Waiver Process Guidelines
Notification/Education
All organic waste generators serviced by the non-exclusive franchised haulers will be provided educational material that notes the availability of waivers. This information will be included
in mailers, notices, brochures, and/or the City’s website.
Waiver Applications
Generators may submit an application to the City, either through use of the online wavier application form available on the City’s website or through applications made available to the
franchised hauler. In certain instances, the City may allow the franchised haulers to “nominate” waiver candidates, based upon information they obtain through providing collection service
to these generators.
Waiver Process
The City or its designee will review waiver applications, perform onsite inspections, and make determinations on the applicability of a waiver for each requesting generator. If the waiver
is denied, a document noting the reason for denial will be provided to the generator, along with instructions on how they can obtain a compliant program. If a waiver is approved, an
approval notice will be issued. This notice will establish the expiration date for the waiver and inform the recipient of their responsibility to report any changes in their waste generation
to the City.
The city will maintain a record of all approved waivers in sufficient detail to arrange for periodic inspections. The City will also maintain a record of individual waiver approval notices.
All such records will be housed in the City’s Implementation Record.
For space constrain waivers, the City will incorporate the franchised hauler’s opinion on applicability. However, the City will rely on its own inspection process (or that of its designee)
before approving a space constrain waiver.
At this time the City is not planning on issuing waivers that allow for collection timeframes exceeding one-week between collections.
With regards to waivers for de minimis volumes, the City will use the following guidelines:
Multi-Family Properties – De Minimis Waiver
SB 1383 regulations do not make allowances for participation, so lack of container use is a non-issue with regards to waivers. In determining if de minimis waivers apply, the City of
Diamond Bar estimates volumes of food waste discarded as follows:
There are no per-unit food waste generation estimates available, therefore the City has formulated one using national studies on food waste generation that suggest 242 pounds per-person
per-year (works out to 4.65 pounds per-person per-week). Of this amount we estimate 75% is generated by the person at their residence, with the other 25% generated by meals eaten outside
their home (typically at work or at social and education settings). This reduces per-person generation to 3.49 pounds-per-person. In addition, some residents use their garbage disposals,
dishwashers and other means to handle their food waste. With an estimate of 60% of their food waste is handled in this manner, this results in 2.09 pounds per-person per-week as the
amount we estimate is discarded into refuse bins by each resident.
We estimate an average of 2 person’s per-unit in the City’s multi-family properties, so the per-unit food waste disposal estimate is 4.19 pounds per-unit per-week.
Next, to convert weight to gallons we start with an estimate of 800 pounds of food waste per-cubic-yard (estimates range from 680 to 1,500 lbs.). Thus 4.19 pounds of food waste equates
to 0.0052 cubic yards. Since there are approximately 175 dry-gallons in a cubic-yard, this would equate to 0.92 gallons per-unit per-week.
Therefore, a 21-unit multi-family property would theoretically generate approximately 19.22 gallons of food waste per-week and qualify for a de minimis waiver. Therefore, any property
of 20 units or less is considered eligible for a de minimis waiver. The City will amend this criteria to the extent required by the State.
Traditional Businesses – Non-Food-Related & No Cafeteria
Business food waste generation varies significantly by type. To calculate food waste generation from employee meals and snacks only, for all non-food-related businesses that do not have
a cafeteria, the City uses an estimate of 1% of the volume of trash collected each week. Therefore, a location that has one collection of its 3-cubic-yard bin (175 gallons per-cubic-yard
X 3 = 525) would have approximately 5.25 gallons of food waste disposal per-week. Therefore, the maximum service level of a 3-cubic-yard bin, qualifying for a waiver, would be three
times per-week. A fourth service per-week, for a non-food-related business without a cafeteria, would raise the minimum food waste generation estimate to 21 gallons per week (12-cubic-yard
per-week service level).
This estimate is based on 1 break room waste container for every 10 containers in this theoretical business and 10% of the “volume” of the break room container being attributable to
food waste or food soiled paper.
All locations with less that 12 cubic-yards per-week of franchised trash service are eligible for de minimis waivers. The City will amend this criteria to the extent required by the
State.
