The City of Diamond Bar shall implement an SB 1383-compliant Edible Food Recovery Program that:
(1) Educates commercial edible food generators as required by SB 1383.
(2) Increases commercial edible food generator access to food recovery organizations and food recovery services.
(3) Monitors commercial edible food generator compliance.
(4) Work with the City to increase edible food recovery capacity to meet edible food recovery needs.
The City will establish a recordkeeping program that includes all documents supporting its compliance with SB 1383 and shall include, at minimum:
(1) A list of commercial edible food generators that have a contract or written agreement with food recovery organizations or services pursuant to Section 18991.3(b).
(2) A list of food recovery organizations and food recovery services and their edible food recovery capacity.
(3) Documentation of the actions taken to increase edible food recovery capacity.
On a regular basis, the City shall inspect and otherwise work to ensure all edible food waste generators, required by SB 1383 to obtain and maintain a written agreement with an organic
waste collection organization/service, are compliant.
Initially, all identified Tier 1 and Tier 2 generators and food recovery organizations within the city will be inspected and provided the following:
(1) Information about the jurisdiction's edible food recovery program.
(2) Information about commercial edible food generators or organization requirements.
(3) For generators, information about food recovery organizations and food recovery services operating within the jurisdiction, and where a list of those food recovery organizations
and food recovery services can be found.
(4) Information about actions that commercial edible food generators can take to prevent the creation of food waste.
(5) For food recovery organizations, records they are expected to maintain.
Thereafter, education shall continue annually, and site inspections shall occur on a schedule that ensures all Tier 1 and Tier 2 edible food generators receive inspections at least once
every three (3) years.
On an annual basis, the City shall update its list of food recovery organizations and food recovery services operating within its jurisdiction. This list shall include, at a minimum,
the following information about each food recovery organization and each food recovery service:
(1) Name and physical address.
(2) Contact information.
(3) Collection service area.
(4) An indication of types of food the food recovery service or organization can accept for food recovery.
The City shall include all relevant documents supporting its compliance in an Implementation Record, including, but not limited to:
(1) Copies of the information provided, including flyers, brochures, newsletters, other messaging, and website and social media postings.
(2) The date and to whom the information was disseminated or direct contact made. If mass distribution through mailings, or bill inserts is used, the date, a copy of the information,
and the type and number of accounts receiving the information.
(3) If the requirements were met solely with electronic media, the record shall include a copy, with dates posted, of social media posts, e-mails, or other electronic messages.
(4) If a designee is used, records shall include a copy of the materials distributed by the designee.
