To the contrary, this project will benefit those people residing and working in the area. The quality of mobile phone service in the area will be greatly increased by reducing the number of dropped calls and improving reception. Wireless telephones have become common and necessary in the modern urban environment. People use mobile phones to report emergencies, conduct business and to keep in touch with families. Due to the topography of the surrounding area, the immediate vicinity surrounding the proposed site has very poor service. The installation of this site will remedy this situation and ensure that AT&T meets the requirements of its FCC license, to provide quality wireless phone service to all geographic areas. The health, peace, comfort and welfare will thereby be improved by gaining access to improved wireless telephone service. The proposed facility consists of two major elements including the three antenna sectors and the related telephone equipment room. A lease has been negotiated to locate the equipment room within the current shopping center, thereby eliminating the need for an auxiliary equipment shelter to be located where it is visible. The antennas are proposed to be located atop the roof behind screening painted to match the existing building. Such a facility will in no way be detrimental to the use, enjoyment, or valuation of the property in the vicinity. The facility will be fully screened so that the antennas will be unseen by residents and those working or shopping in the area. Finally, the facility will in no way jeopardize, endanger, or otherwise constitute a menace to the public health, safety or general welfare. Wireless telecommunications facilities are a public utility regulated by the Federal Communications Commission (FCC) and the California Public Utility Commission (CPUC). The facilities have been deemed safe to the public by both agencies. As explained previously, the addition of wireless telecommunications to the area will benefit the community by providing state of the art quality service where it is lacking. Such quality wireless service will benefit the community in times of natural disaster when standard utilities are often disrupted while wireless systems often remain in service. The community also benefits in situations where residents or employees in the area report crimes or other emergencies to the police and fire departments. Thtit the proposed site is adequate in size and shape to accommodate the yards, walls, fences, parking and loading facilities, landscaping and other development features prescribed in this Title 22, or as is otherwise required in order to integrate said use with the uses in the surrounding area. The proposed unmanned wireless telecommunications facility is more than adequate in size and shape to accommodate the required development features required by Title 22 and the requirements that the facility be integrated into the area. As described above, the proposed facility will be integrated into the existing environment through locating the antennas on the roof behind screening that completely hides the antennas. Additionally, the related equipment shelter will be located within the building completely out of view of the community, shoppers, and those working in the vicinity. Such a facility will require only periodic maintenance and will therefore not require loading facilities or many features prescribed in the Tile 22 requirements. Once completed, the fully screened facility will be integrated into the existing urban fabric and will likely be unnoticed by most passers by. C. That the proposed site is adequately served by: 1. Since the facility is unmanned, the street and highway system currently in place is more than sufficient for the periodic maintenance personnel to access the facility. In addition, since the project is proposed for an existing developed shopping center, all required utilities are currently in place. Such a facility will require only periodic maintenance and will therefore not require loading facilities or many features prescribed in the Tile 22 requirements. Once completed, the fully screened facility will be integrated into the existing urban fabric and will likely be unnoticed by most passers by. C. That the proposed site is adequately served by: 1. First, a CUP is sought to develop and utilize a portion of the C-3 zoned property with an unmanned freestanding wireless telecommunication facility. Section 22.42.130.G.4 of the Diamond Bar Development Code permits the use and development of this type of facility in the C-3 zone, provided the City's Planning Commission first approves a CUP. Second, the applicant proposes a deviation variance) from Section 22.42,130.H.2.e of the Citv's Development Code reducing the required setback distance for a freestanding antenna structure from a residential zoning district boundary. The proposed monopole would be twenty (20) feet from the nearest residential boundary line. Based on the proposed fifty-five (55) foot high structure, the Code requires a minimum setback distance of sixty-six (66) feet. Conditional Use Permit (development and use of a freestanding wireless telecommunication facility): The CUP is required to determine whether the proposed use should be permitted by weighing the public need for and the benefit to be derived from the use against the impact, which it may cause. Additionally, this discretionary approval process aims to ensure that the proposal is consistent with the City's General Plan land use policies and development standards; provide for quality site design, layout and architecture; and be compatible with any existing structures on -site and/or the neighboring properties. In this way, the quality and economic health of our residential, commercial and industrial districts are maintained. The applicant asserts that the proposed development and use of the facility will be in operation twenty-four (24) hours per day, seven (7) days a week, and will only require routine maintenance. The proposed facility will consist of three (3) sectors of antennas (each containing 4 for a total of 12). They are to be mounted on a fifty-five (55) foot tall freestanding cylinder cell structure camouflaged as a pine tree (commonly referred to as a mono -pine) located in the northwest corner of the shopping center hidden from direct view by the two-story building. Additionally, the accompanying eight (8) foot high electronic equipment cabinet is to be constructed immediately adjacent to the mono -pine. C'iiven the decisive factors for evaluation, there are two prominent issues: aesthetics and potential health effects. Scrutinized documentation on relevant information regarding potential health threats, and regulated design for proposed placement lessens the concerns of these issues. The applicant has submitted information that shows the electromagnetic fields are within the acceptable limits by the Federal Communications Commission (FCC). Also, current literature reveals that a person would have to stand directly in front of the transmitting mechanism to be affected. This is impossible as the transmission mechanism is proposed to be located on the monopole fifty-five (55) feet high above ground level. Aesthetics are a major issue to locating the facilities within our municipality. An over - concentration of the facilities in inappropriate locations without adequate screening methods could prove to undermine the intent of the General Plan, and the implementing ordinances. CUP 2000-09 and Variance Page 4 The plans indicate the mono -pine and equipment cabinet would be located in an existing 420 square foot down sloping landscape planter. However, this would require substantial modifications to the existing retaining wall, and removal of several mature trees. Staff recommends that the mono -pine and equipment cabinet be placed outside of the planter area, at grade. This would allow for no changes to occur to the existing planter or the numerous mature pine trees and other evergreen tree species. The structures, for the most part, would blend into the scenery by the dense tree canopy and be visibly obscured from the street by the two-story building. The proposed mono -pine would be similar in height to the existing trees. If approved, the applicant will lease the needed space from the current property owner to construct and operate the facility. The Subdivision Map Act permits this type of lease arrangement without subdividing the lot. Zone Variance (less than the minimum required setback): The applicant's second request is to allow a structure (55 foot high monopole) to have less than the minimum required setback adjacent to a residential boundary. The monopole would be down slope approximately twenty (20) feet from the adjoining residential boundary parallel to the rear property line. Based on the height of the structure, the Code (Section 22.42.130.H.2.e) requires a minimum setback distance of sixty-six (66) feet. Each commercial zoned property, when considered for development, must maintain minimum front, side and rear yard setback areas. The purpose of these development standards is to provide for open areas around structures where needed for entry; to protect access to natural light, ventilation, and direct sunlight; to separate incompatible land uses; to provide space for privacy and landscaping; to support public safety; and to preserve neighborhood character through complimentary building height designs. Appro•; al of a variance is intended to relieve the property owner from any inability to make reasonable use of their property in the same manner, that other properties of like character in the same vicinity and zone can be used. However, granting of a variance shall not represent a special privilege inconsistent with the limitations upon other properties in the same vicinity and zone. Further, it shall not authorize a use or activity, which is not expressly authorized by the zoning regulations uoverning the parcel of property. While general land use categories can be geographically designated through the General Plan and other applicable land use plans, the requested location of this public utility cellular telephone facility is based on technical locational requirements generally based on terrain and line -of -sight interaction with surrounding existing public utilities. Further indicating that the chosen site would provide the best opportunity for the maximum coverage and efficient operation for the system. Because of the uniqueness of the intended use, staff is of the belief that the deviation, in this case, would not be detrimental to the public health, safety or welfare of the community nor would it compromise the intent of the ordinance. Furthermore, it is staff's opinion that there are reasonable, justifiable and defensible findings for approval of the Variance. CUP 2000-09 and Variance Page 5 The size and shape of this property is atypical among those in the general vicinity with its irregular "T" shaped configuration and slightly sloping topography limiting the usual street frontage, thus requiring the location of improvements to be far removed from the public right- of-way. Strict application of the Code in this instance could prevent the site from being developed with a favorable service, which maximizes the functionality and efficiency of the ever-growing public utility services enjoyed by the community. The granting of the Variance would allow the applicant to construct a reasonable conforming accessory structure (monopole) of sufficient height and setback to allow for effective operation, and would not result in a haphazard layout of land use, nor would it lend a haphazard quality or appearance to the surrounding area. Additionally, the proposed development would not alter the existing established character of the neighborhood, as the mono -pine design would blend into the natural landscape. The resulting deviation from the minimum setback requirement would still provide an aesthetically enhanced street appearance, as the location of the monopole is located to the rear of the site partially screened from view by the building and camouflaged with the existing mature trees. CONCLUSION: Based on the recommended modifications to the proposal, staff believes that the telecommunication facilities are consistent with previously adopted policies of the City, as set forth in the General Plan, to guide the orderly development of the community, to promote the public health, safety, comfort, convenience, and general welfare of the City's residents, to protect property values, and to enhance the aesthetic appearance of the City by maintaining architectural and structural integrity and by protecting views from obtrusive and unsightly accessory uses and facilities. RECOMMENDATION: Staff recommends that the following be performed, in the sequence, as indicated: 1. Planning Commission open the public hearing, receive testimony, close the public hcating; and 2. Approve the Negative Declaration of Environmental Impact; and 3.
