No, work within 500 feet of territories would be prioritized because the longer it takes to finish the more chance there is for it to get shut down if a bird starts nesting. You want
to finish the work within 500 feet first because that’s the most restrictive area(s). Does that make sense?

These are the measures I am going to send to Carol with the email. Please let me know if you have any issues with them. These should be consistent with what she and I discussed and with
the MMRP and with the summary I previously provided to you over voicemail. Note as well that another change order may be needed for the additional biomonitoring, but it'd be easier
to see where things are at in a month. I believe the last one factored in a bunch of full-time days that ultimately ended up being an overestimate so it may be okay, but we'll just
need to check the budget when it gets closer.
. If construction is to occur past February 14, a full-time biological monitor will be required for all work occurring within 500 feet of a known California Gnatcatcher territory,
based on my 2020 survey results and/or any updated territory locations observed during current biological monitoring. Work within 500 feet of known territories will be prioritized to
work outside of 500 feet. Work outside of 500 feet from a known territory will not require a full-time monitor and will proceed with the current weekly check-in schedule for biomonitoring.
. Because the project does not possess an incidental take permit, if the biological monitor detects gnatcatcher breeding activity/nesting within 500 feet of construction, all work
within a 500-foot buffer of the gnatcatcher's territory will be required to cease for the duration of the nesting season, or until authorization is otherwise granted by the USFWS to
proceed again at an earlier date. The USFWS would be notified of any gnatcatcher breeding activity within 24 hours of detection. Work outside of a 500-foot buffer may proceed but consistent
with MMRP Measure BIO-3 if more than 7 days have elapsed since the last time work occurred in that area, a nesting bird survey will be required prior to work re-initiating.
Regarding the final sentence, per the MMRP with all the rain days a nesting bird survey may actually be necessary before Danny comes back this month. We can discuss expected scheduling
tomorrow. Last I checked it's supposed to rain early next week as well.
Please let me know of any modifications or concerns with the two above measures, otherwise I can send to USFWS with your approval. Thanks!

Thanks Ryan, I would agree with the update to Carol as you stated below.
Greg, just a heads up. We recently approved the attached change order for the Canyon Loop Trail. In short, the landscape architect and engineer reviewed the trail after recent rain
events and made additional on-site recommendations to preserve the long-term viability of the trail focused primarily on erosion and run-off. It was quite beneficial to see the trail
immediately after rain and make real time field assessments.
Dan has approved funding from the contingency to authorize these improvements. We felt these items are important to the-natural habitat, FWS, and the community based on a variety of
feedback.
Do you have any input if Ryan Winkleman provides an update to FWS? Please let me know if you'd prefer to have a brief conference call.

Thanks for your call earlier and I apologize for the misunderstanding with the project description on the website. I have included some selected photos of the southern loop of the trail
where nearly all of the work will be conducted, as well as a kmz showing the trail loop and the east and west ends of the widening/improvement along the southern loop. The northern
loop will be largely untouched other than one new bench area where there is already existing disturbance; the northern loop is an SCE access road for some transmission towers alongside
it so the road is already quite wide on the north. On the southern loop there is trail widening along most of the length that I’ve highlighted as well as some isolated occurrences of
gabion wall installations, stair installations, and new benches. The “drainage crossings” referred to on the City website refer simply to diversions to take rainfall off of the trail
during rain events. As you can see from the kmz and if you manipulate your viewpoint in Google Earth, the southern loop is at the top of the slope. There is nothing above it and no
waterways crossing through it; it is completely dry with no possibility of water unless it rains due to its position at the apex of the slope. The only waterway in the project area
is the one down at the bottom of the canyon between the north and south loop trails, which will not be touched and will not have any construction anywhere near it.
