(“UltraSystems”) is pleased to submit our proposal to the City of Diamond Bar (“City”) to prepare an Initial Study/Mitigated Negative Declaration (S/MND) pursuant to the California Environmental Quality Act (CEQA) for a planned electronic billboard, located at 880 South Lemon Avenue. UltraSystems is a full-service planning and environmental consulting firm serving public and private sector clients throughout California. We have 52 employees that have a broad range of experience preparing environmental documents (EIRs) and technical studies in full compliance with the California Environmental Quality Act (CEQA). UltraSystems is headquartered in Irvine, California, and this project would be managed from our Irvine office. UltraSystems is a full-service planning and environmental consulting firm. Since our inception in 1994, we have successfully prepared more than 7,000 environmental compliance documents pursuant to CEQA/NEPA, as well as engineering studies and focused technical reports. Our team can perform robust CEQA environmental analysis and document preparation for this project. The core project team will be based in our Irvine office, led by Betsy Lindsay, MURP, Principal, Dr. Robert Manford, DPPD, Senior Project Manager. His knowledge, skills and experience are highlighted herein and will leverage our project team’s leadership skills with our experienced in-house experts to provide the required services to the City. QUALIFICATIONS 2.1 Introduction UltraSystems Environmental (UltraSystems) is pleased to provide this proposal to prepare CEQA compliance documentation to assess the potential environmental impacts associated with a proposed electronic billboard and to identify appropriate mitigation measures and/or project design features to avoid or reduce those impacts to acceptable levels. The proposed project site is located at 880 S. Lemon Avenue in the City of Diamond Bar, on the premises of the Walnut Unified School District’s Main Office. The Assessor Parcel Number (APN) is 8760-015-901. The 6.1-acre project site is bounded by Walnut Elementary School and adjacent Lycoming Street to the north, south Lemon Street to the west, Glenwick Street to the east, and California State Route 60 (SR 60) to the south. The proposed project entails the construction and operation of a new 14 feet by 48 feet double faced digital billboard at a maximum height of approximately 100 feet from grade. A Conditional Use Permit (CUP) and Development Code Amendment will be needed for the City of Diamond Bar to approve the proposed project and enable its operations. Additional discretionary actions needed for project approval include a Development Review for project design purpose and Development Agreement between the School District and the City. The General Plan land use designation for the proposed project site is “S” School, and the existing zoning is “L”, Light Industrial. The City of Diamond Bar, acting as Lead Agency under California Environmental Quality Act (CEQA), is requesting the preparation of a thorough Initial Study (IS) to support a Mitigated Negative Declaration (MND), or to serve as the basis for the preparation of a focused Environmental Impact Report (EIR) if needed. This proposal responds to the City of Diamond Bar’s Request for Proposals by doing the following: (1) Provides UltraSystems qualifications and introduces the members of our Project Team who will remain committed to the project from the time of contract award through adoption of the anticipated IS/MND; (2) Presents a representative project list completed by UltraSystems in the last five years that are similar in scope and services to the proposed project; (3) Presents our understanding of the project, approach and scope of work designed to ensure full compliance with applicable provisions of CEQA and its implementing Guidelines, as amended; (4) Advances a realistic performance schedule by which to successfully complete the scope of services; (5) identifies the costs estimated to execute the scope of services on a task by task and person basis; and (6) provides a statement accepting all conditions listed in the RFP document.  CEQA CONSULTING SERVICES  Page 5 UltraSystems No. 240826 2.2 UltraSystems Project Team UltraSystems was established in 1994 as a consulting practice specializing in the California Environmental Quality Act (CEQA) and the National Environmental Policy Act (NEPA), and to assist private industry and governmental agencies to navigate environmental regulations. Since then, the firm has prepared over 7,000 environmental reports, engineering studies or technical studies for clients. UltraSystems continues to specialize in providing comprehensive services, emphasizing quality and client-oriented service. UltraSystems’ team of working professionals offers the highest level of experience, knowledge and commitment in providing environmental and engineering services. Our projects have ranged in complexity from categorical exemptions and categorical exclusions to Negative Declarations (ND) and Mitigated Negative Declarations (MND), to full Environmental Impact Reports (EIR) and Environmental Impact Statements (EIS). Additionally, we process and deliver the necessary entitlements, project permits and approvals so that project development is not impeded. Our Project Team is comprised of individuals with extensive project management and technical expertise and experience applied to the successful preparation of CEQA compliance documents for hundreds of projects throughout California. The Project Team committed to successfully undertaking the environmental review of the proposed project is shown on the table below. Serving as Project Director will be the firm’s owner, Ms. Betsy A. Lindsay, MURP, Founder/CEO. She will represent all facets of our firms’ contractual commitments to the City and ensure that all resource requirements are met during the execution of the Work Program. Dr. Robert Manford, DPPD, Director, will serve as our Senior Project Manager on this assignment; he will be responsible for the day-to-day activities of the Project Team and will be our Primary Point of Contact with the City of Diamond Bar, and the applicant if necessary. Dr. Manford has extensive experience managing teams and/or projects with respect to CEQA compliance and project entitlements. UltraSystems has identified members of our Project Team. Except for Lighting/Glare Technical Studies if deemed necessary (and any additional technical studies required by the City), no subconsultants are anticipated to be used on this project. The proposed project included the replacement of the following existing components: home and visitor bleachers, electric scoreboard, synthetic turf, synthetic track, home and visitor field houses (which include restroom/concession structures), press box, ticket booth, fencing, and paving. The project also included a new home/visitor path of travel, and ADA-compliant accessibility features. UltraSystems conducted the environmental analysis and was hired by the La Norwalk-La Mirada Unified School District (District) to prepare an IS/MND for the project. As part of the analysis UltraSystems’ utilized its team of in-house experts to prepare the following technical analysis in support of the IS/MND: lighting analysis, noise impact study, air quality/greenhouse gas emissions analysis, and cultural resources assessment. Because of the proximity of sensitive land uses (residences and a church) across the street from the project site, special focus of the potential impact of new field lighting for the football field and noise during project construction and operation was addressed in the IS/MND. Nonetheless, for each environmental factor, current baseline conditions and, where applicable, projected baseline conditions will be presented in sufficient detail to enable the reader to not only understand what they are, but how they may change because of the proposed project. The impact analyses provided in the Initial Study will employ methods and comprise levels of detail commensurate with the specificity of available baseline conditions data. The background data collection and the technical reports to be prepared will provide the foundation for most impact discussions. For each environmental factor, the type and extent of all applicable impacts will be presented and be focused on by the questions set forth in Appendix G of the State CEQA Guidelines. Thereafter, all identified impacts will be assigned a level of significance based on established quantitative and qualitative Thresholds of Significance. Mitigation measures will then be developed if warranted. Our approach to the mitigation measure discussions under each environmental factor is to first identify project features designed to minimize a particular impact, then identify regulatory compliance requirements designed to minimize a particular significant impact, and lastly, present any mitigation measures required to reduce any identified potential significant impacts. We understand that it is critical to maintain ongoing communications with the City throughout the IS preparation and processing period. Most important among the reasons to do so is that in the event a problematic impact conclusion is identified, immediate notification to the City of the relevant circumstances would enable the project applicant’s design team, if necessary, to address the issue by revising the project design. UltraSystems is requesting through the City that the Project Applicant provide the following documents and any available technical studies pertaining to the project, for review and/or analysis in the IS/MND: • Project Lighting/Operations Plan • Light/Glare Study  CEQA CONSULTING SERVICES  Page 20 UltraSystems No. 240826 • Phase I ESA, if available • Geotechnical Report • Tree/Arborist Report • Community Outreach Plan/Information 4.2 Work Program Scope Our Work Program follows and is organized by Major Tasks and Tasks. MAJOR TASK 1.0 – PROJECT INITIATION, MEETING, MANAGEMENT & PROJECT DESCRIPTION Task 1.1: Project Kick-Off and Progress Meetings. This Task consists of attendance by our Project Director and Sr. Project Manager at one project kick-off meeting via Zoom. This meeting is critical to setting the tone for all subsequent efforts. This task also includes the attendance of our Sr. Project Manager at no more than two project progress meetings during the contract performance period. It is anticipated that all of these meetings will be virtual. In addition, as requested, UltraSystems will participate in a minimum of three conference calls with City staff to discuss the project status and issues related to the environmental review process. UltraSystems will be available throughout the term of our services to respond to City staff requests for input concerning various aspects of the CEQA process. Task 1.2: Project Management and Coordination. This Task consists of routine project management and communications functions of our Project Manager throughout the contract performance period. Task 1.3: Project Description. After receipt of a formal notice to proceed and receipt of project related information, UltraSystems will prepare a draft project description for review and comment by the City. The Project Description will contain all the information required under Section 15124 of the CEQA Guidelines including a description of the proposed project, including design, construction timeline and operations, in addition to scheduled or routine maintenance. UltraSystems will revise the Project Description based on one round of comments received from City staff and prepare a final Project Description. MAJOR TASK 2.0 - TECHNICAL STUDIES This Major Task includes the collection of all requisite information for those issues for which no stand-alone technical reports are being prepared, and the preparation of the technical studies/technical analyses listed below. For all technical reports, drafts of the technical studies will be submitted to the City for review and comment and then revised as warranted to become final technical reports prior to being used to support issue specific discussions in the Initial Study. All technical studies will be included as appendices to the Initial Study to be prepared for the proposed project. Task 2.1: Background Data Collection/Evaluation. For those issues in the Initial Study requiring evaluation but for which no technical study will either be prepared or made available by the project applicant, UltraSystems will conduct a site visit and literature research to document existing conditions at the project site and surrounding areas. Sources of data to be used in this analysis include the City of Diamond Bar General Plan and its Program EIR, City of Diamond Bar Zoning Ordinance, adopted design guidelines and development review process information, in addition to relevant  CEQA CONSULTING SERVICES  Page 21 UltraSystems No. 240826 adopted/certified CEQA documents prepared for other projects in the immediate area, and applicable regional policy plans, among others. Task 2.2: Phase I Cultural Resources Assessment. UltraSystems will prepare a Cultural Resources Assessment for the proposed project. California Assembly Bill (AB) 52 requires consultation with California Native American tribes that are traditionally and culturally affiliated with the geographic area where projects require a (1) notice of preparation (NOP) or (2) Notice of Intent (NOI) to Adopt a Mitigated Negative Declaration (MND). AB 52 requires lead agencies to consult with these tribes, if they so desire, regarding project alternatives, recommended mitigation measures, or potential significant effects before the release of the project environmental review document. The Native American Heritage Commission (NAHC) would be contacted to request a search to identify Sacred Lands and culturally significant sites, if any, and obtain a list of Native American tribes, organizations and interested individuals that should be contacted to provide information on culturally important sites within the 0.5-mile Area of Potential Effect (APE). Prehistoric and historic archaeological literature and record reviews would include Environmental Impact Reports (EIRs), cultural technical reports, site records, previous assessments, research designs, monitoring programs, and related cultural documentation to identify cultural resources within the APE. Records would be reviewed at the South-Central Coastal Information Center at California State University Fullerton. A pedestrian survey of the project site following standard professional archaeological procedures would be conducted to determine if cultural resources are present on the surface and identify areas with a high possibility of containing subsurface cultural resources. Artifacts, features, sites, and structures greater than 50 years of age, if any, would be photographed and recorded. Based on these data, a Phase I Cultural Resource Survey Report would be prepared to: (1) document research methodology and findings, (2) provide recommendations for avoidance of impacts or preservation of cultural resources, if any, that may be encountered during construction or other project activities, and (3) provide mitigation measures to protect and preserve cultural resource if avoidance is not feasible in compliance with CEQA and local standards. A site record and/or site record update would be completed and submitted to appropriate agencies upon completion of the field survey. The Phase I Cultural Report would be provided as an appendix to the IS/MND. As required, the City will handle AB 52 consultation requirements, including government-to-government consultation, with the Native American Tribes, with support from UltraSystems. Specifically, UltraSystems will prepare an AB 52 letter and will assist in initiation of the required tribal consultation pursuant to AB 52. Task 2.3: Paleontological Resources Search. UltraSystems will contact the Los Angeles County Natural History Museum (LACM) to request previously recorded paleontological resources for the project site and vicinity. After a literature review, a pedestrian survey following standard professional paleontological procedures will be conducted to assess outcrops of the underlying geology to locate paleontological resources. The methods and findings of the assessment—including impacts and any required mitigation measures—will be discussed in the IS/MND. The records search results from the LACM will be included as an appendix to the IS/MND. MAJOR TASK 3.0 - INITIAL STUDY AND MITIGATED NEGATIVE DECLARATION Task 3.1: Administrative Draft Initial Study. UltraSystems will prepare an Initial Study (IS) pursuant to CEQA Section 21080 and Sections 15063 through 15065 of the CEQA Guidelines. Technical analyses (refer to Major Task 2.0) will be conducted for different environmental resource areas, as applicable and needed, and well supported responses for all questions listed in CEQA Guidelines Appendix G will be provided. Mitigation measures would be selected to avoid or reduce potential environmental impacts to less than significant levels, where feasible. UltraSystems will also prepare a draft Mitigation Monitoring and Reporting Program (MMRP) pursuant to CEQA Guidelines Section 15097. The MMRP will specify: (1) the responsibility for implementation; (2) the timing for implementation; (3) the mechanisms of monitoring activities, including the frequency, contact and format for reporting requirements; and (4) the content, requirements and ultimate disposition of a Final MMRP. Task 3.3: Revise Administrative Draft Initial Study. After the City reviews and comments on the administrative draft IS, UltraSystems will revise the Administrative Draft IS per the city’s comments and submit a Draft IS to the City. UltraSystems will submit the administrative draft IS/MND and MMRP to City staff for a two-week review and comment period. Our schedule assumes one round of City review. Task 3.4: Public Draft IS/MND and MMRP. After receipt of the City’s comments on the administrative draft IS/MND and MMRP, UltraSystems will revise the administrative draft IS/MND and MMRP based on the comments received and resubmit it to the City as the Public Draft IS/MND. The City of Diamond Bar will be responsible for public circulation and all public noticing unless requested otherwise. Task 3.5: Prepare the Notice of Intent (NOI) to Adopt a Mitigated Negative Declaration and Notice of Completion (NOC) if applicable. A public notice (NOI) will be drafted by UltraSystems for City use that will inform the public and agencies of the City’s intent to adopt a MND, provide information relating to the project, its location and description, and where the document is available. The notice will also identify the public review period, where to send comments, and provide information relating to the City Planning Commission or City Council Hearing as applicable. UltraSystems will also draft any applicable notices that will be sent to the State Office of Planning and Research by the City. All distribution will be handled by the City for this project, unless requested otherwise. MAJOR TASK 4.0 - FINAL IS/MND/MMRP AND PUBLIC HEARING ATTENDANCE/NOD Task 4.1: Response to Comments. UltraSystems will prepare responses to environmental comments received on the Draft IS/MND. Upon receipt of comments on the IS/MND during the review period, UltraSystems would review the content of the letters to determine the nature and extent of the response to comments (RTCs) effort. This scope of work assumes UltraSystems will prepare responses for up to 20 individual environmental comments received on the Draft IS/MND. The RTCs would be provided to the City, and after receiving one set of consolidated comments from  CEQA CONSULTING SERVICES  Page 23 UltraSystems No. 240826 the City, the RTCs would be finalized. Responding to more than 20 individual comments would be done on a time and materials basis with prior approval by the City. Task 4.2: Final IS/MND and Mitigation Monitoring and Reporting Program. UltraSystems will prepare the final IS/MND that will include revisions to the Draft IS/MND based on comments received. If required, UltraSystems will assist the City in soliciting and incorporating the views of Responsible Agencies regarding the scope and the appropriate aspects of the monitoring and reporting program and finalizing the MMRP. Task 4.3: Public Hearing Attendance/Draft NOD. UltraSystems will attend and participate in two public hearings (up to two hours each hearing, via Zoom) to answer questions regarding the environmental document and impact analysis. UltraSystems, in cooperation with the City will help prepare needed materials and participate in the hearing to the extent determined appropriate. If environmental issues arise at the hearings requiring additional investigation(s) beyond the scope of work within this proposal, UltraSystems will provide the City with specific recommendations concerning an appropriate response. UltraSystems would prepare any additional studies that may be required immediately after receiving the City’s authorization to proceed. UltraSystems will also draft a Notice of Determination and submit it to the City for their review and use after adoption of the CEQA document and project approval. The project would demolish the existing Aquatic Center, which was built in 1993, and associated infrastructure and utilities. The project would construct a 50-meter athletic pool, 2 new buildings, an electronic scoreboard and new pool lighting. UltraSystems prepared the IS/MND and conducted technical studies regarding Greenhouse Gas Emissions, Cultural Resources, and Noise. The MND for this project was certified by the Corona-Norco Unified School District on January 16, 2024. Rio Hondo Park, Pico Rivera, CA; May 2023 to Ongoing Ms. Lindsay serves as Principal-in-Charge for this project. The proposed project will allow for further renovation and development of Rio Hondo Park in Pico Rivera. The existing park site consists of approximately 44 acres. The proposed changes would include the construction of a new soccer field, restrooms, exercise stations, picnic shelters, walking paths, a bird and butterfly garden as well as the renovation of existing handball courts, concession stands basketball courts and parking lots. Lake Los Angeles Pedestrian Plan Implementation Phase I, Community of Lake Los Angeles, CA; November 2021 to December 2021 Ms. Lindsay served as Principal-in-Charge for this project. This project consisted of improvements to two roadway segments such as a bike path, sidewalks, curb and gutter, a parking lane, and a paved shoulder; and pedestrian activated warning systems (PAWS) and enhanced crosswalks with advanced yield lines at 10 intersections, all in the unincorporated community of Lake Los Angeles in northern Los Angeles County. Garfield Avenue Complete Street Improvements Project, City of South Gate, CA; July 2020 to December 2020 Ms. Lindsay served as Principal-in-Charge for this project. The proposed project comprised three sub-projects (Subprojects A, B and C) that were separately funded and included street improvements along Garfield Avenue within the City of South Gate (City). The proposed project would improve traffic safety and create pedestrian infrastructure along Garfield Avenue. Advanced Dilemma Zone Detection Improvements at 49 Intersections Project, City of San Bernardino, CA; May 2020 to December 2020 Ms. Lindsay served as Principal-in-Charge for this project. The City of San Bernardino was awarded federal funding through the Highway Safety Improvement Program (HSIP) to implement advanced dilemma zone detection at 49 signalized intersections within three roadway corridors (Highland Avenue, Baseline Street, and Mount Vernon Avenue) in the City. The project included improvement of traffic safety, operation reliability, and traffic throughput by implementing advanced dilemma zone detection systems, upgrading traffic cabinets and controllers, conflict monitors, pull boxes and conduits, and signal poles and mast arms at 49 signalized intersections within the City. Hart Park Pickleball and Fitness Circuit Design, Orange, CA; August 2022 to Ongoing Ms. Breckenridge is responsible for GIS mapping and all graphic preparation to be included in the CEQA documentation for this project. The City of Orange proposes to develop a small portion of a 56-acre park (“Hart Park”) at 701 S. Glassell Street, Orange, CA. Hart Park is designated in the National Register of Historic Places and is currently home to several historic structures and architectural elements, that are located throughout the park site. WPA projects include the Bandshell and the Bath House/Plunge in the park (1933-1935). The City is proposing to develop a small area of the park for a proposed pickleball facility and fitness amenities to meet the needs of its residents. Development would include lighted pickleball courts, area lighting, outdoor fitness equipment, along with paved access to these amenities. Butterfield Overland Trail Seg. 4, Riverside County, CA; IS-MND; July 2022-to Ongoing Ms. Breckenridge is serving as Deputy Project Manager for this project. Riverside County Regional Park and Open Space District are developing the Butterfield Overland trail segment. The trail will run roughly parallel to the historic route and will include an existing ridgeline trail that provides a spectacular view of the Santa Ana Mountains and the historic Butterfield Overland Stage route. UltraSystems conducted a cursory examination of the environment in which Proposed Segment 4 of the Butterfield Overland Trail Project will be located. Based on this review, UltraSystems believes that a well-prepared Initial Study (IS) leading to a Mitigated Negative Declaration (MND), and comprehensive Mitigation Monitoring and Reporting Program (MMRP) will collectively suffice as the appropriate CEQA compliance documentation for the Proposed Project. South Whittier Community Bikeway Access Improvements, Los Angeles, CA; August 2023 to December 2023 The project was located in the unincorporated Los Angeles County community of South Whittier and bordered by the City of Santa Fe Springs to the west, the City of Whittier to the north and northeast, and the City of La Mirada to the southeast and south. The purpose of the project was to improve connectivity and provide a missing link in the existing inter-jurisdiction regional bikeway network within the community. The project consisted of pedestrian intersection improvements, road rehabilitation, bikeway access improvements, landscape improvements, traffic signal improvements, and street lighting improvements. The maximum depth of excavation was 12' deep for traffic signal foundations. The project required removal and replacement of 60 trees (Indian Laurel Fig) that were causing damage to the roadway and sidewalks. 9160-9174 Sunset Boulevard Project, City of West Hollywood, CA; June 2020 to November 2023 Ms. Breckenridge served as GIS Manager, preparing maps/figures and data, and providing oversight for preparation of maps/figures and data processing/calculations for the CEQA Initial Study, EIR, and required technical studies. UltraSystems prepared an Environmental Impact Report (EIR) in response to a development application by a private developer to construct a five-story, approximately 53,029-square-foot commercial building (including retail, restaurant, and office uses on the first floor and exclusively office uses on floors two through five), on an approximately 0.43-acre site located at 9160-9174 Sunset Boulevard in the City of West Hollywood. The project consisted of the demolition of the existing commercial buildings and surface parking on the project site. The project provided approximately 105 car parking spaces in a three-level underground parking structure and included an LED media system, or digital canvas, integrated into the west, north and east facades of the new building. OC Loop Bike Trail, Segments O, P, and Q, IS/MND & CE, Orange County, Los Angeles County, CA; September 2019 to September 2021 Ms. Breckenridge prepared the CE according to Caltrans requirements, assisted with preparation of the IS/MND, conducted senior QA/QC, managed GIS data mapping and preparation of figures for the IS/MND, Cultural resources reports, biological resources reports, and jurisdictional delineation. UltraSystems prepared an IS/MND and NEPA Categorical Exclusion (CE) for this Orange County Public Works project that consisted of developing of a 2.7-mile Class I and Class II Bikeway component of a larger 66-mile regional bikeway corridor called the OC Loop, Segments O, P, and Q, spanning the cities of La Mirada, Buena Park, and Cerritos, California.
