HomeMy WebLinkAbout1441 Blenbury Dr. Code Enforcement notices and citationJune 17, 2021 LEILEI GUAN and or CURRENT TENANTS 1441 Blenbury Dr. Diamond Bar, CA, 91765 C A L I F O R N I A Via Certified and First Class Mail NOTICE OF MUNICIPAL CODE VIOLATION AND ORDER TO CEASE UNLAWFUL SHORT-TERM RENTALS LOCATED AT 1441 Blenbury Dr., DIAMOND BAR CA, 91765 NOTICE IS HEREBY GIVEN that the Director of Community Development has determined that you have committed the following violation of the Diamond Bar Municipal Code ("DBMC") Providing short-term rentals at the property located at 1441 Blenbury Dr., Diamond Bar, CA, 91765 (in violation of DBMC Section 22.08.030). Short-term rentals, such as those listed on Airbnb and similar sites, are prohibited in all residential zones. The Diamond Bar Municipal Code defines any facility "with guest rooms or suites, provided with or without kitchen facilities, rented to the general public" for a time period less than 30 days to be a "hotel or motel." By definition, a residence being rented to a tenant for fewer than 30 days is, therefore, classified as a hotel/motel, and is thus an unlawful use of land. In light of the foregoing, you are hereby ordered to discontinue all efforts to provide short- term rentals in the City of Diamond Bar. This is a very serious matter that requires your immediate attention. All unlawful use of the subject property must cease immediately. Please contact Officer Ramirez, Neighborhood Improvement Officer, at 909-839-7026 by June 29, 2021, regarding the violation. Failure to comply will result in the City seeking appropriate legal remedies to obtain your compliance with the above, and will also seek reimbursement of attorneys' fees to the extent permitted by law. Conditions that detracted from the appearance of your neighborhood were observed. I visited your property again on April 6, 2022 and observed that the following conditions continued to exist: Observations: Landscaping Conditions DBMC 22.34.030(d); Storage of debris, Materials, Trash Cans DBMC 22.34.030(c) Short Term Rental DBMC 22.08.030 Requested Action(s): Please trim and remove overgrown or dead vegetation and weeds, throughout property. Please install approved landscaping (drought tolerant, plants, gravel, artificial turf, etc..) and continue to maintain every two or three weeks or more if needed. Please always debris, materials, trash can behind gate or in garage out of public view. Continue to Cease all unlawful Short -Term Rentals. Thank you...
