The property owner DBV Star, LLC, and the applicant, Steve Thorne of Pacific Dental Services, Inc., has filed an application for Comprehensive Sign Program No. 2002-02 in order to modify existing Planned Sign Program No. 92-04 for property located at 23341 Golden Springs Drive, Diamond Bar, Los Angeles County, California. Hereinafter in this Resolution, the subject Comprehensive Sign Program shall be referred to as the "Application." 2. On Setember 10, 2002, the Planning Commission of the City of Diamond Bar co ducted a meeting on the Application. 3. Pursua t to Chapter 22.44 of the Diamond Bar Development Code, a Comprehensive Sign Program does not require a public hearing or notifica ion of property owners surrounding the project site. However, Planning Commission review and approval is required. 4. The Planning Commission has reviewed the Application in accordance with the provisions of Chapter 22.36 -SIGN STANDARDS of the Diamond Bar Development Code. 5. Furthermore, the Categorical Exemption reflects the independent judgment of the City of Diamond Bar. 3. The Planning Commission hereby specifically finds and determines that, having considered the record as a whole including the findings set forth below, and changes and alterations which have been incorporated into and conditioned upon the proposed project set forth in the application, there is no evidence before this Planning Commission that the project proposed herein will have the potential of an adverse effect on wild life resources or the habitat upon which the wildlife depends. Based upon substantial evidence, this Planning Commission hereby rebuts the presumption of adverse effects contained in Section 753.5 (d) of Title 14 of the California Code of Regulations. 4. Based on the findings and conclusions set forth herein, this Planning Commission hereby finds as follows: (a) The project site is a shopping and professional center approved by Los Angeles County and constructed in the late 1970's and is approximately nine acres and developed with approximately 145,942 square feet of structure. The multi -tenant office building for which the proposed Comprehensive Sign Program amendment relates to is approximately 27,688 square feet of structure on a lot of approximately 23,240 square feet. (b) The project site has a General Plan land use designation of General Commercial. (c) The current zoning of the project site is Commercial Planned Development Zone (CPD). However, the project site is located within approved Zone Change No. 2002-01, which will change the zoning to Community Commercial (C-2). The Zone Change will become effective on September 20, 2002. (d) Generally, the following zones and uses surround the project site: To the north is the CPD zone; to the south is the R-3-1 U zone with Lorbeer Middle School and Mount Calvary Lutheran Church/School; to the east is the C -2 -BE zone; and to the west is the CPD zone and the R -3-15U zone developed with condominiums. (e) The amendment request relates to the installation of two illuminated wall signs on the second floor west and south facade of an existing office. Based on the findings and conclusions set forth above, the Planning Commission hereby approves the Application subject to compliance with the following conditions: (a) The project shall substantially conform to Comprehensive Sign Program labeled as Exhibit "A" as presented to the Planning Commission on September 10, 2002, and as amended herein. (b) Prior to the issuance of any sign permits, Exhibit "A" shall be modified to include the following, and submitted to the Planning Division for review and approval: (1) Wall signs shall be centered on each facade; (2) Trim caps and returns shall be gold and trim cap retaining screws shall be painted gold in order maintain consistency with the original sign program approved by the Planning Commission; (3) The letters shall utilize the Helvetica Medium letter style and green #2108 plexiglas with commercial Green neon in order maintain consistency with the original sign program approved by the Planning Commission; (4) Illuminated directory (as approved in the original sign program) shall be formulated to house the tenant's names at both entries located on the north and west side of the office building structure. (c) The site shall be maintained in a condition which is free of debris both during and after the construction, addition, or implementation of the entitlement granted herein. The removal of all trash, debris, and refuse, whether during or subsequent to construction shall be done only by the property owner, applicant or by a duly permitted waste contractor, who has been authorized by the City to provide collection, transportation, and disposal of solid waste from residential, commercial, construction, and industrial areas within the City. It shall be the applicant's obligation to insure that the waste contractor utilized has obtained permits from the City of Diamond Bar to provide such services. (d) Planned Sign Program No. 92-04 shall remain in full force and effect and shall incorporate Comprehensive Sign Program No. 2002-02 which amends Planned Sign Program No. 92-04. 4 (e) Prior to final inspection of the two approved wall signs and directory sign, the applicant shall paint the metal frame of all monument signs ' within the Diamond Bar Village Shopping and Professional Center. Paint color shall match the existing color of the frame of all monument signs (f) This entitlement shall not be effective for any purpose until the permittee and owner of the property involved (if other than the permittee) have filed, within fifteen (15) days of the approval date, at the City of Diamond Bar Community and Development Services Department, their affidavit stating that they are aware and agree to accept all the conditions of this grant. Further, this grant shall not become effective until the permittee pays any remaining City processing fees. The Planning Commission shall: (a) Certify to the adoption of this Resolution; and (b) Forthwith transmit a certified copy of this Resolution, by certified mail, to DBV Star, LLC, P.O. Box 5156, Diamond Bar, CA 91765 and Steve Thorne, Pacific Dental Services, Inc., 129 W.
