Dear Mr. Mazur:
In response to a request from Richard Gould with JCC Homes, Harrington Geotechnical
Engineering, Inc. is presenting this response to the referenced City of Diamond Bar
Memorandum.
The memorandum, a copy of which is attached, contains a comment related to the location
of the house in respect to the restricted use area shown on the plan. It is our understanding
that the restricted use area shown on the 20-scale grading plan (Ref. 3) is the same as the
special foundation zone established during the pre -rough grading design of the shear key
and is based upon a 1:1 projection from the anticipated toe of the shear key. The actual
location of this projection, based upon the as -built location of the shear key, is denoted
foundation setback" on Plate A-2 of the referenced rough grading report. Since this

foundation setback line is based upon as -built information, it is our opinion that it
supersedes the restricted use zone boundary shown on the referenced grading plan.
The location of the actual foundation setback line is between zero and ten feet in from the
top of the descending rear slope. As stated in our December 6, 1994, letter/report (Ref. 2),
the structure is located at least 20 + feet back from the top of this slope and is therefore
outside the limits of the final as -built footing setback area. Thus, the location of the structure
as shown on the grading plan is in conformance with the approved geotechnical report.
