Appeal of evacuation for yellowtagged condo
The village at Diamond bar
10/5/2021
23601 Golden Springs Drive Unit 3A, Diamond Bar CA 91765
I Latania McGee, am the legal owner of the condominium located at The Village at Diamond bar, address 23601
Golden springs Drive unit 3A, I live at the bottom unit in buildiing A
along with my Husband and Son. I purchased the property in March 2019, and have lived there for over 2 years, I
have always paid my HOA dues and morgage on time, and used all of my savings to invest in this property. I want
to appeal the evacuation notice of my unit.
I was extremely horrified when On September 30th 2021, I along with 150 other condominium owners received a
notice to evacuate our residence in 18 days , due to an impending danger based on an building engineer report
that was submitted to the City of Diamond bar that says the building is immediately dangerous to life ,limb,
property of safety of the public.
The first building engineer report according to city documentation was in 2017 prior to me purchasing the
property, listing the same building findings, however nothing was done by the HOA to correct these issues . If there
was pending danger in these condo's in 2017 then it would appear there was no concern, or emergency at that
time, and it was not red/yellow tagged. My condominium located on the ground floor was yellow tagged, which
says moderately damaged to the degree that its habitability is limited . The HOA has not provided a time line for
repairs , how long owners will need to stay removed from their properties etc. owners still must pay their
morgage,HOA fees, and now include a new rental property that require a 12 month leasing agreement , time off
from work , moving cost relocation cost, which is extremely financially challenging, especially in an 18 day period.
if in fact the HOA had a specific time line of repair, how long we would need to be gone etc.we would have an Ideal
of events that were taking place and plan accordingly with an appropiate time line of 90 days etc. Since the
report does not list specific information on what makes our unit 3A ,moderately unlivable , we are requesting a
halt to the evacuation process for our lower unit until the testing is completed and actual repairs began, also
requesting to get appropiate notice and timeline, that is considerate and practical 60‐90 days etc.
Sincerely
Latania McGee
