A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF DIAMOND BAR APPROVING VARIANCE NO. 2005-01, A
REQUEST TO INCREASE THE NUMBER OF MONUMENT SIGNS
FROM ONE TO TWO, IN CREASE MONUMENT SIGN HEIGHT
FROM 6 FEET TO 8.25 FEET, AND REDUCE THE REQUIRED
SETBACK FROM 10 FEET TO 2 FEET FOR THE RANCH CENTER
IN THE COMMERCIAL MANUFACTURING ZONE, LOCATED AT
800-884 BLOCK OF N RTH DIAMOND BAR BOULEVARD,
DIAMOND BAR, CALIFOR IA—APN 8706-002-056 AND MAKING
FINDINGS IN SUPPORT THEREOF.

three public spaces at least 10 days before the public hearing.

conducted a duly noticed public hearing on the Application.

NOW, THEREFORE, it is found, determined and resolved by the Planning
Commission of the City of Diamond Bar as follows:
1. This Planning Commission hereby specifically finds that all of the facts set
forth in the Recitals, Part A, of this Resolution are true and correct.
2. Based upon substantial evidence presented to this Commission during the
above -referenced public hearing on March 8, 2005, including written and oral
staff reports together with public testimony, this Commission hereby
specifically finds as foll
(a) The application ap lies to property located at 800-884 North
Diamond Bar Boule and and the site is presently improved with a
commercial center. he site is known as the Ranch Center.
(b) The properties to the north and south are developed with commercial
centers, the property to the east is developed with single family
houses, and the property to the west is the State Route 57.
(c) The proposed monuent sign is increased by 2.25 feet, mostly due
by a river rock base nd a pitch architectural feature.
(d) The sign area for tenants has increased from 20 square feet to 28
square feet. The center name and logo add another 4 square feet.
The center name and logo re -enforce the center identity, which further
its image.
(e) Monument signs are set back approximately two feet from the
property line, which is consistent with the existing Acapulco
monument sign. Because of the existing mounding and the low river
rock wall, additional setback is not feasible for the monument sign.
Requiring the owner to re -grade the site and demolish the river rock
wall would place unnecessary and unreasonable hardship for the
property owner.
(f) The two new monume it signs are placed approximately 70 feet away
from drive entries, whi h according to the City's Traffic Engineer, do
not pose a traffic haz rd.
(g) Between 800 and 730 block of North Diamond Bar Boulevard, there
are four existing mon meat signs placed at 1 to 2 feet from the
property line, which is imilar to the proposed monument signs.
(h) The site is unusually d ep for a retail center and it is hindered by the
U -shape orientation of buildings. Tenants located in the rear have no
visibility from the stree that attracts customers.
(i) Other shopping centem such as those existing at the intersection of
Grand Avenue and D amond Bar Boulevard enjoy good visibility.
Therefore, the Ranch Center should be allowed to enjoy the same
substantial property rig is as other shopping centers.

Bar Village center I sated at Diamond Bar Boulevard and Golden
Springs Drive. Diarr and Bar Village center share the same condition
as in the Ranch Cer ter where there is no visibility from the street for
the buildings located at the rear of the property. Therefore a
precedent has been established.
(k) The proposed 'Varia ce will not be detrimental to the public health,
safety, convenience or welfare of the City.
(1) Granting the Variance will be consistent with the General Plan as it
will further the goals of economic development.
(m) Pursuant to the provision of the California Environmental Quality Act
(CEQA), Section 15061(b) of Article 5 of the Cafifornia Code of
Regulations and Guidelines promulgated thereunder, the City has
determined that this project is exempt and no further environmental
review is required.
Based upon the substantial evidence presented to this Commission during
the above -referenced public hearing and upon the specific findings of facts
set forth in paragraphs 1 arid 2 above, this Commission hereby finds and
concludes as follows:
(a) There are special

size, surroundings, topography, or other
conditions), so that the

Code denies the property
owner privileges enjoyed by other property
owners in the vicinity and
under identical zoning districts or creates an

it obviously impractical to require compliance
with the development

(b) Granting the Variance
is necessary for the preservation and
enjoyment of substantial
property rights possessed by other property
owners in the same vicinity
and zoning districts and denied to the
property owner for which
the Variance is sought.
(c) Granting the Variancis
consistent with the General Plan and any
applicable Specific PI

(d) The proposed entitlement would not be detrimental to the public
interest, health, safety, convenience, or welfare of the City.
(e) The proposed entitlement has been reviewed in compliance with the
provisions of the Calif 9mia Environmental Quality Act (CEQA).

4. Based on the findings and conclusions set forth in paragraphs 1, 2, and 3
above, the Planning Commission hereby approves the Application subject to
the following conditions:

(a) The project shall substantially conform to the Comprehensive Sign
Program 2005-01 labeled as Exhibit "A", as submitted and approved
