The City of Diamond Bar uses recycled paper and encourages you to do the same. DIAMOND BAR CITY COUNCIL MEETING RULES Welcome to the meeting of the Diamond Bar City Council. Meetings are open to the public and are broadcast live on Spectrum Cable Channel 3 and Frontier FiOS television Channel 47. You are invited to attend and participate. PUBLIC INPUT Members of the public may address the Council on any item of business on the agenda during the time the item is taken up by the Council. In addition, members of the public may, during the Public Comment period address the Council on any Consent Calendar item or any matter not on the agenda and within the Council’s subject matter jurisdiction. Persons wishing to speak should submit a speaker slip to the City Clerk. Any material to be submitted to the City Council at the meeting should be submitted through the City Clerk. Speakers are limited to five minutes per agenda item, unless the Mayor determines otherwise. The Mayor may adjust this time limit depending on the number of people wishing to speak, the complexity of the matter, the length of the agenda, the hour and any other relevant consideration. Speakers may address the Council only once on an agenda item, except during public hearings, when the applicant/appellant may be afforded a rebuttal. Public comments must be directed to the City Council. Behavior that disrupts the orderly conduct of the meeting may result in the speaker being removed from the Council chambers. INFORMATION RELATING TO AGENDAS AND ACTIONS OF THE COUNCIL Agendas for regular City Council meetings are available 72 hours prior to the meeting and are posted in the City’s regular posting locations, on DBTV Channel 3, Spectrum Cable Channel 3, Frontier FiOS television Channel 47 and on the City’s website at www.diamondbarca.gov. A full agenda packet is available for review during the meeting, in the foyer just outside the Council chambers. The City Council may take action on any item listed on the agenda. ACCOMMODATIONS FOR THE DISABLED A cordless microphone is available for those persons with mobility impairments who cannot access the podium in order to make a public comment. Sign language interpretation is available by providing the City Clerk three business days’ notice in advance of a meeting. ADJOURNMENT: Agenda #: 2.1 Meeting Date: January 27, 2020 TO: Honorable Mayor and Members of the City Council FROM: Daniel Fox, City Manager TITLE: APPLICANT INTERVIEWS AND CONSIDERATION TO MAKE AN APPOINTMENT TO FILL A VACANT CITY COUNCIL SEAT. STRATEGIC GOAL: Open, Engaged & Responsive Government RECOMMENDATION: A. Interview applicants; B. Discuss and take action as deemed appropriate to appoint an individual to fill the vacant City Council seat; and C. Administer the Oath of Office (if necessary). BACKGROUND/DISCUSSION: On January 7, 2020, the City Council took action to commence a process to fill the vacant City Council seat resulting from the recent resignation of former Council Member Carol Herrera. It was determined that the City Council would appoint a Diamond Bar resident to fill the remainder of the unexpired term through the November 2020 General Municipal Election. The appointed Council Member would likely serve through the first City Council meeting in December when the election results are typically certified. A total of 10 applications were received by the submittal deadline of 5:30 pm, Monday, January 20, 2020. City Clerk Kristina Santana has verified th at each of the applicants has met the minimum qualifications to be considered for the appointment. She has also communicated with the candidates to establish the interview schedule which is included in Attachment 1. Their submitted application materials (included in Attachment 2) are organized by applicant in interview-order. One applicant withdrew their application before the posting of the agenda. Applicant John Forbing is currently out of the country and thus unable to attend the interview, however his application has been included as the last application for Council’s consideration. 2.1 Packet Pg. 4 Following the interviews, the City Council may choose to appoint an individual to fill the vacancy. The new Council Member must be selected by a majority vote of the City Council. If the City Council is able to make a decision on an appointment, that individual may be administered the Oath of Off ice following such decision, making the appointment effective immediately. Alternatively, the Oath of Office may be administered at the beginning of the February 4, 2020 City Council meeting, making the appointment effective at that time. Should the City Council not be able to select an individual from the applicants interviewed, the Council may choose any additional process it deems appropriate to consider and select a new member. The City Council has until February 18, 2020 to make such appointment. LEGAL REVIEW: City Attorney has reviewed and approved this item as to form.
