Mr. Varner states that his understanding is that the Oversight Board intended to send the Resolution approving the sale of Tres Hermanos last week to the Department of Finance, but he is not sure if that occurred. He has referred our office to Ms. Schlichting to obtain these documents because he believes that they would have been sent by the Successor Agency staff acting as Oversight Board staff. His suggestion that these documents were sent last week comports with other (unverified) information we received that the Department of Finance has already received these documents. Please provide these documents as you have stated you would or inform us if you know definitively that they have not been created and/or sent to the Department of Finance. Pursuant to the Public Records Act, we requested on August 31, 2017 the Oversight Board’s Resolution of Approval from August 24, 2017 of the Tres Hermanos Ranch Sale from the Oversight Board Secretary, but she responded as the City Clerk and stated she does not have it. (See attached.) We asked again yesterday for the above resolution as well as documents forwarded to the Department of Finance in support of the Tres Hermanos Sale but were informed by the Industry City Attorney’s office that they do not have it and will provide these documents when they do have them. We have been told, but we do not know if this is true, that the Oversight Board resolution and supporting documents have already been sent to DOF. If this is true, pursuant to the Public Records Act, could you please provide copies of all such documents if they have been transmitted to DOF or inform us if the documents have not been transmitted?
