Good morning,
CalRecycle received a wriƩen complaint regarding lack of blue or green waste bin collecƟon service at a few locaƟons
within the city. We are required to forward complaints on to the jurisdicƟon where the alleged violaƟon took
place. According to the regulaƟons (see below), the city will need to invesƟgate the complaint within 90 days of
receiving it and then let me know the outcome. We will follow up with you in two weeks to see if it's been resolved.

SecƟon 18996.8 Department InvesƟgaƟon of Complaints of Alleged ViolaƟons
(d) If the Department receives a complaint about a violaƟon within the enforcement authority of a jurisdicƟon, it shall
refer the complaint to the jurisdicƟon for invesƟgaƟon under SecƟon 18995.3.
SecƟon 18995.3. JurisdicƟon InvesƟgaƟon of Complaints of Alleged ViolaƟons.
(a) A jurisdicƟon shall provide a procedure for the receipt and invesƟgaƟon of wriƩen complaints of alleged violaƟons of
this chapter. The jurisdicƟon shall allow for the submission of anonymous complaints.
(b) The procedure shall provide that complaints be in wriƟng and include the following informaƟon:
(1) If the complaint is not anonymous, the name and contact informaƟon of the complainant.
(2) The idenƟty of the alleged violator, if known.
(3) A descripƟon of the alleged violaƟon including locaƟon(s) and all other relevant facts known to the complainant.
(4) Any relevant photographic or documentary evidence to support the allegaƟons in the complaint.
(5) The idenƟty of any witnesses, if known.
(c) A jurisdicƟon shall commence an invesƟgaƟon within 90 days of receiving a complaint that meets the requirements
of Subdivision (b) if the jurisdicƟon determines that the allegaƟons, if true, would consƟtute a violaƟon of this chapter.
The jurisdicƟon may decline to invesƟgate a complaint if, in its judgment, invesƟgaƟon is unwarranted because the
allegaƟons are contrary to facts known to the jurisdicƟon.
(d)The jurisdicƟon shall provide a procedure to noƟfy a complainant of the results of their complaint if the idenƟty and
contact informaƟon of the complainant are known.
(e) The jurisdicƟon shall maintain records of all complaints and responses pursuant to this secƟon in the ImplementaƟon
Record set forth in SecƟon 18995.2. The records shall include the complaint as received and the jurisdicƟon's
determinaƟon of compliance or noƟce of violaƟons issued.
