PL 2010-251 Paae 2 nf fi ' ANALYSIS: Review Authoritv (Diamond Bar Mu�icipal Code (DBMC) Sections 22.47 and 22.56} An addition that is over 301 square feet and less than 50 percent of the existing struc�ture requires a Plot Plan review which is reviewed at the staff level. Changes to an exis�ting nonconforming structure require the approval of a Minor Conditionai Use Permit(MCUP) by the Hearing Officer. Because the MCUP applicat'son requires approval by the Hearing Officer, the Hearing Officer is reviewing the Plot Plan. Approval of an MCUP and a Plot Plan is required to ensure compliance with the City's general plan policies, development standards, and design guidelines to minimize adverse effects of the proposed project upon the surrounding properties and the City in general. Pro�ect Description The applicant requests approval ta construct an addition to an existing single family residence. The new addition consists of a 779 square-foot addition and 650 square-foot patio cover to the rear of the house. Single family residential homes in Low Medium Density Residential (RLM)zones are required to have a side setback of five feet on one side and 10 feet on the other, and a separation of 15 feet from any structure o�n adjorning parcels. The existing building is nonconforming due to an existing side setback of 9-feet, 6-inches from the side property line to the east(10' is required), and the continuation of an existing nonconforming distance to the structure on the adjacent lot to �the east of 14'-6" (15' is required). Minor Conditional Use Permit An MCUP is required because of an exis�ting nonconforming side setback and separation between structures on adjacent parcels. Current development standards require a side setback of 10 feet on one side and 5 feet on the other side and separatian of 15 feet between structures on adjacent parcels. Currently, the side setback is 9'-6" on the east side and 6'-6" on the west side and the separation between structures on adjacent parcels is 14'-6" on the east side and 19'-6" on the west side. The City recognizes that property owners should be allowed to have an addition or make improvements to their properties, even with nonconformities. Therefore,the City has established the MCUP process for such additions, subject to the findings set forth in the Development Code. Staff believes that approving the MCUP as described above is appropriate and compatible with other residences in the neighborhood, based on the following facts and observations: • "fhe existing dwelling was built in 1986, prior to the incorporation of the City of Diamond Bar; a The proposed addition will maintain and not further encroach into the existing nonconforming side setback of 9'-6" on the east side, and the distance between structures on the adjacent parcels is 14'-6" on the east side; and e By maintaining the existing nonconforming setback, the proposed project is consistent with other homes within the neighborhood. Site and Grading Configuration: The site is on a feveled pad and no grading is required. Elevations: The existing architectural style is a 198�'s tract home design with gabfed roofs, half- timber, and vinyl windows. The proposed addition will maintain the existing architectural style of the existing residence and will be consistent with the surrounding arcl-iitecture of the neighborhood. Landscaping: A landscape plan is not required farthe project because the additiori is to the rear of the property and will not have a negative impact on the yard. Compatibilitv with Neiqhborhood The proposed project complies with the goals and objectives as set forth in the adopted General Plan in terms of land use and density. The proposed project will not negatively affect the existing surrounding land uses, and the design and appearance of the proposed addition is compatible with the existing residence and surrounding community. The proposed project is designed to be compatible and complementary to the neighborhood, and incorporates the principfes of the City's Residential Design Guidelines as follows: e The addition will maintain the existing nonconforming side setbacks and distances to structures on adjacent parcels, which are consistent with other homes in the neighborhaod, and will not further encroach into the existing setbacks; MCUP NO. NOTICE OF PUBLIC HEARING: Public hearing notices were mai�ed to property owners within a 500-foot radius of the project site, and the notice was published in the San Gabriel Vallev Tribune and the Inland Vallev Dailv Bulletin newspapers on February 4, 2011. A notice display board was posted at the site, and a copy of the legal notice was posted at the City's three designated community posting sites. ENVIRONMENTAL ASSESSMENT: This project has been reviewed for compliance wi�th the California Environmental Quality Act (CEQA). Based on that assessment, the City has deterrr�ined �the project to be Categoricalfy Exempt from the provisions of CEQA pursuant to the provisions of Article 19 under Section 15301(e)(addition to an existing structure of less than 10,000 square feet)of the CEQA guidelines. No further environmental review is required. RECOMMENDATION: Staff recommends that the Hearing Officer adopt the attached Resolution (Attachment 1) approving Minor Conditional Use Permit and Plot Plan No. PL 2010-251 based on the findings in MCUP NO. Hereinafter in this resolution, the subject Minor Conditional Use Permit and Plot Plan shall collectively be referred to as the "Project." 2. The subject property is made up of one parcel totaling 0.42 acres. It is located in the Low Medium Density Residential (RLM) zone and with the Low Density Residential (RL) land use category of the General Plan. _ 3. The legal description of the subject property is Lot 23 of Tract Ni�imber 37873: The Assessor's Parcel Number is 8717-026-046. 4. On February 4, 2011, notification of the public hearing for this project was published in the San Gabriel Valley Tribune and the Inland Vallev Daily Bulletin newspapers. On February 22, 2011, the Hearing Officer of the City of Diamond Bar conducted a duly noticed public hearing, solicited testimony from all interested individuals, ai�d concluded said hearing on that date. B: RESOLUI"ION NOW, THEREFORE, it is found, determined and resolved by the Hearing Offieer of the City of Diamond Bar as follows: 1. The Hearing Officer hereby specifically finds that all of the facts set forth in the . Recitals, Part A, of this Resolution are true and correct. 2. The project has been reviewed for compliance with the California Environmental Quality Act (CEQA). Based on that assessment, the City has deterrriined the project to be Categorically Exempt according to the provisions of Article 19 Section 15301(e) (additions to an existing structure of less than 10,000 square- feet) of the CEQA Guidelines. FINDINGS OF FACT Based on the findings and conclusions set forth herein and as prescribed under Diamond Bar Municipal Code (DBMC) Section 22.56, this Hearing Officer hereby finds as follows: MINOR CONDITIONAL USE PERMIT 1: The proposed use is allowed within the subject zoning district with the approval of a Minor Conditional Use Permit and corriplies with all other applicable provisions o#this Development Code and the Municipal Code; The existing single-family dwelling is a permitted use in the RLM zone. The exisfing side setback to the east property line of the building and distance between the structures on the adjacent lot to the east renders the project nonconforming. The addition of a nonconforming sfrucfure requires approval of a Minor Conditiona� Use Permit. The proposed 779 square-foot addition complies with the development standards of the RLM zone. 2. The proposed use is consistent with the general plan and any applicable specific plan; _ The pro�aosed addition to a single-family dwelling unit is consistent with the City's' adopted General Plan. The site is not subject to the provisions of any specific plan. 3. The existing and proposed use of land is consistent with the surrounding land uses. The proposed addition of floor area is consistent wifh fhe development standards for the RLM zone. 5. Granting the Minoc Conditional Use Permit will not be detrimental to the public interest; health, safety, convenience or welfare, or materially injurious to persons; property or improvements in the vicinity and zoning district in which the praperty is located; and The granfing of the Minor Conditional Use Permit will allow the addition of the existing single-family dwelling unit in a manner similar with existing dwelling units located in the surrounding neighborhood. The praposed expansion of the dwelling unit will not negatively impact the public interest, health, `safety convenience or welfare. Prior to issuance of any City permits, the proposed projeet is required to comply with aH conditions within the approved resolution, and the Building and Safety Division and Public Works Department. The referenced agencies through the permif and inspection process wi/l ensure that the proposed project is not detrimental to the public health, safety or welfare, and materialfy injurious to the properties or improvements in the vicinity. 6. The proposed project has been reviewed in compliance with the provisions af the California Environmental Quality Act (CEQA): The proposed project is categorically exempt from the provisions of the - California Environmental Quality Act (CEQA) as .set forth under Article 99 Section 15301(e) (addifion to an exrsting structure of less than 10,000 square feef) of the CEQA Guidelines.
