Just as a follow up and to ensure we are on the same page. Today was the 12th approved rain day of the project, which extends the final day of the 60-day construction from January 17,
2023 to February 2, 2023, assuming there is no further rain. I know this weekend may be rain, but please look ahead to potential weekends in which you are interested to work to meet
this deadline and let me know.

Thank you for the email. Please see my notes below related numbers 1, 2,and 3 you reference in your email below.
1, The Notice of Proceed was dated October 17, 2017 and provided to you electronically on October 12, 2017. I have attached a copy as well. Unfortunately, DD Systems failed to meet
the terms of the agreement until October 20, 2022 which included the inability to meet insurance requirements, complete a no-free City permit, and provide the City with a DIR. These
were all delays created by DD Systems. I would suggest you review emails between you and I dated: October 6, 12, 13, and 18, 2022 for additional details. In addition, at the October
5, 2022 Pre-Construction Meeting (agenda attached) you were verbally reminded of these requirements. Although it took DD Systems until October 20, 2022 to meet the requirements of
the agreement, the City will not issue any additional days. October 17, 2022 remains the first day of the 60-day project.
2. Yes, there have been five approved rain dates and the City agrees with the date you provided below. These have been factored into the new end date of January 24, 2022.
3. Per the Cal Trans schedule below, the two holidays for the Thanksgiving Holiday have been incorporated. Please note ALL holidays are accounted for in this schedule:

In summary, the 60-day work schedule began on October 17, 2022 and including the five rain dates and recognized holidays, the completion date is precisely January 24, 2023. Per section
4 of the signed agreement (attached) liquidated damages of $1,000 per day will be included for every day after January 24, 2023. Granted, if there are additional approved rain dates
this may be extended. I hope we can avoid the liquidated damages process, but please be reminded this is a very time sensitive project and the City will follow through with the terms
of the agreement.

GM Ryan,
Reviewing my daily log stumbled upon the following:
1- The City personnel gave me the gate key to enter the site on 10/19/22 at 5:00 PM therefore the actual start date should be 10/20/22.
2- 5 rainy days as you mentioned is correct and they are 11/2; 11/7; 11/8; 12/12 and 12/13.
3- Thanksgiving holiday 2 days 11/24 and 11/25.
With coming holidays and possible rainy days we will end-up with late January 2023 to early February 2023 completion date.
The good news is we are at 90% for all the gabion walls construction.
The steps and V swales are not projected to take long.
