Permittee shall indemnify and hold harmless City (including its officers, employees and agents) from and against all claims, causes of action, liabilities, losses and damages for injuries to persons and property, including reasonable costs of defense and attorney and expert fees, arising from Permittee’s work described in and undertaken under and pursuant to this Permit. Permittee shall promptly pay the amount of any judgment rendered against City (including its officers, employees and agents) for any such indemnified claims, and reasonable costs and attorney and expert fees incurred by City in the defense of such claims. Traffic Control devices shall be installed per Caltrans Traffic Control Manual and W.A.T.C.H Handbook before start of construction. This permit shall expire Ninety (90) days after the date of issuance unless otherwise indicated below. A 30 day extension may be obtained at the discretion of the City Engineer with payment of an extension fee or any other fee that may be required. The City Engineer reserves the right to terminate any permit. Work hours on arterial or collector streets shall be from 8:30am - 4:30pm; for residential streets they shall be from 7:00am - 4:30pm or at the discretion of the PW Director. There shall be no construction on weekends and on City holidays. To the extent any facilities are placed in the City’s right-of-way (ROW) pursuant to this Permit, the owner of such facilities shall, upon notice from the City and at its sole cost and expense, promptly remove, relocate or protect in place such facilities when necessary for any governmental use of the ROW. The City will endeavor to provide a place for such facilities to be relocated within the ROW as long as such relocation does not interfere with the City’s use thereof. A certificate of insurance listing the City of Diamond Bar as additionally insured shall be submitted prior to the start of work. An endorsement listing the City of Diamond Bar, its officers, agents and employees as an additionally insured shall be submitted prior to the start of work. - Contractor shall schedule inspections on pre-specified milestones established by the City inspector at least 48 hours in advance. Stockpiling shall be removed at the end of each work day. - Traffic control per W.A.T.C.H. manual, M.U.T.C.D., or an approved Traffic Control Plan. - All appropriate BMPs for erosion and sediment control shall be in place prior to commencing construction and maintained throughout the duration of the work to protect drainage pathways and inlets from construction debris and pollutants. - Disposal, hauling and recycling of construction and demolition debris shall adhere to the City of Diamond Bar’s Construction and Demolition Requirements. - Failure to promptly correct work deficiencies as identified by the City staff/inspector will be a cause for the City to stop parts or all of the permitted work. - Register or pull a permit from AQMD for portable equipment used at the site. AQMD prohibits the operation of equipment which may either cause or reduce the issuance of air contaminants without first obtaining a written Permit to Operate. (See attached Portable Equipment Registration Program (PERP) flyer) - All underground service alert markings shall be sand blasted for removal to the satisfaction of the City Engineer prior to close of permit. - Replace all damaged landscaping within 48 hrs. of completion of work. If the landscape restoration work is not completed within this time frame, a City contractor will complete the restoration work and the Contractor will be invoiced for the work per MC section 12.04.250 - Coordinate work with property owner and inform property owner how to maintain the new landscaping - Landscape replacement shall match existing and adjacent landscaping - The City shall be notified of construction start date at least one week prior to commencing work - The contractor shall adhere to California dig laws. Call Underground Service Alert at least 2 working days in advance prior to construction. The City will allow chalk based paint for all USA markings. A USA ticket shall be available on site for inspection by the City - Streets that are subject to trench work or potholing shall require Type II Slurry Seal to the satisfaction of the City Engineer - Access to all businesses/residents shall be permitted at all times through driveways. All affected businesses/residents shall be notified of construction at least 48 hours in Advance prior to construction - Post and maintain “No Parking” signs a minimum of 48 hours in advance in areas that need to be accessed for work. - All trenches shall be saw-cut using a vacuum to prevent contaminated water from reaching storm drain system. Saw cutting shall be per City Standard and restoration shall include full-depth backfill with 1-slack slurry, 12” overgrind, and pavement re-construction in accordance with City Standards (see attached) - Temporary steel plates and asphalt shall be maintained at all times. Asphalt shall be compacted flat using mechanical means - All striping and bots dots shall be replaced within 24 hours of the completion of pavement restoration if damaged - Traffic signal loops shall be protected and replaced within 48 hours if damaged - Final pavement restoration along arterial roadways shall be performed within 3 weeks of the completion of work . Final pavement restoration along residential roadways shall be completed within 45 days of the date of permit issuance. If the pavement restoration work is not completed within this time frame, a City contractor will complete the restoration work and the permit applicant will be invoiced for the work per MC section 12.04.250 - Concrete sidewalk construction shall be replaced per the Standard Plans and Specifications for Public Works Construction, Latest Edition. - Sidewalk should be replaced from score line to score line and no patches are allowed - Sidewalk shall be replaced within 2 weeks of completion of work. If the sidewalk restoration work is not completed within this time frame, a City contractor will complete the restoration work and the Contractor will be invoiced for the work per MC section 12.04.250 - Work areas in and around the sidewalk shall be adequately protected by barricades, tape, or other applicable measures to prevent public access into work zones Work initiated before calling for inspection under this permit is subject to removal and reconstruction CALL (909) 839-7040 AT LEAST 24 HOURS BEFORE YOU START WORKING
