Diamond Bar, CA 91765 Dear Deng, Chun Wei: RE: FINAL FINAL NOTICE of Violation at 2831 Steeplechase Ln., Diamond Bar, CA 91765 On May 9, 2022 I visited your property as part of the City's ongoing effort to ensure the continued safety and attractiveness of the community. Conditions that detracted from the appearance of your neighborhood were observed. I visited your property again on March 10, 2023 and observed that the following conditions continued to exist Observations: STOP WORK ORDER ISSUED Construction without proper permits DBMC 15.00.120 Application Filing DBMC 22.44.030 Administration Code DBMC 15.00.120(10) Improper use of property DBMC 22.42 Requested Action(q): Please submit plans to City and obtain planning approval and obtain all building permits: 1. Illegal patio decks and enclosures and structures 2. Illegal Additions below house, Whole house new windows and new slider doors. 3. New Electrical, Plumbing, HVAC, building permits required or Demo Permits. Thank you. The Design -Build Documents shall not be construed to create a contractual relationship of any kind (1) between the Architect and Owner, (2) between the Owner and a Contractor or Subcontractor, or (3) between any persons or entities other than the Owner and Design -Builder, including but not limited to any consultant retained by the Owner to prepare or review the Project Criteria. An enumeration of the Design -Build Documents, other than Modifications, appears in Article 8. § 1.2 The Design -Build Contract represents the entire and integrated agreement between the parties hereto and supersedes prior i:egotiations, representations or agreements, ei�iier written or oral. `s t.3 The Design -Build Contract may be amended or modified only by a Modification. A Modification is (1) a written amendment to the Design -Build Contract signed by both parties, (2) a Change Order, (3) a Construction Change Directive or (4) a written order for a minor change in the Work issued by the Owner. ARTICLE 2 THE WORK OF THE DESIGN -BUILD CONTRACT § 2.1 The Design -Builder shall fially execute the Work described in the Design -Build Documents, except to the extent specifically indicated in the Design -Build Documents to be the responsibility of others Job description provided by the Design -builder as below: •Architectural drifting for the existing house. •Architectural design for the room addition and deliver the elevations. •Str-uctural engineering and calculation. •Electrical engineering and electrical system documents. •Rough Interior design. •Take photos per city requirement. • Blueprints. •HOA approval. •Site visitation during all construction phase PROPOSAL SVBMITTED TO: Chunwei Deng 283(Steeplechase Ln, Diamond Bar, CA 91765 JOB DESCR[PT]ON PROPOSAL &CONTRACT Design -Builder not responsible fees for job description as below: • Existing site survey and environmental& geologic reports(If Any) • Soil Test(If Any) • Landscape architecture Design • The preliminary grading plan • Title24 reports • LEED certification(If Any) • Permits& application fee (shall not provided by contractor) • Deputy Inspection & Title24 Testing • School Fees ( Any Engineering Document other than Structural Engineer ) PAGE 3 OF 4 JUN E 15,2022 PROJECT: DESIGN -BUILD SFP. SERVICES ARTICLE 3 DATE OF COMMENCEMENT AND SUBSTANTIAL COMPLETION § 3.1 The date of commencement of the Work shall be the date of this Agreement unless a different date is stated below or provision is made for the date to be fixed in a notice issued by the Owner. § 3.2 The Contract Time shall be measured from the date of commencement, subject to adjustments of this Contract Time as provided in the Design -Build Documents. The contractor shell not be response to any outside independent professions later than 15 working days once received their document. The owner shell not be response to the contractor later than 15 working days once received request for proceed from the contractor. (Insert pro visions, if any, for liquidated damages relating to fai/ure to comp/ete on time or for bonus payments for ear/y comp/etion of the Work.) § 3.3 The Design -Builder shall achieve Substantial Completion of the Work not later than 15 working days from the date of commencement. ARTICLE 4 CONTRACT SUM § 4.1 The Owner shall pay the Design -Builder the Contract Sum in current funds for the Design -Builder's performance of the Design -Build Contract. Owner could have their choice it the price has 15% difference.
