PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by C/Schad. ROLL CALL: Present: Chairman Goldenberg, Vice Chairman Ruzicka, and Commissioners, McManus and Schad Absent: Commissioner Fong Also Present: Community Development Director James DeStefano, Senior Planner Catherine Johnson, and Assistant Planner Ann Lungu. MATTERS FROM THE AUDIENCE/PUBLIC COMMENTS - None CONSENT CALENDAR: 1. Minutes of January 14, 1997. VC/Ruzicka made a motion, seconded by C/Schad, to approve the minutes of January 14, 1997 as presented. Without objections, the motion was so ordered. OLD BUSINESS - None NEW BUSINESS: 1. Wireless Telecommunications Facilities. Responding to the Planning Commission's request, CDD/DeStefano presented a report regarding wireless telecommunications facilities. With the cooperative effort of neighboring cities staffs and telecommunications carriers LA Cellular, Cox California and the Keith Companies, staff compiled the report. CDD/DeStefano explained the three currently utilized wireless telecommunications facilities known as the Cellular Systems, the Personal Communications Services (PCS) digital systems, and Enhanced Specialized Mobile Radio (ESMR) analog digital systems. Transmission signals replicate and amplify voice messages carried from transmitting antennas to receiving antennas. He pointed out the advantages and disadvantages of the systems. Presently, five providers serve the Southern California area: AirTouch, LA Cellular, NexTel, PacBel Mobile Services, and Cox Communications. There are seventeen o, JANUARY 28f 1997 PAGE 2 PLANNING COMMISSION cellular sites in the City of Diamond Bar. Two additional applications are pending approval with the City. He presented a graphic indicating the cellular site locations. Staff believes that a cellular site master plan exists based upon provider's needs. Some sites accommodate several cellular providers. CDD/DeStefano responded to VC/Ruzicka that the City's ridgeline elevation is not appropriate to accommodate the reception and quality of desired service. At this time, it is not anticipated that single family residences will be asked to accommodate these kinds of services. CDD/DeStefano presented background and historical information regarding communications systems monitored by the Federal Communications Commission (FCC). He spoke about neighboring cities ordinances which provide for wireless facilities incorporated within free standing art such as a clock tower. CDD/DeStefano stated Diamond Bar regulates, wireless telecommunications sites through the existing Planning and Zoning Code which allows for use by right in some zones and for use via Conditional Use Permit in other zones. Every zone requires a discretionary review by the Hearing Officer for Administrative Development Review or by the Planning Commission. He talked about the review and approval process with respect to Diamond Bar cellular site installations. Staff determined through general information provided by the telecommunications carriers that property owners who provide cellular site accommodations can expect to receive from $500 to $1200 per month. In addition, many cellular carriers provide additional amenities to the property owner such as property improvements and signage. C/Schad asked if a topographical map indicating line of site installations would prevent interference by proposed construction. He suggested light standards be used for cellular site installations in order to provide income for the City. He also suggested bouncing signals over and around structures. CDD/DeStefano responded that with respect to potential conflicts between property owners and cellular communications carriers, carriers need to locate sites they believe will not be blocked in the future. He stated the City probably would not allow a cellular site facility to dictate potential land use decisions. Chair/Goldenberg recommended tonight's presentation be given to the City Council with emphasis on the permit approval process and developer created master plan. .Y JANUARY 28, 1997 PAGE 3 PLANNING COMMISSION PUBLIC HEARING: 1. Conditional Use Permit 96-10 and Development Review 96-9 (pursuant to Code Section 22.20.100) is a request for an unmanned, wireless telecommunications transmission facilities for two service providers consisting of antennas to be located on a proposed 1,152 square foot barn with equipment cabinets located within and adjacent to the barn. This proposal includes an amendment to Tract Map 42584, removing an easement from said Map restricting vehicle ingress and egress to Armitos Place. Project Address: 24401 Darrin Drive (northwest corner Darrin Drive and Armitos Place) Applicant: Cox California PCS, Inc., 18200 Von Karman Avenue, Suite 100, Irvine, CA 92612 Owner: Eric and Robin Stone, 24401 Darrin Drive, Diamond Bar, CA 91765 CDD/DeStefano presented the staff report. He indicated that in order to provide adequate advertising of this Public Hearing item, staff recommends that the Planning Commission take no action on this item tonight and direct staff to readvertise Conditional Use Permit No. 96-10 and Development Review No. 96-9 when appropriate. VC/Ruzicka moved, C/Schad seconded, to continue Conditional Use Permit No. 96-10 and Development Review No. 96-9. PLANNING COMMISSION ITEMS - None INFORMATIONAL ITEMS: 1. Development Code - Informational Update. CDD/DeStefano presented a status update on the Development Code project. He referred the Commissioners to the Windmill Development Code survey results summary enclosure. The City's General Plan is the basis for the Development Code document which may account for the low percentage of public response. The first Town Hall Meeting is tentatively scheduled for Saturday, March 8, 1997. VC/Ruzicka asked if college students could assist in soliciting community response. C/McManus requested copies of the survey and survey responses. C/Schad reiterated his concerns regarding implementation of the Development Code and more particularly, the Tree Ordinance JANUARY 28, 1997 PAGE 4 PLANNINGCOMMISSION with respect to proposed construction projects such as the SunCal project. CDD/DeStefano stated the Tree Ordinance is scheduled to come before the Planning Commission in February. Staff proposes to agendize the Development Code topics in sections similar to the method used for General Plan discussion. The adoption process will incorporate all sections of the proposed Development Code. With respect to the SunCal project, upon acceptance of the Vesting Tentative Subdivision Map, it vests in the rules, regulations and fees that are in process at the time it is deemed to be complete. This Development Code will not become effective until about January 1, 1998. The SunCal Map has been submitted and deemed complete for purposes of processing and will not be captured by the proposed Development Code. However, the SunCal project will fall under the jurisdiction of the City's General Plan. SCHEDULE OF FUTURE EVENTS: In addition to the posted schedule of future events, Chair/ Goldenberg reminded the Commission about the Thursday, January 30, 1997 Parks and Recreation Commission's Parks Master Plan Public Workshop. Golden Springs Drive, Diamond Bar, CA 91765 Mt. Calvary Lutheran Church 23300 E. Golden Springs Drive, Diamond Bar, CA 91765 The property owner/applicant, Mt. Calvary Lutheran Church and their agent, Mega Signs and Graphics are requesting approval of Planned Sign Program No. 97-1 (pursuant to Sign Ordinance No. 5A (1991), Section 110.D.3. Planned Sign Program). The request is for the existing monument sign's removal and the installation of a new freestanding monument sign. The project site, located at 23300 E. Golden Springs Drive, is approximately 6.95 acres. It is developed with a church and parochial school. It has a General Plan Land Use designation of General Commercial (C). It is within the Limited Multiple Residence (R-3-1U) Zone. Generally, the following zones and use surround the project site: to the north is the Commercial Planned Development (CPD) Zone; to the south is. the Single Family Residence -Minimum Lot Size 8,000 Square Feet (R-1-8,000) Zone; and to the east is Lorbeer Junior High School and the Single Family Residence -Minimum Lot Size 10,000 Square Feet (R-1-10,000) Zone; and to the west is the CPD and R-1-8,000 Zone. FA ANALYSIS: Pursuant to the City's Sign Ordinance, a freestanding monument sign is permitted for civic organizations, institutions and churches when complying with the following development standards: 1. Maximum area is 16 square feet, except that such signs may be 24 square feet in any zone if said sign is located on property with frontage on a public right-of-way in excess of 65 feet in width. Such signs shall be located so as to be viewed from said right-of-way. 2. Maximum height is six feet. 3. Maximum number is one per frontage along a public street. 4. Permitted in all zones. 5. Freestanding monument signs are within the Planned Sign Program category, and require Planning Commission review and approval. The proposed freestanding monument sign is six feet in height and 15 square feet in sign face area. The sign face area will be an illuminated box, with a white background, mounted on a concrete .block pedestal with'a-plaster finish that matches the adjacent retaining wall. The sign face will be constructed from polycarbonate plastic which prevents breaking and resists vandalism. The type face of all text will be Helvetica, with "MT. CALVARY" as the largest of -the text, shadowed to add depth and emphasis. Proposed text colors are red, blue, and black. The logo (a cross) is gray with yellow background. The monument sign's proposed contemporary design is compatible with the church facility's contemporary architectural style. It is harmonious with other signs in the area which are an eclectic collection of sign styles. The proposed monument sign will be located adjacent and perpendicular to Golden Springs Drive, more than 50' from any residential use, out of the public right-of-way and two feet behind the existing concrete swale. However, the Public Works Department recommends that the sign's proposed location be move further back, maintaining a minimum of five feet behind the swale. Additionally, no problems are anticipated regarding clear line -of -sight. The existing monument sign's removal and the proposed monument signIs installation may destroy the existing landscaping. The applicant is ,required to replace the destroyed landscaping with planting materials which match the existing. 2 The Public Works Department and the Building and Safety Division reviewed this project. Their recommendations are. a component of the draft resolution. ENVIRONMENTAL ASSESSMENT: The environmental evaluation shows that the proposed project is categorically exempt pursuant to the guidelines of the California Environmental Quality Act (CEQA), Section 15311 (a). NOTICE OF PUBLIC HEARING: A Planned Sign Program reviewed by the Planning Commission does not require a public hearing. RECOMMENDATIONS: Staff recommends that the Planning Commission approve Planned Sign Program No. 97-1, Findings of Fact and conditions of approval as listed within the attached resolution. REQUIRED CONDITIONAL USE PERMIT FINDINGS: 1. The proposed sign will be legible. to the intended audience under normal viewing conditions, based on its proposed location and design of its visual elements. 2. The proposed sign will not obscure from view or detract from existing signs, based on its location, shape, color and other similar considerations. 3. The proposed sign will be in harmony with adjacent properties and surroundings, based on the size, shape, height, color, placement, and the proximity of such proposed sign to adjacent properties and surroundings. 4. The proposed sign will be designed, constructed and locatedso that it will not constitute a hazard to the public. 5. The proposed sign is not designed to have the advertising thereon maintained primarily to be viewed from a freeway, unless specifically provided for under the terms of this Sign Ordinance. PLANNING COMMISSION „� RESOLUTION NO. 97-XX A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DIAMOND BAR APPROVING PLANNED SIGN PROGRAM NO. 97-1 AND CATEGORICAL EXEMPTION SECTION 15311 (a), A REQUEST TO INSTALL A NEW FREESTANDING MONUMENT SIGN WITH A MAXIMUM HEIGHT OF SIX FEET AND A SIGN FACE AREA OF 15 SQUARE FEET FOR MT. CALVARY LUTHERAN CHURCH LOCATED AT 23300 E. GOLDEN SPRINGS DRIVE, DIAMOND BAR, CALIFORNIA. A: RECITALS. 1. The property owner/applicant, Mt. Calvary Lutheran Church and agent, Mega Signs and Graphics have filed an application for Planned Sign Program No. 97-1, for the installation of a freestanding monument sign located at 23300 E. Golden Springs Drive, Diamond Bar, Los Angeles County, California, as described above in the title of _ this Resolution. Hereinafter in this Resolution, the subject Planned Sign Program shall be referred to as the "Application". 2. On April 18,.1989, the City of Diamond Bar was established as a duly organized municipal corporation of the State of California. Thereafter, the City Council of the City of Diamond Bar adopted its Ordinance No. 14 (1990), thereby adopting the Los Angeles County Code as the ordinances of the City of Diamond Bar. Title 21 and 22 of the Los Angeles County Code contain the Development Code of the County of Los Angeles now currently applicable to development applications, including the subject Application, within the City of Diamond Bar. 3. Action was taken on the subject application as to the consistency with the General Plan. It has been determined that the proposed project is consistent with the General Plan. 4. The Planning Commission of the City of Diamond Bar on February 11, 1997 conducted a meeting on the Application. 5. Pursuant to Sign Ordinance No. 5A (1991), a Planned Sign Program does not require a public hearing or notification of property owners. 7 B. Resolution. NOW, THEREFORE, it is found, determined and resolved by the Planning Commission of the City of Diamond Bar as follows: 1. This Planning Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. The Planning Commission hereby determines that the project identified above in this Resolution is categorically exempt from the requirements of the California Environmental Quality Act (CEQA) of 1970, as amended, and the guidelines promulgated thereunder, pursuant Section 15311 (a) of Article 19 of Chapter 3 of Title 14 the California Code of Regulations. 3. The Planning Commission hereby specifically finds .and determines that, having considered the record as a whole including the findings set forth below, and changes and alterations which have been incorporated into and conditioned upon the proposed project set forth in the application, there is no evidence before this Planning Commission that the project proposed herein will have the potential of an adverse effect on wild life resources or the habitat upon which the wildlife depends. Based upon substantial evidence, this Planning Commission hereby rebuts the presumption of adverse effects contained in Section 753.5 (d) of Title 14 of the California Code of Regulations. 4. Based on the findings and conclusions set forth herein, .this Planning Commission hereby finds as follows: (a) The project relates to a site of approximately 6.95 acres developed with a church and parochial school. The project site is located at 23300 E. Golden Springs Drive, Diamond Bar, California. (b) The project site has a General Plan Land Use designation of General Commercial (C). It is within the Limited Multiple Residence (R-3-lU) Zone. (c) Generally, the following zones and use surround the project site: to the north is the Commercial Planned Development (CPD) Zone; to the south is the Single Family Residence -Minimum Lot Size 8,000 Square Feet (R-1-8,000) Zone; and to the east is Lorbeer Junior High School and the Single Family Residence -Minimum Lot Size 10,000 Square Feet (R-1-10,000) Zone; and to the west is the CPD and R-1-8,000 Zone. (d) The proposed project is a request to install a freestanding monument sign with a maximum height of six (6) feet and a sign face area of 15 square feet. Additionally, the request includes the existing monument sign's removal. ■ (e) The proposed freestanding monument sign is not �� substantial conflict with the adopted General Plan. �° The General Plan requires that a sign concept t� address the following: scale in relationship to the building; landscaping; and readability. It also dictates that the concept ensure integration into the overall site and architectural theme of the site's development. The proposed monument sign will be located adjacent and perpendicular to Golden Springs Drive and out of the public right-of-way. The sign's scale and placement allows for easy readability and a clear line -of -site for traffic traveling along Golden Springs Drive and entering and exiting the site. This issues was reviewed and confirmed by the Public Works Department. The monument sign's contemporary design is compatible with the church facility's contemporary architectural style. (f) The proposed freestanding monument sign will be legible to the intended audience under normal viewing conditions, based on its proposed location and design of its visual elements. The proposed monument sign is located adjacent and perpendicular to Golden Springs Drive. This placement allows for clear identification of the church when traveling northeast or southwest on Golden.. Springs Drive. Additionally, the type face style (Helvetica), arrangement and colors against a white background allow for easy reading. (g) The proposed freestanding monument sign will not obscure from view or detract from existing signs, based on its location, shape, color and other similar considerations. The proposed monument sign will not obscure the view or detract from existing signs because there are no other signs within one hundred feet. Additionally, the size (six feet tall and 15 square feet in sign face area) complies with the Sign Ordinance's minimum standards for a freestanding monument for a church. (h) The proposed freestanding monument sign will be in harmony with adjacent properties and surroundings, based on the size, shape, height, color, placement, and the proximity of such proposed sign to adjacent properties and surroundings. The proposed monument sign and is harmonious with the sign styles in commercial and the City as a whole. is a contemporary design eclectic collection of centers within this area 3 (i) The proposed freestanding monument sign will b designed, constructed and located so that it wil not constitute a hazard to the public. The proposed monument sign was review by the Public Works Department and complies with its clear line - of -site requirements. Additionally, plan check review and permit are required before the signs installation. This, along with the Building and Safety Division's inspections ensures that the proposed monument sign will not be a public hazard. (j) The proposed freestanding monument sign is not designed to have the advertising thereon maintained primarily to be viewed from a freeway, unless specifically provided for under the terms of this Sign ordinance. The proposed monument sign is not adjacent or near a freeway to primarily be viewed from a freeway. It is visible from Golden Springs Drive, Prospectors Road, Sabana Drive and possibly Diamond Bar Boulevard at Golden Springs Drive. Based on the findings and conclusions set forth above, the Planning Commission hereby approves the Application subject to the following conditions: (a) The project shall substantially conform to site plan elevation and written sign criteria collectively labeled as Exhibit "A" dated February 11, 1997, as submitted and approved by the Planning Commission. (b) The site shall be maintained in a condition which is free of debris both during and after the construction, addition, or implementation of the entitlement granted herein. The removal of all trash, debris, and refuse, whether during or. subsequent to construction shall be done only by the property owner, applicant or by a duly permitted waste contractor, who has been authorized by the City to provide collection, transportation, and disposal of solid waste from residential, commercial, construction, and industrial areas within the City. It shall be the applicant's obligation to insure that the waste contractor utilized has obtained permits from the City of Diamond Bar to provide such services. (c) Landscaping and irrigation disturbed or destroyed as a result of the monument sign's installation shall be repair and/or replaced to match the existing landscaping and irrigation. (d) Footing and pedestal shall be engineered and designed for a maximum soil pressure of loo pounds and wind load of 80 miles an hour with an exppoo i of "C" . iP (e) The following information shall be submitted to the Building and Safety Division for review and approval: (1) Location of disconnect switch; (2) Method of the electric sign attachment to the pedestal; and (3) Verification of U.L. approval. (f) The applicant shall comply with Planning and Zoning, and Building and Safety Division's and Public Works Department's requirements. (g) This grant is valid for one year and construction shall commence (i.e. footings) within this one year period or the grant shall expire. (h) This grant shall not be effective for any purpose until the permittee and owner of the property involved (if other than the permittee) have filed, within fifteen (15) days of approval of this grant, at the City of Diamond Bar Community Development Department' their affidavit stating that they are aware of and agree to accept all the conditions of this grant. Further, this grant shall not be effective until the permittee pays remaining City processing fees. (i) If the Department of Fish and Game determines that Fish and Game Code Section 711.4 applies to the approval of this project, then the applicant shall remit to the City, within five days of this grant's approval, a cashier's check of $25.00 for a documentary handling fee in connection with Fish and Game Code requirements. Furthermore, if this project is not exempt from a filing fee imposed because the project has more than a deminimis impact on fish and wildlife, the applicant shall also pay to the Department of Fish and Game any such fee and any fine which the Department determines to be owed. The Planning Commission shall: (a) Certify to the adoption of this Resolution; and (b) Forthwith transmit a certified copy of this Resolution, by certified mail, Mt. Calvary Lutheran Church, 23300 E. It will be perpendicular to Golden Springs Drive to give moving motorist better visual and to help locate the church driveway because the road is curved. Lighting will be standard and will not be visible from residential properties and will not interfere with any traffic or regulatory lighting. The typeface of all text will be Helvetica, with "MT. CALVARY" the largest of all the text and shadows -are added for depth and emphasis. On the left is the Lutheran Cross symbol in maroon color. The colors of the text will be red, blue and black as shown on attached color layout. The light box will be mounted on a concrete block wall pedestal with plaster finish to match the adjacent retaining wall. The -new sign face will be made of polycarbonate - - plastic material to prevent breaking and resist vandalism. The area of the proposed sign is considerably smaller than the existing but will have better and formal aesthetics. The investigation includes all vehicle maneuvers from the two commercial centers (which house Pick-n-Save, Ralph's and others) onto north and southbound Diamond Bar Boulevard. The Department of Public Works contacted Nikko Capital and Pacific West, management companies of Diamond Bar Towne Center (Ralph's) and Diamond Bar Towne Square (Pick-n-Save), respectively. The Property Manager of the Ralph's Commercial center relayed to staff that he has not received concerns related to vehicle maneuvering from businesses and patrons of the center, except once, approximately six months ago. The concern, again, was related to egress from the center. Staff was unable to communicate with the property manager of the Pick-n-Save center. Based on a site investigation, it is staffs opinion that there is a concern with traffic circulation at median break on Diamond Bar Boulevard between Grand Avenue and Clear Creek Canyon Drive. Staff has brought this matter to the attention of Traffic and Transportation Commission in order to determine whether a traffic engineering consultant should be retained in order to study this intersection. Should the Commission concur with staff to retain a consultant to conduct a study, it is recommended that the two management companies contribute financially to said study. RECOMMENDATION• That the Traffic and Transportation Commission discuss the median break on Diamond Bar Boulevard between Grand Avenue and Clear Creek Canyon Drive and provide input to staff as necessary. / =-:\/ CITY OF DIAMOND BAR I ^' INTEROFFICE MEMORANDUM TO: David Liu, Deputy Public Works Director' FROM: James DeStefano, Community SUBJECT: Median break on Diamond Bar Boulevard Grand Avenue and Clear Creek Canyon Drive DATE: December 2, 1996 At the November 25, 1996 Planning Commission meeting, the Commission expressed concern over vehicles utilizing a median break on Diamond Bar Boulevard between Grand Avenue and Clear Creek Canyon Drive. This concern was raised by the Boston Market restaurant proposal. The concern is twofold: 1. Vehicles utilizing the median break to maneuver left turns when exiting Diamond Bar Town Centre (Pic N Save) and Diamond Bar Towne Center (Ralph's); and 2. Vehicles maneuvering across Diamond Bar Boulevard into the shopping centers. The Commission suggested that this matter be reviewed and presented to the Traffic and Transportation Commission if required for mitigation. Additionally, it was suggested that "right turn only" signs be installed at the shopping center exits to Diamond Bar Boulevard.
