Chiang and Judy Y. Chiang, Co-Trustees of the Revocable Trust of Grace Chin Chiang aka Grace C. Chiang dated June 29, 2004 (collectively “Owners”). This letter is to formally appeal the Notice and Order to Vacate No Later Than October 18, 2021 (“Notice”), that was served on October 1, 2021. Please direct all future communications to this office. A copy of said Notice is attached hereto for your reference. Please be advised that the Owners own the condominium unit located at 23617 Golden Springs Drive, Unit K-5, Diamond Bar, CA 91765 (“Subject Unit”). We have reviewed the Structural Evaluation Report (“Report”) dated September 22, 2021, prepared by Khatri International, Inc., structural and civil engineers, concerning the condominium development located at 23601 through 23665 Golden Springs Drive, Diamond Bar, CA 91765 (“Subject Property”). Page 17 of said Report shows that the first-floor units of Building “K” have Raymond Tao Kristina Santana City of Diamond Bar October 4, 2021 Page 2 of 4 Risk Rating of “Yellow” or “MEDIUM RISK; Moderate Damage to the exterior and drainage issues.” The Subject Unit is located on the first floor and considered at “Medium Risk.” The Subject Unit has not been red-tagged and is currently habitable. However, the City of Diamond Bar (“City”) is requiring ALL residents to vacate the Subject Property by October 18, 2021. Owners have owned the Subject Unit since October 2017. Prior to close of escrow, the Subject Unit was inspected by a licensed property inspector and the Subject Unit also passed termite inspection and clearance by a licensed termite inspector. Both the property inspector and termite inspector did not find any major issues with the Subject Unit and considered the Subject Unit to be habitable. The City of Diamond Bar has not presented any evidence whatsoever that the Subject Unit is not habitable under California law. If you do have such evidence, please forward the same to our office. Please be advised that Grace. C. Chiang is my mother, who is currently 87 years old, and living with my father, Frank Y. C. Chiang, who is currently 88 years old. They both live at the Subject Unit and are used to the environment. They are both in poor health with mobility issues. They were provided with only 18 days’ notice to vacate, in violation of their due process rights, especially since the Subject Unit is habitable. The Notice provided by the City also does not make any sense since it failed to identify the conditions to the Subject Unit that needed to be repaired or demolished in order to comply with the Notice. The Notice was addressed to each owner, not the Home Owner’s Association (“HOA”). It is our position, as indicated by the Report, that the Subject Unit is habitable. Grace Chiang and Frank Chiang only have a few years to live, and this mandatory evacuation of their home is a taking by the government without just compensation since they will never be able to return to their home. If you require them to vacate by October 18, 2021, then the City of Diamond Bar must provide them with a home, including a local Senior Living facility, since this is a taking without just compensation. In the alternative, the Owners kindly request that Grace Chiang and Frank Chiang be able to reside at the Subject Unit or grant them an extension to stay longer due to their advanced age and health issues. Grace Chiang and Frank Chiang will cooperate with the HOA if the HOA has a set schedule for mold remediation, construction work, or termite fumigation. They will work with the HOA and vacate the Subject Unit when necessary. Both the City of Diamond Bar and Management have not provided a schedule of work to be performed or any notification at all when the Owners/Residents may return to their home. From my experience litigating these types of cases, it could take 3-4 years before remediation is completed since there are a total of over 100+ units and remediation and rebuild cannot be done all at the same time. I am very familiar with how remediation and construction work since I have litigated numerous habitability cases. The Report shows the Subject Unit is at MEDIUM RISK. We also have evidence that the Subject Property is habitable since the Owners purchased the Subject Property not too long ago. A complete text of all codes is available at the City Clerk's Office. t628246.1 BUILDING OFFICIAL'S FINDINGS After inspections by a structural and civil engineer licensed by the State of California, and retained by the Diamond Bar Village Homeowners Association, inspection by City personnel, and review by the Building Official, the Property, including all residential units thereon, and the clubhouse building, have been determined to be substandard within the meaning of the Diamond Bar Municipal Code, State Housing Laws (California Health & Safety Code (hereinafter "H&S Code") Section 17920.3), California Civil Code, California Civil Code of Regulations Title 24, and/or all Uniform Codes adopted therein, including the 1997 Uniform Housing Code ("UHC")and the California Building Code ('CBe). (626) 351-4830 ____________________________________________________________________________________________ 2.0 FIELD OBSERVATIONS All 12 Buildings are typical in structural design and construction. They are designed as Type V Wood Frame Two Story with roof rafters and flexible diaphragms in the 1970s-80s construction. Over several decades there has been an accumulation of water damage, termite infestation, dry rot, and long term wear and tear on the Roofs with infestation damage leading into the structural walls. Photographs in this Report (Memorandum 2017-3; 6/15/17) and the previous Report (Memorandum 2017-2; 3/26/17) provide field notes that apply to all of the buildings. In summary these notes are: 2.1 The Roof Rafters are severely to critically damaged due to long term water/termite/dry rot damage. They will have to replaced along with the plywood sheathing. 2.2 Moisture damage does extend from the Roof Rafter line into the 2nd Story Walls down to/near approximately the 2nd Story Floor Line. This is noted on several photographs wherein these walls were exposed to show the existing conditions of the studs. The damage is extensive and some of these Walls will have to be reconstructed with new lumber. 2.3 The Balcony Beams are in good condition and do not require replacement. (626) 351-4830 ____________________________________________________________________________________________ structural and not load bearing, it is advised that these edge members should be replaced to avoid further spreading of termite/dry rot damage to the remaining healthy structural members in the Balcony and Second Floor Joists. 2.4 The Balcony Decks should be replaced with new decking material and waterproofing. 2.5 The Parapet of one of the Buildings will require to be replaced with a new connection to the existing Building. 2.6 Certain Buildings have potential Foundation cracking/damage that will require further investigation with exploratory Destructive Testing to expose their footings. Balcony Decks are not designed as permanent storage areas and should be vacated from all these extraneous loads that result in structural problems. 3.2 The Roof Rafters, Roof Sheathing, and all of the existing Spanish Tile will have to be removed and replaced with new materials.
