IMPORTANT NOTICE
State Regulations Require Automatic Roll-out of all
Organic Waste Recycling Programs by January 1st
Diamond Bar Business Owner or Property Manager:
For the past several years we have been notifying you of new State law requiring an organic
waste (including food waste) recycling (Assembly Bill 1826) program at your property. While
this law required you to have a program, the City was allowing voluntary compliance. With
the recent passage of Senate Bill 1383 (SB 1383 in November 2020) regulations, organic waste
recycling services must now be provided to you automatically.
The City is in the process of adopting significant municipal code changes, as dictated by SB
1383. Among these changes are mandatory fines for non-compliance which the City must
issue or the State will fine the City. The State will also fine the City for not providing all required
recycling and organic waste recycling programs. More information on SB 1383 can be found
at the State website listed below:

Valley Vista Services (VVS) is the City’s franchised commercial waste hauler and they have
been directed to deliver containers and start providing required programs on the following
schedule:
• Locations that were required to have AB 1826 compliant programs by January 1, 2017
will have organic waste recycling container delivery starting November 1, 2021.
• All other commercial business and multi-family properties will have organic waste
recycling containers delivered starting November 25th, unless they have applied for
and been granted waiver.
Process to Apply for Waivers from Automatic Service
SB 1383 regulations allow waivers to be granted to locations that dispose of less than 20-
gallons per-week of organic waste. These are referred to as “de minimis” waivers and can
only be granted by the City.
SB 1383 also allows for a limited number of “space constraint” waivers, if a property cannot
physically house a required recycling container. These waivers must also be approved by the
City and require an architect or similar professional, or the franchise hauler to agree with the
property’s space constraint claim.
Finally, the City will grant a waiver if your location has an ongoing third-party organics
recycling program (landscape waste and/or food waste), provided your collector is
approved by City of Diamond Bar and will provide information on the facilities they use to
recycle this material and provide information to the City on the weight or volume of material
they recycle.

Please fill out the applicable form and the City will review your waiver request. Locations that
are granted waivers, as allowed by the State, will be exempt from mandatory service
requirements for a period of 5 years or until the situation qualifying you for a waiver changes.
Those that do not qualify will be notified and must start their required program.
