Fax (909) 861-3117 www.DiamondBarCA.gov RE: AB 325 (Alejo) - Notice of Opposition Dear Assembly Member Alejo: The City of Diamond Bar opposes AB 325 (Alejo), which would expand the statute of limitations to file suit against a city's housing element to over four years. By exposing cities to an expanded window for potential litigation, AB 325 effectively destroys the confidence with which property owners and local government leaders can proceed with the decisions required to implement projects in their communities. The bill is an attempt to expand the current statute of limitations without regard to whether a city's housing element follows the letter of the law or a jurisdiction fails to adopt a housing element entirely. The ongoing possibility of a lawsuit looming over the City for over four years would have devastating effects on development and the local economy. For these reasons, the City of Diamond Bar respectfully opposes AB 325 (Alejo).
