specific
Knowledge of an ongoing structural and environmental
violation that creates a public nuisance and takes no
ministerial step to abate it.
IV. PUBLIC ACCOUNTABILITYAND DEMAND FOR IMMEDIATE
ACTION
The City's blatant disregard for environmental and structural
safety at this property casts a severe shadow of liability and
incompetence over its municipal operations. This documented
pattern of negligence and environmental evasion threatens to
derail public and regulatory trust in the highly publicized
Downtown Diamond Bar Plan —particularly given the City has
already faced scrutiny for being deceptive regarding the
environmental impacts of that project. Allowing a known toxic
and structurally compromised property to operate with
impunity directly undermines the City's credibility. To mitigate
its growing legal exposure and protect the community, the City
of Diamond Bar must execute the following actions within
forty-eight (48) hours of receiving this notice:
* Issue an Immediate Stop Worl< Order.
Dispatch a Building and Safety Inspector alongside Code
Enforcement officers to 1344 S. Diamond Bar Blvd., Unit B,
inspect the foundation slab, and place a red -tag / Stop Work
Order on the premises.
*Mandate Environmental Abatement:
Compel the owners to halt all work until a comprehensive
asbestos survey and licensed abatement plan (in compliance
with AQMD Rule 1403) is submitted and approved.
* Issue Formal Administrative Citations:
Levy immediate citations against I<ai Ping Wang and Ying Lu
Wang "Yang" for executing structural and plumbing
modifications without permits in a substandard building.
NOTICE IS HEREBY GIVEN:
If the City of Diamond Bar continues its bureaucratic stalling
and fails to discharge its mandatory duties to halt this
unpermitted, hazardous construction, all subsequent
structural damage, toxic exposures, property devaluations, or
bodily injuries will rest squarely on the shoulders of the City.
The City will be named as a principal or co-defendant in a
formal civil lawsuit seeking maximum damages, injunctive
relief, and statutory attorney fees for its reckless, negligent
failure to protect the community. Govern yourselves
accordingly.

mandatory South Coast AQMD Rule 1403 asbestos surveying and abatement
protocols, and municipal permit fees, the owners rejected professional
oversight and are executing the demolition clandestinely.
*Illegal Real Estate Flip Operations:
The scope of this unpermitted work constitutes an illegal, clandestine
"property flip"designed to masl<severe subterranean, electrical, and toxic
mold defects. This bypasses California Real Estate Disclosure Laws,
unlicensed contracting statutes, and local municipal zoning protocols.
III. LEGAL AUTHORITIES AND COMPULSORY INTERVENTION
The City's failure to act violates amulti-tiered framework of California and
local statutes designed to protect the public from structural collapse, toxic
11
exposure, and unpermitted hazardous developments.
* California Health and Safety Code §§ 11920.3 & 17960:
These statutes mandate that local enforcement agencies shall initiate
abatement actions upon the discovery of a "substandard building." The
presence of exposed electrical wiring, chronic dampness, mold, vermin, and
unpermitted plumbing explicitly classifies this unit as substandard. The City
has no discretion to ignore these documented hazards.
*South Coast AQMD Rule 1403 (Asbestos Emissions):
The unpermitted demolition of concrete and structural elements in a unit
known to contain asbestos directlyviolates state and regional environmental
mandates requiring licensed abatement contractors, P5 clean-up
procedures, and proper disposal manifests.
*The "Mandatory Duty" Doctrine (§815.6) & Failure to Act:
While a city is immune for failing to enforce a purely discretionary law, it
loses immunity when it has specific knowledge of an ongoing structural and
environmental violation that creates a public nuisance and takes no
ministerial step to abate it.
IV. PUBLIC ACCOUNTABILITYAND DEMAND FOR IMMEDIATEACTION
Compel the owners to halt all work until a comprehensive asbestos survey
and licensed abatement plan (incompliance with AQMD Rule 1403) is
submitted and approved.
* Issue Formal Administrative Citations:

I. FORMAL NOTICE OF MANDATORY DUTYAND LIABILITIES
To the City Attorney and City Manager of Diamond Bar:
This correspondence constitutes a formal Notice of Intent to Sue the City of
Diamond Bar ("the City") for its ongoing failure to discharge its mandatory,
non -discretionary statutory duties to enforce the California Building
Standards Code, the California Health and Safety Code, and the Diamond
Bar Municipal Code.
The City has been repeatedly notified of severe, unpermitted structural
alterations, active asbestos disturbances, and egregious habitability
violations at 1344 S. Diamond Bar Blvd., Unit B.
The City has possessed actual and constructive Knowledge of toxic
environmental hazards at this specific unit since May 8, 2025, yet has
demonstrated deliberate indifference. By continuing to engage in
bureaucratic stalling and failing to issue an immediate Stop Worl<Order and
administrative citations, the City is actively creating public entity liability
under California Government Code § 815.6.
I I. STATEMENT OF FACTS AND ACTIVE VIOLATIONS
The property located at 1344 S. Diamond Bar Blvd., Unit B, is currently
subjected to major, unpermitted structural alterations by owner I<ai Ping
Wang and co-owner Ying Lu Wang "Yang", exacerbating pre-existing,
documented environmental hazards.
3
* Pre-existing and Ignored Habitability Hazards (Since May 8, 2025):
The City has been fully aware since May 8, 2025, that this unit suffers from
severe asbestos contamination. Furthermore, the City has been notified of
dangerous electrical wiring, vermin infestations, toxic mold growth, and
chronic plumbing leaks. For over a year, the City has taken no substantive
enforcement action, jeopardizing the health and safety of the surrounding
community.
* Unpermitted Excavation in a Contaminated Unit: Owner I<ai Ping Wang is
actively tearing up and excavating the structural concrete foundation stab in
Unit B. Because the City is already aware of the asbestos contamination,
aRowing unpermitted demolition guarantees the uncontrolled release of
friable asbestos fibers, creating an immediate, life -threatening respiratory
hazard to neighboring units and the public.
*Intentional Avoidance of Code and Environmental Regulations: In
December 2025 /January 2026, a professional estimate was provided by
Western Rooter outlining a cost of approximately $3,000 solely to safely
open the concrete to address a stab leak. To bypass building standards,
mandatory South Coast AQMD Rule 1403 asbestos surveying and abatement
protocols, and municipal permit fees, the owners rejected professional
oversight and are executing the demolition clandestinely.
*Illegal Real Estate Flip Operations:
The scope of this unpermitted work constitutes an illegal, clandestine
"property flip" designed to mask severe subterranean, electrical, and toxic

Just an update on our inspection this morning. We met with the owner who started demo worl<while
acknowledging a permit is required. He indicated he was having two contractors do the work and small
work to be done by him as owner. The first contractor will be doing 7 openings (2 sliding doors and 5
windows), bathroom remodel in kind, and a repipe. The second contractor will be doing the kitchen
remodel, flooring, and railing. The owner will be doing the lighting (connecting to existing wiring).
He was also told that he needs to apply treatment to any mold and it would need to be verified by the

Good evening,
Just an update on our inspection this morning. We met with the owner who started demo
work while acknowledging a permit is required. He indicated he was having two
contractors do the work and small wort: to be done by him as owner. The first contractor
will be doing 7 openings (2 sliding doors and 5 windows), bathroom remodel in kind, and a
repipe. The second contractor will be doing the kitchen remodel, flooring, and railing. The
ownerwill be doing the lighting (connecting to existing wiring).
He was also told that he needs to apply treatment to any mold and it would need to be
verified by the inspector. He did not that the neighbor had issues before due to a water
leak which he abandoned the line (which is causing the repipe). He was reminded to not
Jo any more work: and encouraged to apply for his permit as soon as possible. The first
contractor already came in which prompted the inspection. He said the second contractor
will come later since the first contractor's worm will take some time.
Please see below for some pictures. Gabby tool: photos which will come later. Let me

The City has been repeatedly notified of severe, unpermitted
structural alterations, active asbestos disturbances, and
egregious habitabilityviolations at 1344 S.
II. STATEMENT OF FACTS AND ACTIVE VIOLATIONS
up[ upul y located at 1344 S. Diamond Bar Blvd., Unit B, is
currently subjected to major, unpermitted structural
alterations by owner I(ai Ping Wang and co-owner Ying Lu
Wang "Yang", exacerbating pre-existing, documented
environmental hazards.
For over a year, the City has taken no substantive enforcement
action, jeopardizing the health and safety of the surrounding
community.
*Unpermitted Excavation in a Contaminated Unit: Owner I<ai
Ping Wang is actively tearing up and excavating the structural
concrete foundation slab in Unit B. Because the City is already
aware of the asbestos contamination, allowing unpermitted
demolition guarantees the uncontrolled release of friable
asbestos fibers, creating an immediate, life -threatening
respiratory hazard to neighboring units and the public.
*Intentional Avoidance of Code and Environmental
Regulations: In December 2025 /January 2026, a professional
estimate was provided by Western Rooter outlining a cost of
approximately $3,000 solely to safety open the concrete to
address a stab leak. To bypass building standards, mandatory
South Coast AQMD Rule 1403 asbestos surveying and
abatement protocols, and municipal permit fees, the owners
rejected professional oversight and are executing the
demolition clandestinely.
* Illegal Real Estate Flip Operations:
The scope of this unpermitted work constitutes an illegal,
clandestine "property flip" designed to masl<severe
subterranean, electrical, and toxic mold defects. This
bypasses California Real Estate Disclosure Laws, unlicensed
contracting statutes, and local municipal zoning protocols.
III. LEGAL AUTHORITIES AND COMPULSORY INTERVENTION
The Citys failure to act violates amulti-tiered framework of
California and local statutes designed to protect the public
from structural collapse, toxic exposure, and unpermitted
hazardous developments.
* California Health and Safety Code §§ 17920.3 & 17960:
These statutes mandate that local enforcement agencies shall
initiate abatement actions upon the discovery of a
"substandard building." The presence of exposed electrical
wiring, chronic dampness, mold, vermin, and unpermitted
plumbing explicitly classifies this unit as substandard. The City
has no discretion to ignore these documented hazards.
*South Coast AQMD Rule 1403 (Asbestos Emissions):
The unpermitted demolition of concrete and structural
elements in a unit known to contain asbestos directlyviolates
state and regional environmental mandates requiring licensed
abatement contractors, P5 clean-up procedures, and proper
disposal manifests.
*The "Mandatory Duty" Doctrine (§815.6) &Failure to Act:
While a city is immune for failing to enforce a purely
discretionary taw, it loses immunity when it has specific
Knowledge of an ongoing structural and environmental
violation that creates a public nuisance and takes no
ministerial step to abate it.
IV. PUBLIC ACC OUNTABILITYAND DEMAND FOR IMMEDIATE
Allowing a known toxic
and structurally compromised property to operate with
0
impunity directly undermines the City's credibility. To mitigate
its growing legal exposure and protect the community, the City
of Diamond Bar must execute the following actions within
forty-eight (48) hours of receiving this notice:
* Issue an Immediate Stop Worl< Order:
Dispatch a Bung and Safety Inspector alongside Code
Enforcement officers to 1344 S. Diamond Bar Blvd., Unit B,
inspect the foundation slab, and place a red -tag / Stop Work
Order on the premises.
* Mandate Environmental Abatement:
Compel the owners to halt all work until a comprehensive
asbestos survey and licensed abatement plan (in compliance
with AQMD Rule 1403) is submitted and approved.
* Issue Format Administrative Citations:
Levy immediate citations against I<ai Ping Wang and Ying Lu
Wang "Yang" for executing structural and plumbing
modifications without permits in a substandard building.
NOTICE IS HEREBY GIVEN:
If the City of Diamond Bar continues its bureaucratic stalling
and fails to discharge its mandatory duties to halt this
unpermitted, hazardous construction, all subsequent
structural damage, toxic exposures, property devaluations, or
bodily injuries wilt rest squarely on the shoulders of the City.
The City will be named as a principal or co-defendant in a
format civil lawsuit seeking maximum damages, injunctive
relief, and statutory attorney fees for its reckless, negligent
failure to protect the community. Govern yourselves
accordingly.
