Hi Fabian,
I’m sorry, you called right around the same time as somebody else and I didn’t see your voicemail. I just listened to it. I’m about to leave to pick up my son from school but I can call
you in about an hour or so.

Subject: RE: EXTERNAL: BMPs/Erosion Control Canyon Loop trail Improvement Project
Ryan,
At the start of the project, some BMPs were installed. These consisted mostly of a gravel bed at the trail entrance (maintenance easement which is being used for project access), to
prevent tracking soil onto the street and into the storm drain system. Additionally, the contractor placed drip pans beneath stationary equipment to contain drips/fluid loss.
Regarding erosion, most if not all of the erosion noted along the trail would have taken place anyway with or without the project. Historically, we deal with these eroded areas a few
times per year after significant rain events. As Dick Fisher stated in an earlier email response, part of the design/improvements are to help reduce if not eliminate trail erosion.
I will discuss this with the contractor and determine what can be done within reason to prevent or reduce this while the project is ongoing. To be fair, it is not reasonable to expect
the contractor to be able to completely prevent this but I will ask that he puts forth a concerted effort.
As we are all aware, one of the main purposes of the BMPs is to prevent sediments and pollutants from entering the storm drains. Given the proximity of the project to any storm drain
elements, there is likely no concern that runoff from the site could potentially impact any storm drains. That being said, as you mentioned below, the side casted material and its impact
on the adjacent vegetation is most likely the focus of this concern. BMPs had not been placed by these material stockpiles at the time of the rain to my knowledge nor am I aware of
any appreciable runoff there. I will be on site today to review and discuss the plan moving forward to mitigate migration of the material into the adjacent vegetation.

Thank you, Anthony. Would you agree then from your email below that Danny did not implement BMPs previously, if there was significant erosion following previous rain events? I can respond
to FWS that the contractor did not install BMPs previously but will install them prior to the next rain event later this week, I just want to make sure that what I say is accurate and
that you’re in agreement since I’m putting it in writing. I assume the BMPs will include silt fencing, wattles, and other methods to contain soil and/or prevent large rills or erosional
features from developing. Looking at the photos that have been sent to the City and to the agencies, I think the concerns that they’re voicing are that sediment has just been sidecast
into areas that are otherwise supposed to be untouched. I don’t know how to resolve that short of pulling it all back very carefully at the end of the project, but they can at least
attempt to prevent it from going in deeper into the vegetation from rainfall, particularly the larger mounds that have been built up.

Good afternoon Danny,
Per the approved plans, specifications and special provisions of the subject project, eroded sediments shall be retained on site. During the most recent rain event on the trail, several
areas experienced significant erosion. As such, please install erosion control measures as required to prevent any further erosion prior to the next rain event. Please reach out to
me with any questions or concerns. If you would prefer, I am happy to meet with you on site to discuss.

FROM: C. Robin Smith,
RE: Canyon Loop Trail Project, California Gnatcatcher ITP
Greg,
As you know, this project is active. I had the pleasure of meeting with Ryan Wright last week along with another resident. We were grateful for Ryan's attention and help.
This morning, I sent an email request for information to Ryan. His automatic email message states he is out of the office until December 5th.
Will you please help me obtain this information today or tomorrow? I would like to come in to observe these records if they cannot be assembled quickly and sent to me via email in PDF
format. I request this information PDF to this email address, in any case.
PUBLIC INFO REQUEST
I request all forms of communication and correspondence between the City of Diamond Bar and anyone in the United States Fish and Wildlife agency, regarding the presence of the California
Gnatcatcher in the city and on the Canyon Loop Trail. Specifically, I wish to learn HOW the determination that an Incidental Take Permit was not necessary, occurred.
I appreciate the City's response and transparency in this matter.
Thank you.
