Dear City Clerk and Mr. Tao:
I am writing to formally appeal the Notice and Order to Vacate No Later Than October 18, 2021
(“Order”), that was served on September 30th, 2021.
I bought my condo on June 30, 2021. It is located at:
23617 Golden Springs Drive, Unit 27K
Diamond Bar, CA 91765
I have voluntarily, temporarily, evacuated based on the red-tag order on my door. I wish to
return to my condo and will temporarily vacate my unit for all tests where I am required to be
out of my unit. If the test results (by both the engineer and the city) deem my unit uninhabitable
and require a long-term evacuation while everything is fixed, I will do so. I do not believe there
is enough evidence at this time to support the red tags as the city did no testing of its own and
everything was based on a visual inspection without testing.
The Order demands that all residents vacate the Community by October 18, 2021 and provides
that any residents remaining may be subject to penalties including arrest. The Order notes that
the City’s determination is based on “conditions described in the June 15, 2017, and
September 22, 2021, reports and recommendations of structural and civil engineering firm
Khatri International, Inc.” Notably, the Order does not rely in any part on the City’s own reports
or inspections (as none have occurred) and the Khatri International, Inc. reports do not support
the Order’s evacuation requirement. The Order should be withdrawn or amended accordingly.
In particular, the June 15, 2017 Khatri International, Inc. report stated:
“The Buildings have extensive damage but do not pose an immediate life safety
threat, at the time of this inspection.”
Likewise, the September 22, 2021 report stated in pertinent part:
“3.1 Each building 2nd Floor units are RED Tagged due to impending risk from
the roof rafter conditions. The occupancy on the 2nd floor must be vacated to
allow for safe inspection with destructive testing on all the roofs for all 12
buildings. No work can commence until the 2nd floor of 11 buildings are fully
evacuated.”
The reports recommend that the 2nd Floor residents need to temporarily relocate for the
purpose of further testing and not necessarily an immediate evacuation.
There still needs to be destructive testing and other analysis performed - which will require the
residents to vacate during the testing and analysis - as the September 22, 2021 report was
based only on a visual inspection, but as it stands, I do not believe there is an immediate need
to evacuate until we learn the results of the tests.
The City proceeded to issue its own Order contrary to the statements and reports by Mr. Khatri
and without conducting its own investigation or reporting.
The Association issued its own notice to the residents on September 27, 2021 via email and
posted on the buildings based on its understanding of Mr. Khatri’s report and urged us to
voluntarily evacuate and not use our balconies as they determine the next steps they need to
take.
On Thursday, September 30, 2021, the City posted its Order, contradicting the Association’s
notice and Mr. Khatri’s recommendations, causing confusion, panic, and anxiety.
I request that the City retract the Order and issue a new order consistent with Mr. Khatri’s
reports or conduct its own investigation and testing and issue an updated order based on the
results thereof. If an evacuation is ultimately ordered or the Order remains in place, the City
needs to clarify steps and procedures for the evacuation. Further, I request the City provide
assistance to the owners and Association through monetary contribution towards relocation
costs and repairs.
