HomeMy WebLinkAboutCity Anowledgement Template DraftNOTIFICATION AND ACKNOWLEDGMENT OF SB 1383 EDIBLE FOOD DONATION REQUIREMENTS DRAFT This Notification and Acknowledgement (“Acknowledgement”) is made among ________________ (“Generator”), Abound Food Care (“Abound”) and the City of (“City”) as of ___________. State Requirements Generator acknowledges that it has been identified as a Tier [1 or 2] Commercial Edible Food Generator under SB 1383 guidelines. State law requires that effective January 1, [2022 or 2024] all Tier [1 or 2] Commercial Edible Food Generators arrange to: Recover the maximum amount of edible food that would have otherwise been disposed of. In the event it produces excess edible food, keep a record that includes: A list of each food recovery organization that collects or receives its edible food. A copy of the written agreement(s) between the Generator and any food recovery organization. A record of the contact information of any of its food recovery organizations, the types of food collected, the frequency of collection, and the quantity of food collected (measured in pounds). Generator agrees that in the event it generates any excess edible food it will: Contact Abound or other food recovery organization or service to implement a food donation program in compliance with SB 1383 regulations. Enter into an edible food donation agreement with Abound or other food recovery organization or service if they have excess edible food fit for donation. Track and report its food donations through a food donation log in compliance with SB 1383 regulations. Maintain the edible food donation agreement and a food donation log on-site to be reviewed during their annual SB 1383 compliance inspection. Generator acknowledges this notification and agrees to the requirements here within.
