Contamination Monitoring Methods
Selected Method
The City’s two (2) exclusive franchise agreements establish that annual route reviews for prohibited container contaminants occur in a manner that all hauler routes are reviewed annually.
The City requires that containers are randomly inspected and that approximately 3% of the total containers making up that route are part of that route’s annual survey.
If prohibited container contaminants are observed, the hauler will note this observation in writing and with photographic evidence and notify the generator of this violation. All such
notifications will include information on the required separation of materials and be accompanied by educational material sufficient to inform this generator of the required action.
Commencing January 1, 2024, inspections for prohibited container contaminants will consider any container visually presenting 20% or more of its contents as consisting of such contaminants
as being in violation of the City Code and subject to franchise hauler contamination fees and/or City Compliance Action.
At a recurring time period (monthly or quarterly), franchised haulers will provide a summary of all violations encountered on route reviews in comparison to the total containers surveyed.
The hauler will also provide the City with copies of all notices issued, along with a report containing individual generator details sufficient to allow the City to monitor the violation
and ultimately determine whether this violation requires Compliance Action. In addition, the City must be informed of any containers that require disposal due to excessive prohibited
container contaminants and the facility where they were disposed of.
At this time, the City is not planning to use waste evaluations to determine compliance. However, the City may elect to use this method to augment route review data if levels of contamination
reported and/or the frequency/number of contamination fees charged by the franchise hauler is considered excessive.
