Thank you for time and effort in working with us to provide Native American Monitoring at the Canyon Loop Trail project. As we discussed this weekend, the City must terminate the agreement
with PNACRM dated October 13, 2022 in order to comply with the mitigation measure for the project. As I further explained, the mitigation requires that the City use a monitor from
a tribe that requested that a monitor be present. The Kizh Nation had responded to the AB52 notice early in the environmental review process. While you were the first to respond to
our request for a monitor, representatives of the Kizh Nation contacted us late last week to ensure the City's compliance with the mitigation measure.
Per the recent inquiry by the Kizh Nation and our need to maintain mitigation compliance, the City must proceed with monitoring provided by the Kizh Nation. I apologize having to terminate
our agreement prior to the commencement of the project and any work on your part. I am sorry for any impact this may cause.
I truly appreciate all your support and hope we can work together in the future. Thank you for your understanding.
