HomeMy WebLinkAboutlimited collection permit (attachment a)Attachment A The State of California mandates that the City of Diamond Bar meet diversion requirements and accurately monitor and report all waste and diversion activities. Per Diamond Bar Municipal Code (DBMC) Section 8.16.460, residents and businesses must utilize one of the City’s two franchise waste haulers or secure a Limited Collection Permit approved by the Public Works Director. The City reserves the right to modify the terms and conditions of the permit at any time and may revoke a permit for violation of any permit condition. 1. Application Process  Permittees must submit this completed application, including but not limited to the following additional requirements listed in DBMC Section 8.16.540: o Liability Insurance; Workers Compensation Insurance; Indemnify City against liability; Maintain an office for inquiries and complaints; Obtain all applicable permits and licenses required by Federal, State or Local agencies; Responsible for damages caused as a result of its acts or omissions; Maintain records and provide City with inspection authority; Hours of collection requirements; Minimize impacts to noise and public traffic.  Certain covered projects must also submit a completed Recycling and Waste Reduction Application as required under DBMC Section 8.16.650.  Applications will be reviewed within ten (10) business days. The decision of the Public Works Director is final. 2. General Provisions  Limited Collection Permits are valid for one calendar year and expire on December 31st. Notification by the City prior to the expiration of the permit will not be provided.  Pay Limited Collection Permit Fee as follows: Issued January-March - $200; April-June $150; July-September $100; or October-December $50.  Permittee shall not have any past due balances with the City or the City’s franchise waste haulers, or any outstanding violations.  Approved permits shall not be transferred, delegated or assigned.  No Collection Permittee shall perform Solid Waste Collection Services otherwise provided for in a Solid Waste Franchise Agreement. 3. Waste Containers  Containers shall comply with all local, state, and federal health and safety standards. 4. Disposal/Diversion and Reporting Requirements  Waste shall be disposed of at least on a weekly basis only at licensed waste disposal facilities, including a landfill, recycling center, recyclable material purchasing center, compostable materials handling facility, transfer station, green material composting facility, or other facility permitted to accept such materials.  Permittee is required to recycle at least 75% of all waste generated by the covered construction project as defined in Section 8.16.620.  Permittee shall retain and provide documentation, consisting of a completed Recycling and Waste Reduction Compliance Report, gate tickets, receipts for disposal, etc. that proves waste has been disposed in the proper manner and at the required frequency. Documentation shall be provided to the City for verification on a monthly basis no later than the 10th day of each calendar month. Authorized Vehicles/Transport  Permittee shall transport waste only in approved vehicles.  Permittee is subject to all local, state, and federal laws related to the transportation of solid waste, as well as storm water discharge regulations.  Permittee is responsible for any damages or clean-up costs resulting from its activities. 6. Modification of Limited Collection Permit  The City reserves the right to modify the terms and conditions of the permit at any time. 7. Revocation, Suspension, Appeal.  The City Manager may revoke or suspend any permit. The applicant may appeal the denial, revocation, or suspension of a permit.  Upon revocation of the permit, service must be immediately established with the appropriate franchise waste hauler. It is unlawful for any person to operate under a permit which has been revoked or suspended.
