DIAMOND BAR CITY COUNCIL MEETING RULES
Welcome to the meeting of the Diamond Bar City Council. Meetings are open to the public and
are broadcast on Spectrum Cable Channel 3 and Frontier FiOS television Channel 47. You are
invited to attend and participate. Copies of staff reports or other written documentation relati ng
to agenda items are on file and available for public inspection by contacting the Office of the
City Clerk. If requested, the agenda will be made available in an alternative format to a person
with disability as required by Section 202 of the Americans with Disabilities Act of 1990. If you
have questions regarding an agenda item, please contact the City Clerk at (909) 839-7010
during regular business hours.
PUBLIC INPUT
Members of the public may address the Council on any item of business on the agen da during
the time the item is taken up by the Council. In addition, members of the public may, during the
Public Comment period address the Council on any Consent Calendar item or any matter not on
the agenda and within the Council’s subject matter jurisdiction. Any material to be submitted to
the City Council at the meeting should be submitted through the City Clerk.
Speakers are limited to five minutes per agenda item, unless the Mayor determines otherwise.
The Mayor may adjust this time limit depending on the number of people wishing to speak, the
complexity of the matter, the length of the agenda, the hour and any other relevant
consideration. Speakers may address the Council only once on an agenda item, except during
public hearings, when the applicant/appellant may be afforded a rebuttal.
Public comments must be directed to the City Council. A person who disrupts the orderly
conduct of the meeting after being warned by the Mayor or the Mayor’s designee that their
behavior is disrupting the meeting, may result in the person being removed from the meeting.

SUBJECT TO STATE OPEN MEETING LAWS.

Adopt Resolution No. 2022-60, providing for continued use of
teleconferencing and other formats as defined and in compliance with
Assembly Bill 361 for meetings of the Diamond Bar City Council, City
Commissions and Subcommittees.

TITLE: ELECTION RESULTS OF THE NOVEMBER 8, 2022 GENERAL
MUNICIPAL ELECTION.

RECOMMENDATION:
Adopt Resolution No. 2022-58 declaring the election results of the November 8, 2022
General Municipal Election.
FINANCIAL IMPACT:
None.
BACKGROUND:
The City conducted its General Municipal Election for three (3) City Council vacancies
on November 8, 2022. With the exception of nomination of candidates, all aspects of
the election were administered by the Los Angeles County Registrar-Recorder/County
Clerk on behalf of the City. According to the County Registrar, the semi-official election
results as of November 29, 2022, are shown in Attachment 2 indicating that Steve Tye
was duly elected to a four-year term for District 1, Andrew Chou was duly elected to a
four-year term for District 3, and Chia Yu Teng was duly elected to a four-year term for
District 4. The final Certified election results are expected to be provided at the meeting.
Adoption of the Resolution will ratify the results certified by the Los Angeles County
Registrar-Recorder/County Clerk on the City's behalf. This action will complete the
election process and allow for the newly-elected Council Members to receive the Oath
of Office and begin their four-year term.

RESOLUTION NO. 2022-58
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DIAMOND
BAR, CALIFORNIA, RECITING THE FACT OF THE GENERAL
MUNICIPAL ELECTION HELD ON NOVEMBER 8, 2022 DECLARING
THE RESULT AND SUCH OTHER MATTERS AS PROVIDED BY LAW.
WHEREAS, a General Municipal Election was held and conducted in the City of
Diamond Bar, California, on Tuesday, November 8, 2022, as required by law; and
WHEREAS, notice of the election was given in the time, form and manner as
provided by law; that voting precincts were properly established; that election officers
were appointed and that in all respects the election was held and conducted and the votes
were cast, received and canvassed and the returns made and declared in time, form and
manner as required by the provisions of the Elections Code of the State of California for
the holding of elections in general law cities; and
WHEREAS, the County Election Department canvassed the returns of the election
and has certified the results to this City Council, the results are received, attached and
made a part hereof as “Exhibit A”.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF DIAMOND BAR,
CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS
FOLLOWS:
Section 1. That the whole number of votes cast in the precincts except vote by
mail voter ballots and provisional ballots was ______.
That the whole number of vote by mail voter ballots cast in the City was ______,
the whole number of provisional ballots cast in the City was ______, making a total of
_______ votes cast in the City.
Section 2. That the names of persons voted for at the election for Member of
the City Council are as follows:

Section 3. That the number of votes given at each precinct and the number of
votes given in the City to each of the persons above named for the respective offices for
which the persons were candidates are as listed in Exhibit “A” attached.
Section 4. The City Council does declare and determine that STEVE TYE was
elected as a Member of the City Council – District 1, for the full term of four years;
ANDREW CHOU was elected as a Member of the City Council – District 3, for the full
term of four years; and CHIA YU TENG was elected as a Member of the City Council –
District 4, for the full term of four years.
Section 5. The City Clerk shall enter on the records of the City Council, a
statement of the result of the election showing: (1) The whole number of votes cast in the
City; (2) The names of the persons voted for; (3) For what office each person was voted
for; (4) The number of votes given at each precinct to each person; and (5) The total
number of votes given to each person.
Section 6. That the City Clerk shall immediately make and deliver to each of the
persons so elected a Certificate of Election signed by the City Clerk and authenticated;
that the City Clerk shall also administer to each person elected the Oath of Office
prescribed in the Constitution of the State of California and shall have them subscribe to
it and file it in the office of the City Clerk; and that each and all of the persons so elected
shall then be inducted into the respective office to which they have been elected.
Section 7. That the City Clerk shall certify to the passage and adoption of this
Resolution and enter it into the book of original resolutions.

REPORTS/COUNCIL MEMBER COMMENTS:
C/Liu thanked staff for the presentations, the wonderful salute to Veterans event,
congratulated this evening’s presentation recipients, and looked forward to the
Windmill Lighting and a wonderful Thanksgiving with family and friends.
C/Tye asked if the blight of election signs left standing after elections could be
addressed at a future Council meeting, congratulated participants and winners of
the Through My Lens contest co-sponsored by the Diamond Bar Community
Foundation and City of Diamond Bar, congratulated Restaurant Week prize
winners, hoped to see everyone at the first annual Windmill Lighting, and spoke
about participating in the Contract Cities honoring of LA County Fire Chief Daryl
Osby on his retirement.
C/Lyons congratulated C/Tye and MPT/Chou on their re-elections to the City
Council, attended a luncheon at Maple Hills Elementary with 84 students who
received an award for fundraising abilities, thanked staff for a very moving, terrific
and well-attended Veterans event, and hoped everyone would attend the
Windmill Lighting event and take advantage of local small businesses in
celebration of Small Business Saturday.
MPT/Chou spoke about the LA County Division for League of California Cities
ongoing concerns with the proposed LA land bank pilot program.

installation of new Board Members of the Southern California Chinese-American
Environmental Protection Association at the Diamond Bar Center, and talked
about speaking to members of Boy Scout Troop 777 about their civic duties and
rights. She wished everyone a Happy Thanksgiving and invited all to attend the
first annual Windmill Lighting event on Sunday, December 4th at 5:00 p.m.

BACKGROUND:
On November 15, 2022, the City Council conducted a public hearing and approved for
first reading Ordinance No. 04 (2022) to amend Titles 5 and 22 of the Municipal Code to
clarify the existing prohibition on short-term rentals in residential neighborhoods. There
were no changes made to the draft Ordinance as presented at the meeting. A copy of
the November 15, 2022 staff report is included in Attachment 2 for reference. The City
Council approved the first reading by a 5-0 vote.
Ordinance No. 04 (2022) (Attachment 1) is now being presented for its second reading
by title only and adoption, and will become effective 30 days from December 6, 2022.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DIAMOND
BAR, CALIFORNIA, ADDING SECTION 5.08.050 (SHORT-TERM
RENTALS) OF TITLE 5 AND AMENDING SECTION 22.80.020
(DEFINITIONS OF SPECIALIZED TERMS AND PHRASES) OF TITLE 22
(DEVELOPMENT CODE) OF THE DIAMOND BAR MUNICIPAL CODE
TO CLARIFY THE EXISTING PROHIBITION ON SHORT -TERM
RENTALS IN RESIDENTIAL NEIGHBORHOODS.
WHEREAS , the number of short-term rentals of residential dwelling units has
grown in recent years in the City of Diamond Bar ("City") and in many other communities.
This is largely due to hosting platform websites such as Airbnb and VRBO that can
provide an easy connection between property owners and individuals looking for short-
term rental housing. Many travelers are now using short-term vacation rentals in lieu of
more traditional commercial lodging options such as hotels, motels and bed and breakfast
inns;
WHEREAS, the City has at all times considered short-term rentals as unpermitted
uses within all residential zones and has used its code enforcement powers against
property owners using residential properties in this manner;
WHEREAS , the commercial nature of short-term rentals is incompatible with the
character of residential neighborhoods for reasons which include, but are not limited to
the following: (1) short-term rental properties are subject to ever-changing tenants which
results in surrounding neighbors not becoming familiar with the property's inhabitants,
which detrimentally affects crime prevention efforts, including, but not limited to,
Neighborhood Watch; (2) short-term renters have less motivation to be good neighbors
due to the transient nature of their stay; (3) because short-term renters are typically on
vacation, loud parties are more frequent and more frequently occur during the middle of
the week, negatively impacting the quiet use and enjoyment of nearby neighbors of their
own properties; (4) short-term rentals are more likely to be occupied by several families
and/or large numbers of adults which results in additional vehicle trips and parking
demand; and (5) it has been the City's experience that short-term rentals place
inordinately larger demands on police services primarily due to noise complaints
associated with loud parties;
WHEREAS, short-term rentals have been primarily located in the City's single-
family neighborhoods, the characteristics of which include: (1) owner-occupied homes
consisting of a single family which typically will remain in the home for a number of years;
(2) long-term tenants with similar characteristics as the owner-occupied home; (3)
neighbors who develop friendships which can last years or even a lifetime and who share
life experiences over the span of years; and (4) neighbors who watch over each other's
properties and have some familiarity with who may or may not belong on the property.
Occupants of short-term rentals do not share these single-family residential
characteristics;

WHEREAS, in adopting the proposed amendments, the City seeks to clarify the
existing condition (i.e., that short-term rentals are not a permitted use in residential zones)
to, in part, ensure that potential purchasers of residential properties in the City have no
reasonable expectation in making their purchasing decision that the residential property
can be put to such a use;
WHEREAS, in adopting the proposed amendments, short-term rentals, home
sharing, and the advertisement thereof, does not amend the General Plan but is consistent
with all provisions of the General Plan to protect neighborhoods from nuisances and other
adverse effects resulting from improper operation of short-term rentals and home sharing;
and
WHEREAS, the City has established goals and policies to address the
development, maintenance and improvement of the housing stock to provide adequate
housing in the city, both in quality and quantity, and to provide appropriate shelter for all
without discrimination. If homes are utilized for transient occupancy, they are no longer part
of our housing stock. Prohibiting home sharing is also a way to preserve affordable housing
opportunities as rooms and secondary units can be used for permanent housing rather than
transient stays. A reduction in permanent housing units can put an upward pressure on
rental prices and negatively affect housing affordability. Prohibiting short-term rental and
home sharing is consistent with the following General Plan and Housing Element goals and
policies:
Land Use and Economic Development
• Goal LU-G-6: Preserve existing residential neighborhoods to retain the
qualities Diamond Bar residents love, such as easy access to preserved natural open
spaces, while supporting and encouraging well-designed, complete neighborhoods with
safe streets, access to shopping and services, and community parks and gathering places.
• Goal LU-G-7: Promote a variety of housing and neighborhood types that
respond to a range of income, household sizes, and accessibility levels.
• Goal LU-G-18: Encourage a diversity of housing types and products.
Housing Element
• Goal H-G-1: Preserve and conserve the existing housing stock and maintain
property values and residents' quality of life.
• Policy H-P-1.3: Promote increased awareness among property owners and
residents of the importance of property maintenance to long-term housing quality.
WHEREAS, on October 25, 2022, the Planning Commission held a duly noticed
public hearing regarding proposed amendments to the Municipal Code, and adopted
Resolution No. 2022-19 recommending City Council approval of said Municipal Code
amendments; and

WHEREAS, on November 15, 2022, the City Council held a duly noticed public
hearing regarding the proposed Municipal Code Amendment.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DIAMOND BAR
DOES HEREBY ORDAIN AS FOLLOWS:
Section 1. Subsection (s) of Section 22.80.020 (Definitions of specialized terms
and phrases) of Title 22, Chapter 22.80 of the Diamond Bar Municipal Code is amended
as follows to add the definitions of “short-term occupancy” and “short-term rental,” as
follows (deletions in strikethrough text and additions shown in double underline):
(s) Definitions, “S.” The following definitions are in alphabetical order:

Short-Term Occupancy. The use or possession, or right to use or possess, of any
portion of a dwelling unit, room or rooms offered for remuneration for dwelling, lodging or
sleeping purposes for a period of less than 30 days. Short-term occupancy is prohibited
in all residential zoning districts.
Short-Term Rental. The use of any dwelling unit, or any portion thereof, for short-
term occupancy. Short-term rentals are prohibited in all zoning districts.

Section 2. A new Section 5.08.050 (Short-term rentals) of Title 5, Chapter 5.08
of the Diamond Bar Municipal Code is added as follows (deletions in strikethrough text
and additions shown in double underline):
Section 5.08.050. – Short-term rentals
(a) Short-term occupancy and short-term rental shall have the same meanings as
provided in Title 22, Development Code.
(b) It is a violation of this Code for an owner or lessee of property or any agent
thereof, to rent a dwelling unit or any portion thereof, for short-term occupancy or as a
short-term rental as such terms are defined in Subsection (s) of Section 22.080.020.
(c) It is a violation of this Code for an owner or lessee of property or any agent
thereof, to place or permit to be placed, any printed or lettered announcement, whether
in a magazine, newspaper, handbill, notice, display, billboard, poster, email, Internet
website or application, or any other form of advertisement for a short-term occupancy or
short-term rental in a zoning district in which such uses are not permitted.
(d) Violation of this Section shall constitute a misdemeanor as set forth pursuant
to Section 1.04.010.
Section 3. The adoption of this Ordinance is not a project within the meaning of

the California Environmental Quality Act ("CEQA") pursuant to Title 14, California Code
of Regulations, Section 15061(b)(3), in that it can be seen with certainty that there is no
possibility that the Ordinance may have a significant effect on the environment because
the Ordinance will not cause either a direct physical change in the environment, or a
reasonably foreseeable indirect physical change in the environment, in that it simply
clarifies existing conditions, which are that short-term occupancies and short-term rentals
are not a permitted use in the City's residential zoning districts. In addition, it is
categorically exempt pursuant to Title 14, California Code of Regulations, Section 15305
as a minor alteration in land use limitations in that it will not result in any changes in land
use or density for the reasons set forth above.
Section 4. Severability. If any section, clause, phrase, word or portion of this
Ordinance is, for any reason, held to be invalid or unconstitutional by the decision of any
court of competent jurisdiction, such decision shall not affect the validity of the remaining
portions of this Ordinance. The City Council hereby declares that it would have adopted
this Ordinance and each other section, clause, phrase, word or portion thereof,
irrespective of the fact that any one or more sections, subsections, subdivisions,
sentences, clauses, phrases, words or portions thereof be declared invalid or
unconstitutional.
Section 5. The City Clerk shall attest and certify to the passage and adoption of
this Ordinance within 15 days after adoption, cause it to be published or posted in
accordance with California law, and it shall be effective 30 days after adoption pursuant
to Government Code Section 36937.

and schedule the second reading and adoption at the next regularly scheduled City
Council meeting.
FINANCIAL IMPACT:

BACKGROUND:
Short-term rentals, such as those marketed through Airbnb and similar platforms, are
prohibited in Diamond Bar. However, these unlawful businesses continue to proliferate.
Because it is currently difficult to preempt the establishment of short-term rentals, and
nearly as difficult to prosecute violators, the City Council directed staff to identify
potential solutions that would better enable the staff to eradicate short-term rentals, and
thus reduce the nuisance they impose on neighborhoods.
The attached ordinance addresses the City Council’s direction by proposing the
following amendments to the Diamond Bar Municipal Code (DBMC):

1. Adding definitions for “short-term occupancy” and “short-term rentals” to clarify the
existing prohibition of such uses in residential neighborhoods.
2. Prohibiting the advertising of short-term rentals, as well as their operation.
The proposed ordinance amends both Title 5 (Business Licensing) and Title 22
(Development Code) of the DBMC.
ANALYSIS:
Residential short-term rentals—such as those listed on Airbnb, VRBO and similar
sites—have become increasingly popular in recent years. These websites provide a
platform for homeowners to operate an online marketplace for the rental of their
residential properties for temporary lodging. Many travelers are now using short-term
rentals in lieu of more traditional commercial lodging options such as hotels, motels and
bed and breakfast inns. Consequently, many communities, including Diamond Bar, are
experiencing the impacts of these uses in their residential neighborhoods, including, but
not limited to, excessive noise, lack of parking, safety concerns, accumulation of trash
and deferred property maintenance. If homes are utilized for transient occupancy, they
are no longer part of our housing stock. A reduction in permanent housing units can put
an upward pressure on rental prices and negatively affect housing affordability. In
addition, when short-term rentals replace traditional commercial lodging, these illegal
businesses put a strain on the City’s fiscal health because they do not pay transient
occupancy tax, even though they place an added burden on public services.
Short-term rentals have always been prohibited in all residential zones within Diamond
Bar. The Municipal Code defines hotels and motels as “facilities with guest rooms or
suites, provided with or without kitchen facilities, rented to the general public for
transient lodging (for) less than 30 days.” By definition, then, a residence being rented
out for fewer than 30 days is classified as a hotel/motel, and is thus not a permissible
use in residential zones. However, a recent search of all short-term rental booking
platforms revealed that 83 homes in Diamond Bar are currently being advertised as
available for temporary lodging. Although the City has been enforcing the prohibition of
short-term rentals to varying degrees of success, staff typically must rely on
circumstantial evidence to bring forth enforcement action against these illegal
businesses.
Adoption Process
Before the City Council may adopt an ordinance that includes amendments to the
Development Code, the Planning Commission must first conduct a public hearing to
consider the proposed amendments. The Commission then forwards its
recommendations via resolution to the Council.
Planning Commission Review
On October 25, 2022, after conducting a duly noticed public hearing, the Planning
Commission adopted Resolution No. 2022-19, recommending, by a 3-0 vote

(Commissioner Garg and Commissioner Rawlings absent), that the City Council adopt
the attached ordinance amending Titles 5 and 22 (Attachment 1). The staff report and
draft meeting minutes from that meeting are included as Attachments 3 and 4
respectively.
No public comments were received prior to or during the Planning Commission hearing.
Proposed Amendments to Title 22 (Development Code)
Section 22.80.020. (Definitions of specialized terms and phrases) – The terms
“short-term occupancy” and “short-term rental” are introduced for clarification purposes,
and to expressly state that short-term rentals are prohibited in all zoning districts. With
the addition of these narrowly-defined terms, it will no longer be necessary to rely
entirely on the definition of “hotel/motel” to assert that short-term rentals are illegal in
Diamond Bar. The new definitions are proposed to read as follows:
• Short-Term Occupancy. The use or possession, or right to use or possess, of
any portion of a dwelling unit, room or rooms offered for remuneration for
dwelling, lodging or sleeping purposes for a period of less than 30 days.
Short-term occupancy is prohibited in all residential zoning districts.
• Short-Term Rental. The use of any dwelling unit, or any portion thereof, for
short-term occupancy. Short-term rentals are prohibited in all zoning districts.
Proposed Amendments to Title 5 (Business Licensing)
Section 5.08.050. (Short-term rentals) – This new section expressly states that it is
not only a violation of the law to operate a short-term rental in Diamond Bar, but it is
also illegal to advertise short-term rentals. Prohibiting the advertising of short-term
rentals will serve as a powerful enforcement tool for the City: while it may be difficult to
prove that a short-term rental is actually being rented out, it will be very easy to provide
evidence that it is being advertised on any of various listing platforms, and the City will
be able to prosecute on that basis alone. The new code section should also serve as a
powerful deterrent by placing would-be violators on notice that the mere act of
advertising a short-term rental is a misdemeanor offense, punishable by a fine of up to
$1,000 and/or imprisonment for each offense. Pursuant to Municipal Code Section
1.04.010, each day that a violation is committed shall count as a separate offense.
ENVIRONMENTAL REVIEW:
The City has determined that the proposed Municipal Code Amendment is not subject
to the California Environmental Quality Act (“CEQA”) pursuant to Title 14, California
Code of Regulations, Section 15061(b)(3), in that it can be seen with certainty that there
is no possibility that the Ordinance may have a significant effect on the environment
because the Ordinance will not cause either a direct physical change in the
environment, or a reasonably foreseeable indirect physical change in the environment,
in that it simply clarifies existing conditions, which are that short-term occupancies and
short-term rentals are not a permitted use in the City's residential zoning districts. In
addition, it is categorically exempt pursuant to Title 14, California Code of Regulations,

BAR, CALIFORNIA, ADDING SECTION 5.08.050 (SHORT-TERM

TO CLARIFY THE EXISTING PROHIBITION ON SHORT -TERM
RENTALS IN RESIDENTIAL NEIGHBORHOODS.
WHEREAS , the number of short-term rentals of residential dwelling units has
grown in recent years in the City of Diamond Bar ("City") and in many other communities.
This is largely due to hosting platform websites such as Airbnb and VRBO that can
provide an easy connection between property owners and individuals looking for short-
term rental housing. Many travelers are now using short-term vacation rentals in lieu of
more traditional commercial lodging options such as hotels, motels and bed and breakfast
inns;
WHEREAS, the City has at all times considered short-term rentals as unpermitted
uses within all residential zones and has used its code enforcement powers against
property owners using residential properties in this manner;
WHEREAS , the commercial nature of short-term rentals is incompatible with the
character of residential neighborhoods for reasons which include, but are not limited to
the following: (1) short-term rental properties are subject to ever-changing tenants which
results in surrounding neighbors not becoming familiar with the property's inhabitants,
which detrimentally affects crime prevention efforts, including, but not limited to,
Neighborhood Watch; (2) short-term renters have less motivation to be good neighbors
due to the transient nature of their stay; (3) because short-term renters are typically on
vacation, loud parties are more frequent and more frequently occur during the middle of
the week, negatively impacting the quiet use and enjoyment of nearby neighbors of their
own properties; (4) short-term rentals are more likely to be occupied by several families
and/or large numbers of adults which results in additional vehicle trips and parking
demand; and (5) it has been the City's experience that short-term rentals place
inordinately larger demands on police services primarily due to noise complaints
associated with loud parties;
WHEREAS, short-term rentals have been primarily located in the City's single-
family neighborhoods, the characteristics of which include: (1) owner-occupied homes
consisting of a single family which typically will remain in the home for a number of years;
(2) long-term tenants with similar characteristics as the owner-occupied home; (3)
neighbors who develop friendships which can last years or even a lifetime and who share
life experiences over the span of years; and (4) neighbors who watch over each other's
properties and have some familiarity with who may or may not belong on the property.
Occupants of short-term rentals do not share these single-family residential
characteristics;

WHEREAS, in adopting the proposed amendments, the City seeks to clarify the
existing condition (i.e., that short-term rentals are not a permitted use in residential zones)
to, in part, ensure that potential purchasers of residential properties in the City have no
reasonable expectation in making their purchasing decision that the residential property
can be put to such a use;
WHEREAS, in adopting the proposed amendments, short-term rentals, home
sharing, and the advertisement thereof, does not amend the General Plan but is consistent
with all provisions of the General Plan to protect neighborhoods from nuisances and other
adverse effects resulting from improper operation of short-term rentals and home sharing;
and
WHEREAS, the City has established goals and policies to address the
development, maintenance and improvement of the housing stock to provide adequate
housing in the city, both in quality and quantity, and to provide appropriate shelter for all
without discrimination. If homes are utilized for transient occupancy, they are no longer part
of our housing stock. Prohibiting home sharing is also a way to preserve affordable housing
opportunities as rooms and secondary units can be used for permanent housing rather than
transient stays. A reduction in permanent housing units can put an upward pressure on
rental prices and negatively affect housing affordability. Prohibiting short-term rental and
home sharing is consistent with the following General Plan and Housing Element goals and
policies:
Land Use and Economic Development
• Goal LU-G-6: Preserve existing residential neighborhoods to retain the
qualities Diamond Bar residents love, such as easy access to preserved natural open
spaces, while supporting and encouraging well-designed, complete neighborhoods with
safe streets, access to shopping and services, and community parks and gathering places.
• Goal LU-G-7: Promote a variety of housing and neighborhood types that
respond to a range of income, household sizes, and accessibility levels.
• Goal LU-G-18: Encourage a diversity of housing types and products.
Housing Element
• Goal H-G-1: Preserve and conserve the existing housing stock and maintain
property values and residents' quality of life.
• Policy H-P-1.3: Promote increased awareness among property owners and
residents of the importance of property maintenance to long-term housing quality.
WHEREAS, on October 25, 2022, the Planning Commission held a duly noticed
public hearing regarding proposed amendments to the Municipal Code, and adopted
Resolution No. 2022-19 recommending City Council approval of said Municipal Code
amendments; and

WHEREAS, on November 15, 2022, the City Council held a duly noticed public
hearing regarding the proposed Municipal Code Amendment.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DIAMOND BAR
DOES HEREBY ORDAIN AS FOLLOWS:
Section 1. Subsection (s) of Section 22.80.020 (Definitions of specialized terms
and phrases) of Title 22, Chapter 22.80 of the Diamond Bar Municipal Code is amended
as follows to add the definitions of “short-term occupancy” and “short-term rental,” as
follows (deletions in strikethrough text and additions shown in double underline):
(s) Definitions, “S.” The following definitions are in alphabetical order:

Short-Term Occupancy. The use or possession, or right to use or possess, of any
portion of a dwelling unit, room or rooms offered for remuneration for dwelling, lodging or
sleeping purposes for a period of less than 30 days. Short-term occupancy is prohibited
in all residential zoning districts.
Short-Term Rental. The use of any dwelling unit, or any portion thereof, for short-
term occupancy. Short-term rentals are prohibited in all zoning districts.

Section 2. A new Section 5.08.050 (Short-term rentals) of Title 5, Chapter 5.08
of the Diamond Bar Municipal Code is added as follows (deletions in strikethrough text
and additions shown in double underline):
Section 5.08.050. – Short-term rentals
(a) Short-term occupancy and short-term rental shall have the same meanings as
provided in Title 22, Development Code.
(b) It is a violation of this Code for an owner or lessee of property or any agent
thereof, to rent a dwelling unit or any portion thereof, for short-term occupancy or as a
short-term rental as such terms are defined in Subsection (s) of Section 22.080.020.
(c) It is a violation of this Code for an owner or lessee of property or any agent
thereof, to place or permit to be placed, any printed or lettered announcement, whether
in a magazine, newspaper, handbill, notice, display, billboard, poster, email, Internet
website or application, or any other form of advertisement for a short-term occupancy or
short-term rental in a zoning district in which such uses are not permitted.
(d) Violation of this Section shall constitute a misdemeanor as set forth pursuant
to Section 1.04.010.
Section 3. The adoption of this Ordinance is not a project within the meaning of

sentences, clauses, phrases, words or portions thereof be declared invalid or
unconstitutional.
Section 5. The City Clerk shall attest and certify to the passage and adoption of
this Ordinance within 15 days after adoption, cause it to be published or posted in
accordance with California law, and it shall be effective 30 days after adoption pursuant
to Government Code Section 36937.

SUMMARY:
Short-term rentals, such as those marketed through Airbnb and similar platforms, are
prohibited in Diamond Bar. However, these unlawful businesses continue to proliferate .
Because it is currently difficult to prevent the establishment of short-term rentals, and
nearly as difficult to prosecute violators, the City Council directed staff to identify
potential solutions that would better enable the staff to eradicate short-term rentals, and
thus reduce the nuisance they impose on neighborhoods.
The attached ordinance addresses the City Council’s direction by proposing the
following amendments to the Diamond Bar Municipal Code (DBMC):
1. Adding definitions for “short-term occupancy” and “short-term rentals” to clarify the
existing prohibition of such uses in residential neighborhoods.

2. Prohibiting the advertising of short-term rentals, as well as their operation.
The proposed ordinance amends both Title 5 (Business Licensing) and Title 22
(Development Code) of the DBMC. Although amendments to Title 5 are not subject to
Planning Commission review, amendments to Title 22 are, so the entire ordinance is
being presented for the Commission’s consideration and recommendation to the City
Council.
BACKGROUND:
Residential short-term rentals—such as those listed on Airbnb, VRBO and similar
sites—have become increasingly popular in recent years. These websites provide a
platform for homeowners to operate an online marketplace for lodging, primarily
homestays for vacation rentals, and tourism activities. Many travelers are now using
short-term rentals in lieu of more traditional commercial lodging options such as hotels,
motels and bed and breakfast inns. Consequently, many communities, including
Diamond Bar, are experiencing the impacts of these uses in their residential
neighborhoods, including, but not limited to, excessive noise, lack of parking, safety
concerns, accumulation of trash and deferred property maintenance. If homes are
utilized for transient occupancy, they are no longer part of our housing stock. A
reduction in permanent housing units can put an upward pressure on rental prices a nd
negatively affect housing affordability. In addition, when short-term rentals replace
traditional commercial lodging, these illegal businesses put a strain on the City’s fiscal
health because they do not pay transient occupancy tax, even though they place an
added burden on public services.
Short-term rentals have always been prohibited in all residential zones within Diamond
Bar. The Municipal Code defines hotels and motels as “facilities with guest rooms or
suites, provided with or without kitchen facilities, rented to the general public for
transient lodging (less than 30 days).” By definition, a residence being rented to a
tenant for fewer than 30 days, therefore, classified as a hotel/motel, and is not a
permissible use in residential zones pursua nt to the City’s land use table. Although the
City has been enforcing the prohibition of short-term rentals to varying degrees of
success, staff typically must rely on circumstantial evidence to bring forth allegations
that these illegal businesses are in operation.
ANALYSIS:
Adoption Process
Before the City Council adopts an ordinance to amend the Municipal Code, the Planning

As noted earlier, the proposed ordinance amends both Title 5 (Business Licensing) and
Title 22 (Development Code) of the DBMC. Although amendments to Title 5 are not
subject to Planning Commission review, amendments to Title 22 are, so, as a practical
matter, the entire ordinance is being presented for the Commission’s consideration and
recommendation to the City Council.
Proposed Amendments to Title 22 (Development Code)
Section 22.80.020. (Definitions of specialized terms and phrases) – The terms
“short-term occupancy” and “short-term rental” are introduced for clarification purposes,
and to expressly state that short-term rentals are prohibited in all zoning districts. With
the addition of these narrowly-defined terms, it will no longer be longer necessary to rely
entirely on the definition of “hotel/motel” to assert that short-term rentals are illegal in
Diamond Bar. The new definitions are proposed to read as follows:
• Short-Term Occupancy. The use or possession, or right to use or possess, of
any portion of a dwelling unit, room or rooms offered for remuneration for
dwelling, lodging or sleeping purposes for a period of less than 30 days. Short -
term occupancy is prohibited in all residential zoning districts.
• Short-Term Rental. The use of any dwelling unit, or any portion thereof, for
short-term occupancy. Short-term rentals are prohibited in all zoning districts.
Proposed Amendments to Title 5 (Business Licensing)
Section 5.08.050. (Short-term rentals) – This new section expressly states that it is
not only a violation of the law to operate a short-term rental in Diamond Bar, but it is
also illegal to advertise short-term rentals. Prohibiting the advertising of short-term
rentals will serve as a powerful enforcement tool for the City : while it may be difficult to
prove that a short-term rental is being rented out, it will be very easy to provide
evidence that it is being advertised on any of various listing platforms, and the City will
be able to prosecute on that basis alone. The new code section should also serve as a
powerful deterrent by placing would-be violators on notice that the mere act of
advertising a short-term rental is a misdemeanor offense.
ENVIRONMENTAL REVIEW:
The City has determined that the proposed Municipal Code Amendment is not subject
to the California Environmental Quality Act (“CEQA”) pursuant to Title 14, California
Code of Regulations, Section 15061(b)(3), in that it can be seen with certainty that there
is no possibility that the Ordinance may have a significant effect on the environment
because the Ordinance will not cause either a direct physical change in the
environment, or a reasonably foreseeable indirect physical change in the environment,
in that it simply clarifies existing conditions, which are that short -term occupancies and
short-term rentals are not a permitted use in the City's residential zoning districts. In
addition, it is categorically exempt pursuant to Title 14, California Code of Regulations,

Section 15305 as a minor alteration in land use limitations in that it will not result in any
changes in land use or density for the reasons set forth above.
NOTICE OF PUBLIC HEARING:
Notice for this hearing was published in the San Gabriel Valley Tribune newspaper on
October 14, 2022, in a 1/8-page display. Pursuant to Planning and Zoning Law
Government Code Section 65091(a)(4), if the number of property owners to whom a
public hearing notice would be mailed is greater than 1,000, a local agency may provide
notice by placing a display advertisement of at least 1/8 page in one newspaper of
general circulation. A copy of the public notice was also posted at the City’s designated
community posting sites.

TITLE: CONSIDERATION TO EXTEND A LOCAL EMERGENCY REGARDING
NOVEL CORONAVIRUS (COVID-19).
STRATEGIC

RECOMMENDATION:
Adopt Resolution No. 2022-59 extending the Declared Local Emergency regarding
Novel Coronavirus (COVID-19).
FINANCIAL IMPACT:
The continuation of the declared local emergency is necessary to ensure access to
reimbursement for related costs in response to COVID-19. The City has submitted a
Request for Public Assistance with California Office of Emergency Services (CalOES) to
seek reimbursement for all eligible COVID-19 related expenses.
BACKGROUND:
The rapid global spread of Novel Coronavirus (COVID-19) has resulted in
unprecedented actions by Federal, State, County and local agencies, as well as private
individuals and businesses, to help combat the community spread of the virus. While
significant improvements in public health and vaccinations have decreased case counts
and the positivity rate, it is necessary to continue the declaration to ensure eligibility for
current and future funding.
On March 4, 2020, the Los Angeles County Board of Supervisors declared a State of
Emergency and the Los Angeles County Public Health Officials declared a Local Health
Emergency. Since that time, numerous actions have been, and continue to be taken, at
the Federal, State and County levels to implement far reaching measures that include
Stay at Home Orders, prohibit gatherings of any size, require closure of a wide range of
businesses, schools, colleges, public facilities, cancellation of large community and
sporting events, and other limitations all aimed at slowing the community spread of the

virus.
At the time the City Council declared a local emergency on March 19, 2020, LA County
Public Health Officials reported (as of March 18, 2020) 190 confirmed cases (including 2
in Diamond Bar), with one death in the County. As of November 24, 2022, there were
3,530,105 confirmed cases and 34,156 deaths reported in Los Angeles County
(including 12,488 cases and 121 deaths in Diamond Bar). Updated numbers will be
provided for the Resolution at the meeting.
On January 25, 2021, Governor Newsom canceled the Regional Stay Home Order that
tied restrictions to available ICU capacity state-wide. On June 15, 2021, Governor
Newsom retired the Blueprint for a Safer Economy Program and eliminated the need for
social distancing or capacity limits on businesses and other activities, with a few
exceptions. While conditions improved in early 2021, since the June 15 reopening
COVID-19 case counts and hospitalizations increased especially for unvaccinated
persons. In October 2022, it was announced the Governor would end the current stat e
of emergency on February 23, 202 3. This advance notice was provided to ensure the
health care system has the needed flexibility to handle any surge after the holidays in
early 2023, and focus on public health outreach efforts aimed at increasing
vaccination and booster rates.
The Council is being asked to continue the Local State of Emergency (Attachment 1)
regarding the COVID-19 pandemic until the state of emergency is lifted, and was last
adopted by Council in October as is required every 60 days during the local emergency.
The City Manager, as the Emergency Services Director for the City, also intends to
continue the activation of the Emergency Operations Center at the lowest level (Level
3) to be able to provide enhanced communications with LA County Emergency
Operations Center and its public safety partners .
ANALYSIS:
The City has taken extraordinary actions and precautions to help protect residents,
businesses and our workforce from community spread of COVID-19. The City
transitioned to online service delivery and recreation programming to better serve the
public, and has expanded service delivery options to include telephone, video, and in-
person appointments.
City Operations:
• City facilities welcomed back the public for in-person services Monday through
Friday during regular operating hours. This is in addition to the continued
availability of telephone, video calls and on-line appointment-based services
offered at City Hall such as building, planning, public works/engineering, as well
as transit passes, Diamond Ride identifications, and environmental services. In
early January 2022, City Hall and Diamond Bar Center limited operating hours to
appointment only services due to increasing COVID case counts as a result of
the Omicron variant. Full services have since been restored.

• City playgrounds, skate park, ball fields, tennis/pickleball courts,
Basketball/volleyball courts, picnic shelters, trails, and dog park are operating
following Public Health guidance.
• City Staff continue to work both in-person and remotely in order to better serve
the public through the variety of in-person, telephone, and video appointment
options.
• Hybrid in-person/teleconferencing City Council and Commission meetings are
currently being held.
• Street sweeping parking enforcement resumed in January 2021.
Recreation & Special Events Update:
• Recreation programs are being expanded, with programming following current
County Public Health guidance. Updated information is on the City website.
• Community in-person special events returned with Concerts in the Park during
summer 2021 and have continued throughout 2022. The goal is to continue other
planned events now that public health guidance is being modified to allow for
more flexible in-person programming, with adjustments based on current County
Public Health Guidance.
• Field allocations for youth sports organizations are following City policies and in
accordance with LA County Public Health.
• Senior programming activities are being expanded following Public Health
Guidance.
Adjustments to City Hall and the Diamond Bar Center operations were initiated which
include:
• City Hall operating hours include appointment services, in-person drop-in
services, as well as expanded on-line service offerings.
• Diamond Bar Center operating hours will be adjusted as needed for
programming and rentals.
• Staff will continue to work hybrid work schedules, which include in-person and
remote work when possible.
• Per the latest County Health Order, indoor mask wearing is optional but could
change depending upon future trends.
The City will continue to monitor conditions, especially transmission rates and
hospitalizations leading up to the tentative end of the state of emergency on February
23, 2023. There remains a possibility that additional unpredictable variants in the future

may require integrated public health measures. The City continues to encourage all
residents and children that are eligible to get vaccinated and boosted to help keep the
community spread of COVID-19 in check, including those under five now eligible to be
vaccinated. Additional information is available on the County Public Health and City

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DIAMOND
BAR, CALIFORNIA, PROCLAIMING EXISTENCE OF A LOCAL
EMERGENCY REGARDING NOVEL CORONAVIRUS (COVID-19)
WHEREAS, the Emergency Services Act (Government Code sections 8550 et
seq.), and in particular California Government Code sections 8630, et seq. thereof, and
Chapter 8.00 of Title 8 of the Diamond Bar Municipal Code, provide that the City Council
may proclaim the existence of a local emergency when the City of Diamond Bar is affected
or likely to be affected by public calamity; and
WHEREAS, the City Council has been requested by the City Manager as the
Director of Emergency Services to proclaim the existence of a local emergency in the City
of Diamond Bar; and
WHEREAS, COVID-19 has spread globally to over 192 countries, infecting more
than 616,292,698 persons and killing nearly 6,540,301 individuals worldwide. As of
November 24, 2022 there were nearly 98,582,109 cases in the United States with more
than 1,107,894 deaths, including 3,530,105 cases and 34,156 deaths in Los Angeles
County (12,488 cases and 121 deaths in Diamond Bar) related to COVID-19. Due to the
expanding list of countries with widespread transmission of COVID-19, increasing travel
alerts and warnings for countries experiencing sustained or uncontrolled community
transmission issued by the Centers for Disease Control and Prevention (“CDC”), the
significant number of cases and deaths from COVID-19 still occurring in the United
States, California, and Los Angeles County, COVID-19 has created conditions that are
likely to be beyond the control of local resources and require the combined forces of other
political subdivisions to combat; and
WHEREAS, on February 26, 2020, the CDC confirmed the first possible case of
community transmission of COVID-19 in the United States. On March 4, 2020, the Health
Officer of Los Angeles County determined that there is an imminent and proximate threat
to the public health from the introduction of COVID-19 in Los Angeles County and
declared a Local Health Emergency and the Los Angeles County Board of Supervisors
concurrently proclaimed the existence of a local emergency for the County of Los
Angeles; and
WHEREAS, on March 4, 2020, Governor Newsom of the State of California
declared a State of Emergency in response to the COVID-19 (Corona Virus Disease 19);
and
WHEREAS, on March 11, 2020 the World Health Organization (WHO) publicly
characterized COVID-19 as a global pandemic; and
WHEREAS, on March 12, 2020 Governor Newsom of the State of California issued
Executive Order N-25-20 in a further effort to confront and contain COVID-19 that among

other things, required residents of California to follow orders and guidance of local public
health officials, including following social distancing requirements and suspended certain
provision of the Ralph M. Brown Act providing local agencies with greater flexibility to hold
meetings via teleconferencing; and
WHEREAS, on March 13, 2020, the President of the United States declared a
National Emergency due to the continue spread and the effects of COVID-19; and
WHEREAS, on March 19, 2020, Governor Newsom issued Executive Order N-33-
20 mandating that residents stay at home while carving out exceptions for workers in
specified federal critical infrastructure sectors; and
WHEREAS, the State of California and numerous other public and private
organizations have announced the cancellation or postponement of all events where
social distancing cannot be reasonably achieved; and
WHEREAS, the City's ability to mobilize local resources, coordinate interagency
response, accelerate procurement of vital supplies, use mutual aid, and seek future
reimbursement by the State and Federal governments will be critical to successfully
responding to COVID-19; and
WHEREAS, the Diamond Bar City Council adopted Resolution 2020-04 on March
19, 2020, proclaiming the existence of a local emergency in response to the COVID-19
public health emergency; and
WHEREAS, on June 15, 2021, the Governor retired the Blueprint for a Safer
Economy, phasing out the majority of executive actions put in place since March 2020,
including elimination of social distancing requirements and occupancy limitation, with a
few exceptions, but leaving in place many other executive orders and declaration of
emergency; and
WHEREAS, the Diamond Bar City Council subsequently adopted Resolution Nos.
2020-12, 2020-22, 2020-38, 2020-41, 2021-01, 2021-06, 2021-14, 2021-32, 2021-47,
2021-56, 2022-07, 2022-15, 2022-35, 2022-46, and 2022-51 extending the local
emergency due to the continued existence of a local emergency; and
WHEREAS, the Diamond Bar City Council must review the local emergency at
least once every 60 days to determine the need for continuing the local emergency until
its termination by the Diamond Bar City Council.
NOW, THEREFORE, IT IS HEREBY PROCLAIMED that as authorized by
Government Code section 8630 and Diamond Bar Municipal Code section 8.00.050, the
City Council proclaims that as defined in Government Code section 8558 and Section
8.00.020 of the Diamond Bar Municipal Code, a “local emergency” continues to exist
throughout the City of Diamond Bar, which proclamation is based on the following findings
by the City Council:

1. That the above recitals are true and correct and based thereon, hereby finds
that the spread and potential further spread of COVID-19 constitutes a
situation that severely impairs the public health and safety, and constitutes
conditions of extreme peril to the safety of persons and property within the

2. That these conditions are likely to be beyond the control of the services,
personnel, equipment, and facilities of the City of Diamond Bar; and
3. That the conditions of extreme peril warrant and necessitate the extension of
the proclamation of the existence of a local emergency.
IT IS HEREBY FURTHER PROCLAIMED AND ORDERED that during the
threatened existence and actual existence of the local emergency, the powers, functions
and duties of the Director of Emergency Services and the emergency organization of the
City shall be those prescribed by state law, by ordinances and resolutions of the City and
approved by the City Council.
IT IS FURTHER PROCLAIMED AND ORDERED to ensure that City vendors are
paid in a timely manner, the City Manager and the City Treasurer or their designees are
authorized and directed to approve the claims and demands, make payments thereon,
and finally to bring those claims and demands to the City Council at future meetings for
ratification of the payments made.
IT IS FURTHER PROCLAIMED AND ORDERED in accordance with Assembly
Bill 361, it is the present intent of the City Council to conduct hybrid council meetings in
which the City Council, staff and the public can either attend in person or via
teleconferencing and other electronic means to afford council members, staff and
members of the public the ability to implement recommended social distancing and
otherwise provide for their own safety, while still proceeding with the efficient handling of
the City’s business, while providing opportunities for public participation.
IT IS FURTHER PROCLAIMED AND ORDERED that a copy of this proclamation
be forwarded to the Director of California Governor’s Office of Emergency Services
requesting that the Director find it acceptable in accordance with State law that the
Governor of California, pursuant to the Emergency Services Act, issue a proclamation
declaring an emergency in the City of Diamond Bar; that the Governor waive regulations
that may hinder response and recovery efforts; that response and recovery assistance be
made available under the California Disaster Assistance Act and the Stafford Act; and
that the State expedite access to State and Federal resources and any other appropriate
federal disaster relief programs.
IT IS FURTHER PROCLAIMED AND ORDERED that the proclamation of a local
emergency shall be reviewed at least once every 60 days until its termination is
proclaimed by the City Council of the City of Diamond Bar, State of California.

BACKGROUND/ANALYSIS:
Due to the continued impact of the COVID-19 pandemic, the California Legislature
passed AB 361, which authorizes a local agency to use teleconferencing without
complying with certain teleconferencing requirements imposed by the Brown Act when:
(1) the legislative body of a local agency holds a meeting during a declared state of
emergency; (2) when state or local health officials have imposed or recommended
measures to promote social distancing; and/or (3) when a local agency has determined
that meeting in person would present imminent risks to the health or safety of
attendees.
The City Council first utilized the provisions of AB 361 on November 16, 2021. In order
to continue to have the ability to use the modified teleconferencing options, AB 361
requires that the City Council re-affirm its findings every 30 days. Conditions under
which AB 361 may be utilized continue to exist as described in the attached Resolution
(Attachment 1).

The City Council is currently going beyond what the Brown Act requires by holding
meetings in person and by way of teleconference and allowing the public to participate

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DIAMOND
BAR, CALIFORNIA, MAKING SPECIFIED FINDINGS RELATING TO THE
USE OF TELECONFERENCING IN ACCORDANCE WITH ASSEMBLY
BILL 361 FOR MEETINGS OF THE DIAMOND BAR CITY COUNCIL AND
OTHER CITY COMMISSIONS AND COMMITTEES SUBJECT TO STATE
OPEN MEETING LAWS.
WHEREAS, on March 4, 2020, California Governor Newsom declared a State of
Emergency in response to the COVID-19 pandemic; and
WHEREAS, on March 12, 2020, to address the impacts of COVID-19, Governor
Newsom issued Executive Orders that required, among other things, residents of
California to follow orders and guidance of local public health officials, including social
distancing and masking requirements; and
WHEREAS, existing California law, the Ralph M. Brown Act (“Brown Act”) requires,
with specified exceptions, that all meetings of a legislative body of a local agency, as
those terms are defined, be open and public, that a physical location for such meetings
be provided, and that the public be permitted to provide public comment during the
meetings; and
WHEREAS, the Brown Act permits members of legislative bodies to
teleconference into public meetings subject to certain conditions, including that the place
from which the member teleconferences be open to the public, that an agenda be posted
on the site, and that the teleconference location be noticed in the agenda; and
WHEREAS, in recognition that such public gatherings at such meetings could
accelerate the spread of COVID-19, Governor Newsom’s Executive Orders suspended,
among others, these Brown Act teleconferencing requirements to provide local agencies
with greater flexibility to hold meetings via teleconferencing safely; and
WHEREAS, pursuant to the Emergency Services Act (Government Code sections
8550 et seq.), and Chapter 8.00 of Title 8 of the Diamond Bar Municipal Code, the City
Council of the City of Diamond Bar has proclaimed the continued existence of a local
emergency resulting from the COVID-19 pandemic; and
WHEREAS, as of September 30, 2021, the Governor’s Executive Order
suspending the Brown Act’s teleconferencing requirements expired; and
WHEREAS, on September 16, 2021, Governor Newsom signed Assembly Bill 361,
which authorizes a local agency to continue to use teleconferencing without complying
with certain teleconferencing requirements imposed by the Brown Act when: (1) the
legislative body of a local agency holds a meeting during a declared state of emergency;
(2) when state or local health officials have imposed or recommended measures to

promote social distancing; and/or (3) when a local agency has determined that meeting
in person would present imminent risks to the health or safety of attendees; and
WHEREAS, both Los Angeles County and state health officials continue to
recommend social distancing due community spread of COVID-19; and
WHEREAS, The Diamond Bar City Council first utilized the provisions authorized
by AB 361 on November 16, 2021 and subsequently adopted Resolution Nos. 2021-54,
2021-55, 2022-01, 2022-06, 2022-12, 2022-14, 2022-19, 2022-23, 2022-28, 2022-34,
2022-42, 2022-45, 2022-47, 2022-48, 2022-54 and 2022-55 re-affirming its continued
use; and
WHEREAS, the Diamond Bar City Council must approve a Resolution reaffirming
that the requirements set forth in Assembly Bill 361 exist every 30 days in order to allow
members of its legislative bodies to utilize the provisions of Assembly Bill 361 when
attending public meetings via teleconferencing; and
WHEREAS, notwithstanding that the City’s legislative bodies, as defined by the
Brown Act, are now holding modified public meetings in person, there may be situations
in which a member of one of these legislative bodies decides not to attend in person due
to a particular health or safety risk posed by such attendance and as such, it is the City
Council’s desire to permit members of its legislative bodies to attend by way of
teleconference pursuant to Assembly Bill 361 due to health and safety concerns
associated with COVID-19.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City
of Diamond Bar as follows:
1. That the above recitals are true and correct. and based thereon, that the
spread and potential further spread of COVID-19 continues to pose an
imminent risk to the public health and safety.
2. That a state of emergency due to the COVID-19 pandemic continues to exist
and at the time that this Resolution was adopted both Los Angeles County
and State health officials are recommending social distancing to slow the
spread of COVID-19.
3. That meeting in person may pose an imminent risk to the health and safety
of some attendees, including members of the City’s legislative bodies, who
due to age, health conditions, or vaccination status, have a higher risk of
contracting COVID-19 and are more likely to get severely ill and in some
cases, die from COVID-19.
4. That during the effective period of this Resolution and any reaffirmation
thereof, members of the legislative bodies of the City of Diamond Bar may

participate in meetings subject to the Brown Act by way of teleconference in
accordance with Assembly Bill 361.
5. That meetings shall be held in accordance with AB 361 by, among other
things, providing notice to the public how it can access the meeting and
provide public comment, providing an opportunity for the public to attend via
a call-in or an internet-based service option, conducting the meeting in a
manner which protects the statutory and constitutional rights of the public,
and stopping the meeting until public access is restored in the event of a
service disruption.
IT IS FURTHER RESOLVED that this Resolution is effective for 30 days from its
adoption date and must be affirmed/acknowledged every 30 days by the City Council of
the City of Diamond Bar in order for the provisions of Assembly Bill 361 to continue to
apply to teleconferencing by members of the legislative bodies of the City of Diamond
Bar.

Should the City Council concur, it is recommended that the Mayor, at the end of the
December 20, 2022 City Council Meeting, adjourn said Council meeting to January 17,
2023.

Approve, and authorize the Mayor to sign, the First Amendment to Agreement with
Woodruff, Spradlin & Smart for City Attorney Services designating Omar Sandoval as
City Attorney.
FINANCIAL IMPACT:
None.
BACKGROUND/ANALYSIS:
On April 2, 2013, the City Council selected the law firm of Woodruff, Spradlin & Smart
(WS&S) to provide legal services to the City of Diamond Bar following an extensive
competitive search process. As part of that Agreement, the City Council selected David
DeBerry to serve as City Attorney, and Omar Sandoval and James Eggart to serve as
Assistant City Attorneys. WS&S, and each of these attorneys in their respective roles,
have continuously served the City of Diamond Bar well since approval of the Agreement
in 2013.
City Attorney David DeBerry has indicated his desire to change his status with WS&S to
less than full time and has submitted his resignation as City Attorney to the City of
Diamond Bar effective December 31, 2022. It is therefore necessary for the City
Council to appoint a new City Attorney.
The appointment of the City Attorney is at the full discretion of the City Council. The
proposed Amendment to the WS&S Agreement will appoint Omar Sandoval to serve as
the City Attorney and David DeBerry to serve as Assistant City Attorney effective

December 31, 2022. All other provisions of the Original Agreement will remain
unchanged. The City will continue to have access to the full compliment of legal
services offered by the law firm of WS&S.
Mr. Sandoval has been with WS&S since 2005 and has over 28 years of experience
advising city councils, city commissions, and special districts on governmental and
regulatory activities and procedures. He is also currently serving as City Attorney to the
City of Garden Grove. He has experience with the Brown Act, Political Reform Act,
Public Records Act, Government Tort Claims Act, Public Contracts Code, adoption of
local regulations, code enforcement, Uniform Building Codes, ADA, land use, property
maintenance, solid waste, water, sewage, municipal franchises and
telecommunications.
As previously mentioned, Mr. Sandoval has served the City of Diamond Bar as
Assistant City Attorney since April 2013. Over the years, Mr. Sandoval has served as
acting City Attorney at serval Council meetings. He is familiar with City operations,
policies and regulations. He most recently provided valuable assistance in
implementing the State’s organic recycling mandates, including preparation of the
ordinance implementing SB 1383 and the amendment to the Waste Management
Agreement. He was also directly involved in the process to transition to district-based
elections.

FIRST AMENDMENT
TO
AGREEMENT FOR CITY ATTORNEY SERVICES
(Woodruff, Spradlin & Smart)
This First Amendment to Agreement for City Attorney Services (“First Amendment”) is
made and entered into as of this 6th day of December, 2022, by and between the City of
Diamond Bar, a California municipal corporation (hereinafter “CITY”), and the law firm of
WOODRUFF, SPRADLIN & SMART, a Professional Corporation (hereinafter “WS&S”).
RECITALS
A. The CITY and WS&S entered into that certain Agreement for City Attorney
Services dated as of April 2, 2013, which is incorporated herein by this reference (the
“Original Agreement”);
B. As part of that Original Agreement, the City Council, pursuant to its authority
under Government Code section 36505, appointed David DeBerry, an attorney with WS&S,
to act as the City Attorney for the CITY;
C. David DeBerry has indicated his intent to resign from his role as City Attorney
to CITY effective December 31, 2022; and
D. The City Council now desires, pursuant to its authority under Government Code
section 36505, to appoint Omar Sandoval, an attorney with WS&S, to act as the City Attorney
for the CITY.
NOW, THEREFORE, in consideration of the mutual promises and covenants
contained herein, the parties agree as follows:
AGREEMENT
1. Retention of WS&S. This First Amendment revises Section 1 of the Original
Agreement to read as follows:
“City hereby retains and employs WS&S to provide all legal services incident to city
attorney representation for the City Council and CITY. In this regard, effective December 31,
2022, Omar Sandoval is designated as the City Attorney for the CITY. The City Attorney shall
serve as the chief legal advisor to the City Council. Effective December 31, 2022, David
DeBerry and James H. Eggart are designated as Assistant City Attorneys for the CITY. With
written consent of the City Manager, Mr. Sandoval is authorized to assign other attorneys of
the law firm who may serve as Assistant and Deputy City Attorneys, or as otherwise
authorized by the City Council. The City Council may at any time request that WS&S assign

a different attorney in the law firm to act as City, Assistant or Deputy City Attorney.”
2. Integration. This First Amendment amends, as set forth herein, the Original
Agreement and except as specifically amended hereby, the Original Agreement shall remain
in full force and effect. To the extent that there is any conflict or inconsistency between the
terms and provisions of this First Amendment and the terms and provisions of the Original
Agreement, the terms and provisions of this First Amendment shall control.
IN WITNESS WHEREOF, the parties hereto have executed this First Amendment as
of the date first above written and represent that they are authorized to bind their respective
parties.

purchase of four (4) HPE Servers in the amount of $84,536.58.
FINANCIAL IMPACT:
Sufficient funds for this purchase are included in the FY 2022-23 Adopted Budget from
the Equipment Maintenance and Replacement Fund (Fund 503), the Special Revenue
Prop A fund (Fund 206) and the Special Revenue Prop C fund (Fund 207).
BACKGROUND:
The daily operations of the City rely on the use of computers, specialized networks, and
associated hardware and software to create, process, and store digital information and
communicate with the public. To ensure the City’s essential information systems
infrastructure remains in place, it is proposed that four (4) servers be replaced. Each
server has outlived its useful life and has been scheduled for replacement.
DISCUSSION:
As required by the purchasing ordinance, the City solicited bids through the Planet Bids
website for four new HP servers as well as a five-year warranty plan for each. Six

DECEMBER 7, 2021
Consistent with COVID-19 regulations, members of the public were encouraged to
participate and address the Authority during the public comment portion of the meeting
via teleconference. Authority Members and limited staff were physically present for the
meeting. Due to distancing requirements, public seating was very limited on a first-
come, first-serve basis.

NOVEMBER 1, 2021 THROUGH OCTOBER 31, 2022.

RECOMMENDATION:
Approve the Annual Public Financing Authority Treasurer's Statement.
FINANCIAL IMPACT:
None.
BACKGROUND:
In 2002, the City of Diamond Bar (City), through the Public Financing Authority
(Authority), issued Variable Rate Lease Revenue Bonds in the principal amount of
$13,755,000 for the purpose of building the Diamond Bar Center. In December 2011,
the City, through the Authority, refinanced and converted the outstanding principal
amount of $11,790,000 to Fixed Rate Lease Revenue Bonds. On June 9, 2021, the
City, through the Authority, refunded the outstanding principal of $7,839,851 on the
2011 Bonds and issued new Lease Revenue Refunding Bonds, 2021 Series A, with a
principal amount of $6,735,000. The interest rate paid to the bondholders is 4% during
the life of the 2021 Bonds through June 1, 2033. As of October 31, 2022, the
outstanding principal amount of the 2021 Bonds was $6,280,000.
The Authority bank account which reflects the principal and interest payment activities is
included in this Treasurer’s Statement. Although the Authority’s Fund has been
incorporated into the City’s monthly Treasurer’s Statement, a separate Treasurer’s
Statement has been prepared for review and approval by the Authority. This statement
shows the cash and equivalent balance with the fiscal agent (US Bank).
