Let’s work together to rescue edible food and feed communities in need. What is SB 1383? SB 1383 is a California state mandate to reduce organic waste destined for landfills by 75%, and to recover 20% of edible food that would otherwise be sent to landfills by 2025. Why is this law in place? Food waste is the second largest contributor of organic matter in California landfills which produces methane gas, a known greenhouse gas pollutant. California has made a commitment to reduce greenhouse gas emissions and air pollution by implementing SB 1383. How and when does this affect my jurisdiction? As a Tier 1 or Tier 2 food generator (see back page to identify which tier you fall into), you must comply with SB 1383 or face fines and penalties. Below is a timeline of requirements you must meet. Year Requirements Actions you need to take January 1, 2020 50% reduction in organic waste disposal Provide a written agreement with a food recovery service or organization. January 1, 2022 Regulations take effect and enforcement begins Tier 1 generators must be compliant with SB 1383 requirements (see back page). January 1, 2024 Local governments take over enforcement Non-compliance notice of Tier 1 violations and penalties to begin. Tier 2 generators must be compliant with SB 1383 requirements. January 1, 2025 75% reduction in organics waste disposal and 20% increase in edible food recovery A food recovery service or organization needs to be established and recovering all edible excess food from your facility.
