It is 47 inches wide, which is narrower than the intended trail width of 60 inches. This would not result in any new vegetation impacts and would be restricted only to the existing dirt trail, and the contractor would still only be able to have one piece of equipment actively constructing at a time, i.e. if he’s compacting the trail with the roller, the skid-steer and mini excavator would not be in use. Please let me know if USFWS has any objections to the temporary use of the roller, otherwise we will let him know that he can bring it in after the rains to compact the trail and then go back to normal operation again once compaction has been completed. Also, if you would rather not be informed of small changes like this that aren’t increasing the overall impacts of the project, please let me know! I am just making sure that the Service is staying informed so that there aren’t any surprises or misunderstandings. Thanks very much. The contractor has a foot crew and a Bobcat skid-steer loader to assist with the necessary vegetation removal for the trail widening. The contractor is now also requesting to use a mini excavator in order to help smooth bumpier parts of the trail as well for gabion wall construction. The mini excavator is 68" wide, comparable in size to the Bobcat. We had previously specified in my letter to you that only one piece of equipment would be used on the project. He has agreed to, if granted permission, only using one piece of equipment on the trail at a time (either the Bobcat or the mini excavator but not both). Is USFWS okay with this concession and allowing the additional piece of equipment as long as only one is in active use on the trail at any given time? Thank you! The information provided therein included: project description, survey results, and avoidance and minimization measures. Because the work will be done outside the breeding season, will involve very narrow zones of disturbance, and will be distributed across the territories of three coastal California gnatcatcher (Polioptila californica californica; gnatcatcher) territories, we agree that the project is not likely to result in impacts that would warrant an Incidental Take Permit for the gnatcatcher. We appreciate the City's willingness to offset impacts to coast prickly pear scrub at a ratio of 5:1, resulting in a total of 0.250 acres to be mitigated onsite. This will benefit the gnatcatcher and the cactus wren (Campylorhynchus brunneicapillus), which was also identified as using the site. However, as specified in your letter, a total of 0.187 acre of gnatcatcher habitat will be impacted in the course of the planned activities. The Service recommends that this loss be offset at a 2:1 ratio, for a total of 0.374 acres of coastal sage scrub. Because it is clear from the territory mapping that the gnatcatchers are using the coast prickly pear scrub, that 0.250 acres of mitigation can be counted towards the 0.374-acre recommended offset for gnatcatchers. The remaining offset needed to achieve the 2:1 ratio would therefore be 0.124 acres of coastal sage scrub. There appear to be ample opportunities within the context of the site to achieve this goal. Although gnatcatchers are known to be present in the area, it is our belief that the project’s avoidance and minimization strategy and proposed habitat mitigation outweigh the otherwise relatively minimal effects that the project may have on the species, and that the net effects do not rise to the level of the project requiring an Incidental Take Permit to proceed.
