Box 4025, Sacramento, CA 95812 www.CalRecycle.ca.gov  (916) 322-4027 California Environmental Protection Agency Department of Resources Recycling and Recovery Gavin Newsom California Governor Yana Garcia Secretary for Environmental Protection Zoe Heller CalRecycle Director Sent via Certified Mail January 9, 2025 Dan Fox City Manager City of Diamond Bar 21810 Copley Drive Diamond Bar, CA 91765 Subject: Corrective Action Plan 1171.SLCP.CAP.2023.3 Modification and Time Extension Request for City of Diamond Bar Dan Fox: The Department of Resources Recycling and Recovery (CalRecycle) has received the City of Diamond Bar’s (Jurisdiction) request to modify and extend the final deadline to implement its Corrective Action Plan 1171.SLCP.CAP.2023.3 (CAP) to January 31, 2025. Please find the approved CAP addendum attached. The Jurisdiction’s modification and extension request stated that changes to the tasks and additional time are required to fully address the violations as set forth in Section 3.2 of the original CAP issued on March 29, 2023. CalRecycle’s approval is based on the justification provided by the Jurisdiction. The CAP addendum includes milestones to address remaining violations. Dates for bimonthly status reports and meetings during the revised oversight period are included in the Schedule for Compliance. The tasks listed in the CAP addendum will be the only ones that require status updates through bimonthly status reports and meetings during the revised oversight period. In accordance with Public Resources Code Section 42652.5, failure to implement programs and/or comply with all sections of the CAP at any time may result in CalRecycle’s revocation of its approval of the CAP and imposition of administrative civil penalties retroactively to the date of violation in 2022, for administrative civil penalties accruing in 2023, and for administrative civil penalties accruing during any other additional time covered by the CAP.
