Following up on our conversation just now, I looked up the CDFW comment letter from November 2020 and the relevant bits from BIO-4 that will actually apply were provided supplementally
by CDFW. See below. So we adapted the MM #1 into the first paragraph of BIO-4 and then MM #2 is the last paragraph of BIO-4. You can see that in CDFW’s own language it doesn’t say that
the pre-construction survey report needs to be approved by CDFW prior to construction starting. It only says it needs to be submitted. Assuming the contractor has a biologist on-board,
they should be able to conduct a quick pre-construction survey either Wednesday afternoon or Thursday morning and get a brief memo out to CDFW by Friday afternoon, or earlier ideally.
I’ve reached out to Anisha to find out who she has been talking to there for this project.

Just curious, who did the contractor bring on as the biologist, and has the pre-construction survey been completed yet? Measure BIO-4 in the MMRP requires the results of the pre-construction
survey to be submitted to CDFW before construction starts.

I request all forms of communication and correspondence between the City of Diamond Bar and anyone in the United States Fish and Wildlife agency, regarding the presence of the California
Gnatcatcher in the city and on the Canyon Loop Trail. Specifically, I wish to learn HOW the determination that an Incidental Take Permit was not necessary, occurred.
