Hi Ryan,
Thank you for the pre-construction survey. I am currently reviewing the resumes. Due to our staffing and my workload, I will not be able to complete my review of all biologists until
early next week. I will reach out if I have any concerns.
Best,

Hello Julisa,
I just wanted to check on the status of the biological monitor approvals for this project, as well as to forward you a copy of the pre-construction survey report. The only sensitive
species observed on-site during the pre-construction survey were California Gnatcatcher and Cooper’s Hawk, both of which are known to occur on-site and were addressed during the CEQA
process already. Submittal of this report is for additional fulfillment of the requirements of BIO-4 in the project’s MMRP.
Construction is still planned to begin next week. Please let me know if you have any questions about the survey results or about the proposed monitors. I believe we may have one or two
additional resumes to forward to you, which I’ll do when I receive them.
Thank you!

Hello Julisa,
I was referred to you by my coworker Anisha Malik who said you have taken over as the designated CDFW biologist for the Canyon Loop Improvement Project in Diamond Bar. The project is
gearing up to start construction potentially at the beginning of next week. Under Measure BIO-4 of our MMRP, a CDFW-approved biological monitor is required during vegetation removal
and grubbing. I am submitting resumes of proposed and/or potential monitoring staff for your approval, as well as my own as I will have an oversight role as well. Final staffing will
be dependent on availability.
Please let me know if you have any questions, I look forward to your response.
Thank you!

Subject: Canyon Loop Trail Improvement Project CAGN
Hello Carol,
As we have previously discussed and met about, please find attached a memo for you to evaluate the potential impacts on California Gnatcatchers from the Canyon Loop Trail Improvement
Project in the City of Diamond Bar. Although gnatcatchers are known to be present in the area, it is our belief that the project’s avoidance and minimization strategy and proposed habitat
mitigation outweigh the otherwise relatively minimal effects that the project may have on the species, and that the net effects do not rise to the level of the project requiring an
Incidental Take Permit to proceed.
If you have any questions or want to meet with me again, please don’t hesitate to let me know.
Otherwise we look forward to your response. Thank you!

Ryan,
Please accept my apologies for the delay in responding to your request We have reviewed the City of Diamond Bar's proposal as presented in your July 22, 2022, letter. The information
provided therein included: project description, survey results, and avoidance and minimization measures. Because the work will be done outside the breeding season, will involve very
narrow zones of disturbance, and will be distributed across the territories of three coastal California gnatcatcher (Polioptila californica californica; gnatcatcher) territories, we
agree that the project is not likely to result in impacts that would warrant an Incidental Take Permit for the gnatcatcher.
We appreciate the City's willingness to offset impacts to coast prickly pear scrub at a ratio of 5:1, resulting in a total of 0.250 acres to be mitigated onsite. This will benefit the
gnatcatcher and the cactus wren (Campylorhynchus brunneicapillus), which was also identified as using the site. However, as specified in your letter, a total of 0.187 acre of gnatcatcher
habitat will be impacted in the course of the planned activities. The Service recommends that this loss be offset at a 2:1 ratio, for a total of 0.374 acres of coastal sage scrub. Because
it is clear from the territory mapping that the gnatcatchers are using the coast prickly pear scrub, that 0.250 acres of mitigation can be counted towards the 0.374-acre recommended
offset for gnatcatchers. The remaining offset needed to achieve the 2:1 ratio would therefore be 0.124 acres of coastal sage scrub. There appear to be ample opportunities within the
context of the site to achieve this goal. We would be happy to coordinate with you on appropriate plants to use for this purpose.
Please feel free to contact me if you have any questions. Thank you for the opportunity to provide input on the project.
Sincerely,
-Carol (she, her, hers)
