A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DIAMOND
BAR SETTING A PUBLIC HEARING TO DETERMINE WHETHER THE
PUBLIC NECESSITY, HEALTH, SAFETY, OR WELFARE REQUIRES
THE FORMATION OF AN UNDERGROUND UTILITY DISTRICT ON
BREA CANYON ROAD BETWEEN COOL SPRINGS DRIVE AND COLD
SPRING LANE AND DIRECT STAFF TO ADVERTISE THE PUBLIC
HEARING BEFORE THE COUNCIL AT THE NOVEMBER 16, 2021
REGULAR MEETING.
WHEREAS, per the Diamond Bar Mupal Code Section 13.04.030I prior to the
creation of an underground utility district, the City Council is required to hold a public
hearing to ascertain whether the public health, safety, or welfare requires the removal of
poles, overhead wires and associated overhead structures, and the underground
installation of wires and facilities for supplying electric, communication, or similar or
associated service, in any such district.
WHEREAS, it is proposed that an underground utility district be formed as shown
on Exhibit "A", a map entitled "Heritage Park Underground Utility District".
WHEREAS, the proposed underground utility district is proposed to be funded in
whole or in part through funding under Tariff Rule 20 of the California Public Utilities
Commission.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Diamond
Bar as follows:
Section 1. This Council hereby fixes 6:30 p.m. on November 16, 2021, in the
Windmill Community Room at City Hall, 2 18 10 Copley Drive, Diamond Bar, California, as
the time and place for a hearing before this Council on this question of whether the public
health, safety, or welfare requires the removal of poles, overhead wires, and facilities to
supply electric, communication, and associated services in the district as shown on the
attached exhibit map and hereby gives notice of said hearing.
Section 2. The City Clerk shall certify to the adoption of this Resolution; and
staff shall notify all affected property owners as shown on the last equalized assessment
rolls, and all affected utilities, by mailing a copy of this Resolution to such property owners
and utilities concerned, and cause a true and correct copy of this Resolution to be
published pursuant to California Government Code § 6061, at least ten (10) days prior to
the date set for said hearing.
