Casc, established in 1993, is regarded as one of the leading NPDES consulting firms in the state of California, including NPDES related inspections. Our work with government agencies spans a multitude of programs, from multimillion-dollar on-call contracts with Caltrans, to small and medium-sized municipal support contracts. We have been providing NPDES related inspections in various watersheds for 30 years, including for the cities of Industry, El Monte, Irwindale, Montclair, Pomona, and Palm Springs, as well as Southern California Edison and LA County Department of Public Works. Why Casc? Casc has a reputation for having a deep understanding of water quality requirements in Los Angeles County, as well as throughout Southern California. Casc melds this deep understanding with current technologies to implement cost-effective and technologically compatible NPDES program processes. Compliance is achieved through implementation of all NPDES program elements, including implementing priority development requirements, inspections, investigations, enforcement, tracking, educating, training, and monitoring and reporting, all while remaining business and developer friendly. We have dealt with the ever-changing NPDES Permit regulations for over 20 years and have kept our finger on the pulse of the state and regional regulatory agencies to anticipate potential new requirements. We, at Casc, pride ourselves on our ability to limit project challenges by forward-thinking and planning, and our ability to resolve project issues by following established protocols in a professional and cooperative manner. Ultimately, the success of any project comes down to the people involved, and Casc is proposing a technically seasoned team committed to serve the County. The Program Manager and main Point-of- Contact will be Melanie Sotelo, Director of Environmental Services, who has over 20 years of professional experience. Additionally, Joe Rosales, with more than 35 years of NPDES experience, will serve as the Assistant Program Manager, and Ed Suher, PG, with over 30 years of NPDES experience in LA County, will serve as Technical Advisor. Highlights of the exceptional qualifications of the Casc team include: •Exceptional knowledge of Commercial/Industrial, Construction and Post-Construction BMP, Restaurant, and similar inspections through having taught MS4 NPDES inspectors for many years through the Riverside County Flood Control and Water Conservation District and San Bernardino County; •Exceptional experience gained through conducting a wide range of similar NPDES services for agencies such as the cities of El Monte, Pomona, Irwindale, Lawndale, San Gabriel, City of Industry, Montclair, Rialto, Highland, Hemet, Temecula, Palm Springs, La Quinta, and Cathedral City; TECHNICAL PROPOSAL 1 City of Diamond Bar March 12, 2023 Page 2 www.cascinc.com •All primary team members hold at least one of the following credentials: PE, ENV SP, CPSWQ, CPESC, CESSWI, QSD, QSP, or QISP; •A project approach that has proven effective in terms of both MS4 permit compliance and reception by the business community; and •A company that has been providing NPDES compliance inspection services since 1993. The Casc Glendora office is located just 13 miles from Diamond Bar City Hall, eliminating long travel times and increasing response times to immediate City requests. Understanding of Objectives: Casc acknowledges our understanding and ability to complete the Objectives as presented within the RFP. Finally, Casc guarantees that all contents of this proposal are valid for 120 calendar days from today, March 19, 2023. Agreement Statement: All terms and conditions outlined in the provided consulting services agreement are acceptable, with the exception of the proposed changes in item “9. Indemnification” shown below. Sincerely, 9. Indemnification. To the maximum extent permitted by Civil Code section 2782.8, Consultant shall indemnify, defend with counsel approved by City, and hold harmless City, its officers, officials, employees and volunteers ("Indemnitees") from and against all liability, loss, damage, expense, cost (including without limitation reasonable attorneys' fees, expert fees and all other costs and fees of litigation) of every nature arising out of or in connection with: (1) Any and all claims under Workers’ Compensation Act and other employee benefit acts with respect to Consultant’s employees or Consultant’s contractor’s employees arising out of Consultant’s work under this Agreement; and (2) Any and all claims arising out of Consultant's negligent performance of work hereunder or its failure to comply with any of its obligations contained in this Agreement, regardless of City’s passive negligence, but ex cepting such loss or damage which is caused by the sole active negligence or willful misconduct of the City. Should City in its sole discretion find Consultant’s legal counsel unacceptable, then Consultant shall reimburse the City its costs of defense, including without limitation reasonable attorneys' fees, expert fees and all other costs and fees of litigation. The Consultant shall promptly pay any final judgment rendered against the Indemnitees. It is expressly understood and agreed that the foregoing provisions are intended to be as broad and inclusive as is permitted by the law of the State of California and will survive termination of this Agreement. Except for the Indemnitees, this Agreement shall not be construed to extend to any third-party indemnification rights of any kind.(3) To the fullest extent permitted by law, the Consultant agrees to indemnify and hold indemnitees entirely harmless from all liability arising out of any claim, loss, injury to or death of persons or damage to property caused by the negligent professional act or omission in the performance of professional services pursuant to this Agreement. This includes water quality, environmental, landscape architecture, civil engineering, land use planning, training, drone, and GIS services to our diverse public and private client base. Our NPDES regulatory compliance projects include municipal program development, program management, permit renewal assistance, storm water monitoring, industrial/ commercial inspections, post-construction BMP design and operation, plan checking, drone services with certified pilots, biological studies, GIS and database support, training, and storm water program staff augmentation. For each project, we assemble a multi -disciplinary team selected to address our clients’ specific needs. Together, we identify, analyze and develop solutions to tackle challenges regarding storm water regulatory compliance. Casc is a certified small business and we currently operate from five offices serving Southern California— Glendora, Colton, Temecula, Palm Desert, and Irvine—and also have an office in Tyler, Texas. Casc also employs over 65 professionals. PROJECT TEAM AND SUBCONSULTANT SUPPORT Ultimately, the success of any project comes down to the people involved, and Casc is proposing a technically seasoned team committed to serving the City. The Program Manager and main Point -of-Contact will be Melanie Sotelo, Director of Environmental Services, who has over 20 years of professional experience, in combination with Ed Suher, PG, serving as Technical Advisor on the project. Melanie and Ed are supported by a strong group of experienced team members and subconsultant team members. CASC ENGINEERING AND CONSULTING Casc is a leader in the storm water profession. Our staff continues to serve in prominent positions for leading storm water professional organizations. Melanie Sotelo currently serves as a Director for the California Stormwater Quality Association (CASQA), is the past Co -Chair of the CASQA Construction subcommittee, and is also the President for the International Erosion Control Association (IECA) Western Chapter. Jeff Endicott served for over 12 years as a Director for CASQA, is a board member and past president of the American Public Works Association Inland Empire Branch, and a past President of the IECA Western Chapter. Both Melanie and Jeff also currently serve on the State’s Construction General Permit Training Team which works to set training standards and materials for CGP ToRs, QSDs, and QSPs. Our staff have been directly involved in developing standard -setting guidance for storm water BMPs including CASQA’s Best Management Practices Handbooks, the first edition of Caltrans’ Storm Water Quality Handbooks, and BASMAA’s “Using Site Design Techniques to Meet Development Standards for Stormwater Quality – A Companion Document to Start at the Source.” In 2017, Casc led the development of three standard-setting reports for CASQA including “LID Technical Standards Review—Bioretention and Standards Review,” “LID Technical Standards Review—Permeable Pavement Details and Standards Review,” and “LID Technical Standards Review—Future efforts related to LID.” Participating in these leadership roles brings the Casc team to the table with regulators and permit writers, working to influence permit language while establishing important relationships for liaison support. NPDES Expertise | Casc has experience in Southern California with conducting monitoring for TMDL requirements, preparing Regional Board approved Final Jurisdictional Maps related to the Statewide Trash Amendment requirements, preparing work plans required by regulators, development of the Whitewater region’s LID BMP Design Handbook, participating in several county’s Permittee Task Forces, and assisting with MS4 Permit renewal assistance and negotiations. Casc’s extensive involvement throughout Southern California, combined with our knowledge of NPDES requirements, will allow Casc to provide the County with efficient and economical execution of their stormwater program. Casc is not just a company of consultants. The firm and many of its staff are leaders in the storm water industry. 3 CITY OF DIAMOND BAR MUNICIPAL NPDES PROFESSIONAL SERVICES APPROACH AND UNDERSTANDING APPROACH TO SCOPE OF WORK AND UNDERSTANDING For the purposes of this proposal, the term “Scope of Work” is understood to be the “Objectives” listed within the City’s RFP. Casc will assign a dedicated and experienced Program Manager for this Scope of Services. Melanie Sotelo, MSE, will serve as the Program and Project Manager for this contract and be the main point of contact for City staff. Ms. Sotelo will work with the Assistant Program Manager to provide the City with an additional point of contact, so that the City is always provided with quick responses. The Technical Advisor, Ed Suher, PG, will review the progress of the contract on a monthly basis and ensure that adequate resources are available to complete scheduled tasks. All work produced will undergo QA/QC review by peers and then by the Technical Advisor prior to being submitted to the City or any regulatory agency. Casc has assisted numerous cities in LA County with MS4 Permit Support Services for several permit terms and has been involved in the implementation of progressively more complex, challenging, and costly MS4 Permits requirements. Casc has also been involved with the Safe, Clean Water Program which provides some relief to cities regarding the funding of stormwater programs, projects, and O&M. Casc will perform the following tasks based on our understanding of the information provided in the RFP: TASK 1 — PROGRAM ADMINISTRATION, AND COMPLIANCE PLANNING AND REPORTING Casc has extensive experience with the MS4 Permit and the TMDL requirements contained within the permit. We are currently assisting several cities with Watershed Management Programs (WMPs [formerly EWMPs]). The experienced and credentialed Casc team is prepared to assist the City by attending meetings and providing the City with advice on upcoming and on-going implementation and compliance requirements. Casc is currently attending the Los Angeles Permit Group (LAPG) meetings, the Upper Los Angeles River (ULAR) Watershed Management Group (WMG) meetings, Bacteria Load Reduction Strategy (LRS) meetings, and MS4 Permit related workshops. Casc will attend Lower San Gabriel River (LSGR) WMG meetings and provide notes from City staff/ management meetings and other NPDES related meetings as required. Additionally, Casc has extensive experience in MS4 Annual Report preparation and understands that providing the City time for review and comment on the internal draft of the report is essential to preparing a thorough report. Casc is also familiar with Semi-Annual WMP Progress Reports. The Program Manager will prepare the drafts of the individual Annual Report and the Semi-Annual WMP Progress Report and provide to the City for review. The finals of each report will be prepared per the schedule outlined by the WMP group. Additionally, Casc is experienced in maintaining various databases for our clients, with access to the data at their fingertips. Casc will select from ESRI GIS databases, Power BI, Access and Excel, databases to provide the City with the most functional use for its needs. Casc will also prepare and deliver annually, one Municipal Employee Stormwater Training class covering the requirements of the overall stormwater management program. The training will be designed to promote a clear understanding of the activities that pollute stormwater and identify opportunities to require, implement, and maintain appropriate BMPs in each employee’s line of work. TASK 2 — SAFE CLEAN WATER PROGRAM (SCWP) PROGRAM FUNDING ASSISTANCE Casc has extensive experience with the SCWP and has prepared and submitted applications for funding consideration for two Infrastructure Projects using the Safe Clean Water Program (SCWP) web -based project module. Casc has assisted with the development and presentation of a project concept for TRP funding. Casc has assisted cities with preparation of SCWP Annual Plan and Reports and awarded funding Transfer Agreements. Casc has also assisted cities with 5-year Project Expenditure Projections and prepared and delivered project specific presentations to the Watershed Area Steering Committees (WASCs). Casc will use this experience to provide the City with SCWP funding assistance as indicated in this task. TASK 3 AND TASK 5 — PLANNING AND LAND DEVELOPMENT (PRIVATE /CIP DEVELOPMENT) Casc has been a major contributor in developing and editing the Stormwater Best Management Practices (BMP) Manuals, SWPPP Preparation Manuals, SWPPP templates, Inspection Reporting forms, BMP/SWPPP Staff Guides, and Stormwater Contract Special Provisions. Further, as members of the California Stormwater Quality 4 CITY OF DIAMOND BAR MUNICIPAL NPDES PROFESSIONAL SERVICES Association’s (CASQA) BMP and Construction Subcommittees, and Executive Program Committee, Casc has provided input and review on the Best Management Handbooks since their creation. Casc ’s heavy involvement with CASQA means that Casc is thoroughly familiar with BMPs and their importance for water quality. Services proposed includes tasks 3 and 5 as listed in the Objectives and is partially summarized below in Casc ’s proposed plan check general process detailed below. General Plan Check Approach Approach: Plan Check comments do not include suggesting a more efficient design, or providing solutions to deficiencies, or critiquing another firm’s approach. The objective of Plan Checking is to verify that the design meets the City’s conditions, design criteria, standards, policies, Permit requirements, and/or standards in the industry. Methods: Plan Checking is more involved than following a standard checklist. It requires solid design experience and/or field implementation understanding. Drawing on years of design experience and an eye for BMP design practices with the City’s needs in mind, reviews are conducted to provide a quality Plan Check. All reviews will be conducted within 5 to 10 business days of receipt of complete information and/or plan set. Plan Log: Casc will utilize an internal database for tracking of all plan reviews. Casc will be able to provide status of all reviews at any time during the review process. City Standards & Design Criteria: Casc will refer to the City’s standards, LID ordinances, and applicable Permit requirements to effectively communicate the City’s requirements. Checklists: Checklists are used to guide the Plan Checker to a thorough Plan Check and/or design review. Casc has developed checklists for reviewing various improvement plans or the firm can use City checklists. Casc will utilize its collective plan check experience to make recommendations related to the current plan check criteria and checklist. Redlines: “Redlines” are used to convey comments on plans and reports. In our experience, “redlines” placed directly on plans and in reports are widely understood and are an effective means of conveying comments. In some cases, “checklists” may be used to convey routine comments and are employed when determined appropriate by the Plan Checker. Casc currently utilizes both digital BlueBeam software and hardcopy markups on hard copies of plans for plan check and is comfortable in both formats. Casc is able to use OneDrive to digitally transfer files both for acceptance of reviews or return of comments. Return of Plans: A digital copy of the Plan Check and Design Review comments will be maintained for record - keeping purposes until plans receive final approval from the City. Efficiency: Casc follows these five basic steps for successful and efficient Plan Checking design review: Be Direct: Comments are clear and concise. Be Objective: Plan checks are reviews, not critiques. Be Thorough: Review everything and cross check drawings. Be Consistent: Use the same staff throughout the project life when feasible. Be Neat: Handwrite or type comments legibly. Casc’s staff is comprised of certified inspectors and Qualified Storm Water Pollution Prevention Plan (SWPPP) Developers (QSD) and/or Practitioners (QSP). Casc will use City reviewed inspection forms and Best Professional Judgment (BPJ) to inspect and assess the effectiveness of Post -Construction BMPs for COO issuance, or as needed. Casc will record Post-Construction BMP inspections, and related tracking data, as identified in the MS4 Permit, in a Post-Construction BMP Inspection Database. TASK 4 AND TASK 5 — CONSTRUCTION INSPECTIONS (PRIVATE /CIP PROJECTS) At the direction of the City, Casc’s inspectors will inspect and document whether operators of construction sites within the City comply with all applicable regulations of the Construction General Permit (CGP). Casc ’s inspectors will review site conditions to determine if runoff from active construction projects is effectively controlled through proper Best Management Practices (BMPs). Follow up inspections will be conducted for non - compliant sites. Casc will, in coordination with the City, assist with enforcement notices to ensure that construction sites are in compliance with the CGP and City requirements. Casc ’s staff is comprised of certified inspectors and Qualified Storm Water Pollution Prevention Plan (SWPPP) Developers (QSD) and/or Practitioners (QSP). Casc’s inspectors are able to provide inspections for private development as well as serve in the roles of QSD and QSP for all CIP projects, as needed. Casc’s team understands the requirements of the 2009 Construction General Permit (CGP), but also the requirements of the 2022 CGP that is coming into effect on 5 CITY OF DIAMOND BAR MUNICIPAL NPDES PROFESSIONAL SERVICES September 1 of 2023. Casc’s inspectors can navigate both CGP permits as will be required through 2025. TASK 6 AND TASK 8 — INDUSTRIAL/COMMERCIAL (I/C) FACILITIES/ PUBLIC AGENCY FACILITIES Casc will conduct Industrial and Commercial Facility Inspections from the City ’s list of approximately 100 currently identified facilities. Casc will also inspect municipal facilities, as required. Inspectors will verify that appropriate Best Management Practices (BMPs) are implemented at the facilities, ensure that illicit connections and/or discharges are eliminated, and provide necessary educational materials for distribution to businesses. Casc will provide a customized Industrial/Commercial Facility Inspection Form (electronic, on tablet) with the City’s logo and contact information. Casc will assist the City in preparing a letter of introduction for the City to send to the facilities indicating the purpose and scope of the inspections, and Casc will deliver those letters to the facilities. Casc will periodically provide City staff with a status of the inspections completed. Casc will provide the City a copy of all inspection reports and follow -up inspections. Casc will perform follow-up inspections of facilities with significant compliance deficiencies, assumed to be 20 facilities. If compliance is not achieved after a second inspection, City environmental staff or Code Enforcement may be notified for further enforcement action and a joint inspection with Casc inspectors and City staff may be warranted. TASK 7 — IDDE ILLICIT DISCHARGE DETECTION ELIMINATION INSPECTIONS Casc has been assisting several other cities in LA County with on -call IDDE response and assessment services since 2004. Casc has conducted the IDDE investigations and assisted the cities in directing the abatement and clean up of spills and other illicit discharges. Casc has coordinated with City and County agencies regarding the discharge and the Illicit Discharge Elimination requirements of the MS4 Permit, including post -event documentation and enforcement assistance. Casc has documented all elements of discharges including type and volume of discharge, owner/facility name and location, responding agencies, and contractor/company in charge of clean up. Casc has assisted cities in preparing the draft Notice of Violation letters for signature and distribution by City officials. As part of the Notice of Violation letters, Casc has provided BMP implementation suggestions to educate facility managers and prevent future discharges. Casc ’s designated IDDE responder will be dispatched within 20 hours of notification, and will undertake actions and measures in conformance with (as closely as possible) to the requirements of the MS4 Permit and its objectives. TASK 9 — PUBLIC INFORMATION AND PARTICIPATION PROGRAM Casc has over 20 years of experience in developing and distributing effective educational Stormwater related materials to municipalities, businesses, schools, and other organizations. Casc understands that public outreach and participation is a key component of the MS4 Permit. Casc will develop materials targeting the pollutants of concern in the watershed, and prepare press releases, website content and other educational materials to increase public awareness and to involve the public to help with controlling pollution associated with urban runoff. Casc will assist the City with reaching residents and businesses through either the City ’s website or direct distribution by the most effective means. Casc will prepare drafts of all documents for City review prior to posting or distribution. 6 CITY OF DIAMOND BAR MUNICIPAL NPDES PROFESSIONAL SERVICES PROJECT SCHEDULE The chart below presents the proposed schedule and estimated hours to be allocated to each task listed in the RFPs’ Objectives. The team is led by Program Manager Melanie Sotelo, who will serve as the primary contact with the City, supported by Technical Advisor Ed Suher, who brings exceptional Los Angeles MS4 Permit development and implementation experience, and Senior Engineering Director, Jeff Endicott, who is a Professional Engineer and a leader in the water quality field in the State of California. Casc’s strong team of water quality inspection and technical staff have the availability to complete the proposed work and needs no subconsultants to assist with tasks listed in the objectives within the RFP . Personnel to be assigned to this project are all experienced in stormwater compliance requirements, including conducting numerous stormwater compliance inspections, such as food facilities and hazardous material facilities inspections. The CASC team holds professional registrations or credentials that attest to their knowledge, skills, and abilities so that the City can have exceptional confidence in the team.
