HomeMy WebLinkAboutFW_ Dec_ 4 Public Hearing Input_ Plus (3).msgHi Ricia and David, I’m forwarding the most recent correspondence received from Robin Smith and Robert Hamilton. Smith’s letter threatens litigation on the grounds of the EIR bio analysis unless the General Plan incorporates information and recommendations in Hamilton’s February 2019 report and subsequent EIR comments. Such info includes special status species he has surveyed (primarily gnatcatcher and cactus wren locations) and the mapping of the red-diamond rattlesnake, purportedly documented in the CNDDB. One of his recommendations not included in the General Plan is the establishment of 13 biological protection overlays within City, as mapped in his report. Hamilton’s letter takes issue with the responses to his DEIR comments. Both letters attack Steve Nelson’s credibility, based on what’s in the DEIR, how he responded to Hamilton’s DEIR comments, and statements he made at the December 4th Planning Commission meeting. (Recall, technology was not supporting Robb's presentation at the meeting.) Please distribute this information to the planning commissioners, put in the public record and include it in the council agenda package for their review Dec. 17th.
